HomeMy WebLinkAboutReso 99-123 - Authorizing the Recovery of Cost for Certain Fire Dept Services �i J . �� � r '� ' � � RESOLUTION NO. 99-� A RESOLUTION OF THE CITY COUNCIL OF THE CITY 0►F REDDING AUTHORIZING THE RECOVERY OF COSTS FOR CERTAIN FIRE DEPARTMENT SERVICES. WHEREAS: A. Section 13009 of the California Health and Safety Code authorizes the collection by a public agency of the costs of fire suppression, rescue, and emergency medical services for fires involving negligence and violations of law. B. Section 13009.1 of the California Health and Safety Code further authorizes the collection by a public agency of the costs of investigating and making any reports with respect to those fires, as well as the costs of accounting and collecting. C. The City Council believes that a cost-recovery program should be established for the recovery of costs for certain Fire Department services. NOW, THEREFORE, BE IT RESOLVED that the City Council hereby authorizes the Fire Department to recover its costs for those fire department services authorized by the California Health and Safety Code, as more particularly set forth below: I. TYPES OF FIRES SUBJECT TO RECOVERY OF COSTS The types of fires subject to recovery of costs shall include, but not be limited to, brush or wildland fires. Circumstances of such fires shall conform to the conditions described in Sections 13009 and 13009.1 of the California Health and Safety Code. II. INITIATION OF COLLECTION PROCESS The Fire Department, under the direction and discretion of the Fire Chief, shall be entitled to initiate the collection process for the recovery of any and all costs as set forth in California Health and Safety Code Sections 13009 and 13009.1 for any and all fires described in Section I. herein. Recovery of costs shall be limited to actual costs, plus a $50 administrative charge as set forth in Section V. herein. III. LABOR COSTS FOR FIRE DEPARTMENT SERVICES The Fire Department shall use the hourly billing rates in effect at the time its services are rendered when computing the labor costs incurred by the Fire Department. � IV. FEE FOR ADMINISTERING COST-RECOVERY PROGRAM A fee of $50.00 shall be added to the labor and equipment costs to cover the accounting and collection costs, and the administrative costs of operating the cost- recovery program. VI. NONPAYMENT OF RECOVERABLE COSTS Nonpayment of the recoverable costs set forth herein shall give rise to civil remedies as described in Sections 13009 and 13009.1 of the California Health and Safety Code.
