RESOLUTION NO. 99-�
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
REDDING SUMMARILY VACATING A PORTION OF A 70' WIDE
PERMANENT NON-EXCLUSIVE EASEMENT AND RIGHT-OF-WAY
(I,OCATED IN THE 1VIT. SHASTA MALL PARKING LOT) FOR
UNDERGROUND UTILITY PURPOSES, GRANTED BY ERNEST W.
HAHN, INC. AND MT. SHASTA MALL ASSOCIATES TO THE CITY
OF REDDING.
WHEREAS:
A. A 70' wide permanent non-exclusive easement and right-of-way for
underground utility purposes was granted to the City of Redding by Ernest W. Hahn, Inc. and
Mt. Shasta Mall Associates on September 14, 1976, and recorded October 13, 1976, in Book
1371 of Official Records at page 232, Shasta County Records ("Easement"), as more
particularly shown on the map attached and made a part hereof by reference.
B. The utilities located within the crosshatched portion of the Easement have been
relocated, and the new easement was dedicated to the City of Redding on recorded Parcel Map
29 PM 70.
C. The property owner has requested the abandonment of the crosshatched portion
of the Easement, more particularly described in Exhibit "A" attached and made a part hereof.
D. The Public Works Department has advised the City Council that, with the
relocation of the utilities, there are no in-place public utility facilities that are in use or would
be affected by vacating the crosshatched portion of the Easement.

NOW, THEREFORE, THE CITY COUNCIL RESOLVES AND ORDERS AS �

1. The City Council elects to proceed in this matter under the provisions of the Public
Streets, Highways and Service Easements Vacation Law as set forth in Section 8330, et
seq., of the Streets and Highways Code of the State of California.
2. The crosshatched portion of the Easement is no longer needed for utility purposes; it
has been superseded by relocation; and there are no public facilities located therein.
3. The City Council approves the request to summarily vacate the crosshatched portion of
the Easement, more particularly described in Exhibit A and shown crosshatched on the
map attached hereto.
4. The City Clerk is directed to cause a certified copy of this resolution of vacation,
attested by the Clerk under seal, to be recorded in the office of the Shasta County
Assessor/Recorder.
5. From and after the date this resolution is recorded, the crosshatched portion of the
Easement hereby vacated shall no longer constitute a permanent non-exclusive easement
and right-of-way for underground utility purposes.
I HEREBY CERTIFY that the foregoing resolution was introduced, read and adopted
at a special meeting of the City Council on the 3rd day of August, 1999, by the following
vote:

Easement Abandonment
EXHIBIT "A"
A atrip of land 70.00 feet in width, lying 35.00 feet on
each side of a portion of the centerline of that certain
strip described as Parcel One in the Easement to the City of
Redding as recorded October 13, 1976 in Book 1371 of
Official Records at Page 232, Shasta County Records, said
portion of Parcel One being deacribed as follows:
Commencing at the one-quarter corner common to Sectiona
31 and 32, Township 32 North, Range 4 West, Mount Diablo
Meridian, as shown on that certain Parcel Map for E.W. Hahn,
recorded in Book 4 of Parcel Mapa, on Page 149, in Shasta
County Recorda;
Thence, North 00 degrees 57 minutes 06 seconds West,
along the centerline of Canby Road, a distance of 600. 11
feet;
Thence, leaving said centerline, South 87 degreea 52
minutes 30 seconda West, a distance of 118.77 feet;
Thence, South 87 degrees 39 minutea 49 aeconds West, s
distance of 353.46 feet to the Point of Beginning;
Thence, continuing South 87 degreea 39 minutea 49
seconda West, a distance of 245.00 feet to the Point of
Terminus of said centerline.
The side linea of the above described strip of land
shall be lengthened or shortened to begin and terminate on
lines bearing South 02 degrees 07 minutes 30 seconds East
through the above described Point of Beginning and Point of
Terminus.
