A RESOLUTION OF THE CITY COUNCII. OF THE CITY OF
REDDING SUMMARIL�' VACATING A 15-F�OT-WID� UTILITY
(WATERLINE) EASEMENT RECORDED IN BOOK 793 OF OFFICIAL
RECORDS OF SHASTA COUNTY AT PAGE 317.
WHEREAS:
A. Through annexation the City of Redding acquired all rights in and to a 15-foot-
wide utility easement for the conveyance of domestic water granted to the Cascade Community
Services District by instrument recorded on June 22, 1954, in Book 793 of Official Records of
Shasta County at page 317 (Easement). The Easement affects the real property described in
Exhibit A, and its location is shown on Exhibit B, attached and made a part hereof by
reference.
B. The Public Works Department has advised the City Council that the Easement
has not been used for the purpose for which it was acquired for five consecutive years
immediately preceding this proposed vacation; and there are no in-place public utility facilities
that are in use or would be affected by vacating the Easement.
C. It is the recommendation of staff that the Easement be summarily vacated.
NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES AND
ORDERS AS FOLLOWS:
l. The City Council elects to proceed in this matter under the provisions of the Public
Streets, Highways and Service Easements Vacation Law as set forth in Section 8333, et
seq., of the Streets and Highways Code of the State of California. �

2. Because the Easement has not been used for the purpose for which it was acquired for �
five consecutive years immediately preceding this vacation, the City Council approves �

the request to summarily vacate the Easement recorded on June 22, 1954, in Book 793
of Official Records of Shasta County at page 317 on the real property more particularly
described in Exhibit A; with its location shown on Exhibit B.
3. The City Clerk is directed to cause a certified copy of this resolution of vacation,
attested by the Clerk under seal, to be recorded in the office of the Shasta County
Assessor/Recorder.
4. From and after the date this resolution is recorded, the Easement shall no longer
constitute a 15-foot-wide utility easement for the conveyance of domestic water.
I HEREBY CERTIFY that the foregoing resolution was introduced, read and adopted
at a special meeting of the City Council on the 3rd day of August, 1999, by the following
vote:
