RESOLUTION NO. 99-�
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
VACATING A 5.01-ACRE UNIMPROVED PARK SITE LOCATED NORTH
OF OASIS ROAD AND EAST OF INTERSTATE 5 (A-16-98).
WHEREAS:
A. A 5.01 acre park site was dedicated to the City of Redding in 1995 with the filing of
� the Parcel Map for LS-21-91 to satisfy Condition #17 of the approval of the Victoria Knolls
Tentative Subdivision Map.
B. The applicant, on behalf of the property owners, no longer believes that the Victoria
Knolls Subdivision will proceed, and has requested the reconveyance of the five-acre unimproved
parcel dedicated to the City as a future park site. The park site is more particularly described in
Exhibit A and shown on Exhibit B attached and made a part hereof by reference.
C. Section 17.42.030 A. of the Redding Municipal Code provides that "In subdivisions
containing fifty parcels or less, the city shall require only the payment of fees and shall not require
the dedication of land."
D. Section 17.42.120 of the Redding Municipal Code states that "If the city council
determines that a dedicated site is not desired as a park site, it may return the site to the original
subdivider in exchange for payment of the in-lieu park fee that would otherwise have been
collected."
E. The Planning Commission, the Development Services staff, and the Community
Services staff support the applicant's request.
IT IS RESOLVED AND ORDERED BY THE CITY COUNCIL AS FOLLOWS:
1. Pursuant to Redding Municipal Code Section 17.42.120, the City Council hereby determines
that the 5.01 park site dedicated to the City, as more particularly described herein, is no �
longer desired as a park site; the public purpose for which the dedication was required does �
not exist. �

2. The City Council approves returning the undeveloped park site to the original subdivider by
way of a Quitclaim to be executed by the Mayor and attested by the City Clerk, subject to
the following conditions being met:
(a) Prior to the recording of this resolution, the applicant shall pay to the City of Redding
in-lieu park fees for two single-family residential parcels, in accordance with Chapter
17.42 of the Redding Municipal Code; and
(b) The City Clerk and the Public Works Department are directed to concurrently record
the following documents in the office of the Shasta County Assessor/Recorder:
First: This resolution;
Second: The Quitclaim Deed; and
Third: City of Redding Property Line Adjustment PLA-44-98 to merge the
abandoned park site with Assessor's Parcel No. 075-220-06.
I HEREBY CERTIFY that the foregoing resolution was introduced, read and adopted at a
regular meeting of the City Council on the 19th day of January, 1999, by the following vote:
