RESOLUTION NO. 99-�( A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING SUlVIMARIL-Y VACATING THE NORTHERLY 30' OF THE LANCERS I,ANE ROADWAY (PURSUANT TO CONDITION 6 OF LOT SPLIT NO. LS-3-97 [A-8-98]. WHEREAS, the remaining portion of Lancers Lane (the northerly 30') proposed for vacation was dedicated to the City for public use (street, drainage easements and public utility easements) on the Mt. Shasta Heights Subdivision as recorded January 19, 1977, in Book 14 of Maps at page 139, Shasta County Records; and WHEREAS, it is the recommendation of staff that the City summarily vacate the street portion of the northerly 30' of Lancers Lane, subject to the City reserving and excepting from the vacation a 30' drainage and public service easement and the right to maintain, operate, replace, remove, or renew the public utility facilities, as more particularly described in Exhibit A and shown on Exhibit B attached hereto and made a part hereof by reference, pursuant to condition 6 of Lot Split No. LS-3-97. NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES AND ORDERS AS FOLI,OWS: 1. The City Council elects to proceed in this matter under the provisions of the Public Streets, Highways and Service Easements Vacation Law as set forth in Section 8333, et seq., of the Streets and Highways Code of the State of California. 2. The City Council approves the request to summarily vacate the street portion of the northerly 30' of Lancers Lane as more particularly described and shown on attached ;�, .J�1�PAGEon� ��,., '��''��-/�-�� r � ' • � Exhibits A and B, subjeCt to the City reserving and excepting from the vacation a 30' drainage and public service easement and the right to maintain, operate, replace, remove, or renew the public utility facilities. The roadway has not been used for the purpose for which it was dedicated for five consecutive years immediately preceding this vacation. 3. The City Clerk is directed to cause a certified copy of this resolution of vacation, attested by the Clerk under seal, to be recorded in the office of the Shasta County Assessor/Recorder. 4. Subject to the City reserving and excepting from the vacation a 30' drainage and public service easement and the right to maintain, operate, replace, remove, or renew the public utility facilities [which was again dedicated to the City with the recording of Parcel Map LS-3-97 on November 24, 1998], from and after the date this resolution is recorded, the northerly 30' of Lancers Lane, described in Exhibits A and B, shall no longer constitute a street. Shasta Heights subdivision as recorded January l9, 1977 in Book 14 of Maps at Page 32 St�asta County Records, situate in the Northwest one-quarter of Section 32, Township 32 North, Range 4 West, City of Redding, County of Shasta, California, said portion of Lancers Lane to be abandoned being more particularly described as follows: Commencing at the Southeast corner of that portion of Canby Road dedicated on said 14 Maps 139, said corner also being the Southwest corner of Parcel 2 as shown on Parcel Map No. LS-3-97 as recorded in Book 32 of Parcel Maps at Page 94, Shasta County Records; Thence along the Westerly line of the lands described as Parcel A in the City of Redding Resolution No. 98-164 as recorded in Book 3785 of Official Records at Page. 371, Shasta County Records, North 04° 14' 45" West a distance of 196.01 feet; Thence North 02° 09' 41" West a distance of 233.38 feet to the Northwest corner of the lands described in said Parcel A and the Point of Beginning of this description of that portion of Lancers Lane to be abandoned by this document; Thence from said Point of Beginning, along the North line of said Parcel A, North 87° 50' 19" East a distance of 500.32 feet to the West line of Churn Creek Road and the Northeast corner of said Parcel A; Thence along the West line of Churn Creek Road, North 02° 09' 45" West a distance of 30.00 feet to the North line of Lancers Lane per said 14 Maps 32; Thence along the North line of said Lancers Lane South 87° 50' 19" West a distance of 500.32 feet to the Southwest corner of Parcel B as described in said Resolution No. 98-164; Thence South 02° 09' 41" East a distance of 30.00 feet to the Northwest corner of said Parcel A and the Point of Beginning.
