Code §6103 A.P.N. 071-430-37 RESOLUTION NO. 99-� A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING SUMMARII,�' VACATING A PORTION OF THE VARIABLE- W�TH PUBLIC SERVICE EASEMEN�' AT HOME CLUB ON OLD ALTURAS ROAD, SHOWN OR DEDICAT'ED B� PARC�L MAP RECORDED NOVEMBER 18, 1991, IN BOOK 28 OF MAPS AT PAGE 108, OFFICIAL RECORDS OF SHASTA COUNTY. WHEREAS: A. An easement was shown or dedicated to the City of Redding by the Parcel Map recorded November 18, 1991, in Book 28 of Parcel Maps at page 108 for the following purposes: Friendly Road; private sewer easement; public service easements; non-access strip; outline of existing and future stores; and building setback line (Easement). B. The property owner has requested the abandonment of the cross-hatched portion of the Easement, more particularly described in Exhibit A and shown on Exhibit B attached and made a part hereof by reference (Area of Vacation). C. The utilities located within the cross-hatched portion of the Easement have been relocated. D. The Public Works Department has advised the City Council that, with the relocation of the utilities, there are no in-place public utility facilities that are in use or would be affected by vacating the cross-hatched portion of the Easement. E. It is the recommendation of staff that the City summarily vacate the Area of Vacation. NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES AND ORDERS AS FOLLOWS: � � � � , ''j<=w a' ., <y--'--. ����� ���_���.��,�._. . � . ` � • � � 1. The City Council elects to proceed in this matter under the provisions of the Public Streets, Highways and Service Easements Vacation Law as set forth in Section 8333, et seq., of the Streets and Highways Code of the State of California. 2. The cross-hatched portion of the Easement is no longer needed for the purposes for which it was dedicated; the utilities located therein have been relocated; and there are no other public facilities located therein. 3. The City Council approves the request to summarily vacate the cross-hatched portion of the Easement, more particularly described in Exhibit A and shown crosshatched on Exhibit B attached hereto. 4. The City Clerk is directed to cause a certified copy of this resolution of vacation, attested by the Clerk under seal, to be recorded in the office of the Shasta County Assessor/Recorder. 5. From and after the date this resolution is recorded, the cross-hatched portion of the Easement hereby vacated shall no longer constitute an easement for the following purposes: Friendly Road; private sewer easement; public service easements; non- access strip; outline of existing and future stores; and building setback line.
