Code §6103 A.P.N. 050-430-44 RESOLUTION NO. 99-� A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING SUMMARILY VACATING TWO 15-FOOT-WIDE UTILITY (WATERLIlVE) EASEMENTS RECORDED IN BOOK 793 OF OFFICIAL RECORDS OF SHASTA COUNT�' AT PAGES 317 AND 323 RESPECTIVELY. WHEREAS: A. Through annexation the City of Redding acquired all rights in and to two 15- foot-wide utility easements for the conveyance of domestic water granted to the Cascade Community Services District by instruments recorded on June 22, 1954, in Book 793 of Official Records of Shasta County at pages 317 and 323 respectively (Easements). B. The instrument recorded in Book 793 at page 317 affects the northerly portion of the real property described in Exhibit A, and its location is shown on Exhibit B, attached and made a part hereof by reference. C. The instrument recorded in Book 793 at page 323 affects the southerly 15 feet of the real property described in Exhibit A, and its location is shown on Exhibit B. D. The Public Works Department has advised the City Council that the Easements have not been used for the purpose for which they were acquired for five consecutive years immediately preceding this proposed vacation; and there are no in-place public utility facilities that are in use or would be affected by vacating the Easements. E. It is the recommendation of staff that the Easements be summarily vacated. NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES AND ORDERS AS FOLLOWS: 1. The City Council elects to proceed in this matter under the provisions of the Public � Streets, Highways and Service Easements Vacation Law as set forth in Section 8333, et seq., of the Streets and Highways Code of the State of California. �'� �J \. �,`: r /�,��'��;?�..��r��`�r�✓���- ' � � � 2. Because the Easements have not been used for the purpose for which they were acquired for five consecutive years immediately preceding this vacation, the City Council approves the request to summarily vacate the Easements recorded on June 22, 1954, in Book 793 of Official Records of Shasta County at pages 317 and 323 respectively on the real property more particularly described in Exhibit A, with their location shown on Exhibit B. 3. The City Clerk is directed to cause a certified copy of this resolution of vacation, attested by the Clerk under seal, to be recorded in the office of the Shasta County Assessor/Recorder. 4. From and after the date this resolution is recorded, the Easements shall no longer constitute 15-foot-wide utility easements for the conveyance of domestic water.
