HomeMy WebLinkAboutOrdinance 2622 - Adopting RZ-2017-00063 & SP-2017-00082, River Crossing Marketplace ORDINANCE NO. 2622 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDDING ADOPTING REZONING APPLICATION RZ-2017-00063 AND SPECIFIC PLAN APPLICATION SP-2017-00082, RIVER CROSSING MARKETPLACE SPECIFIC PLAN, AND FINDING THE SAME TO BE CONSISTENT WITH THE GENERAL PLAN The City Council of the City of Redding Does Ordain as Follows: Section 1. Findings of Fact. The City Council finds and declares as follows: A. Redding's General Plan was adopted on October 3, 2000. B. A series of actions (Proposed Actions) is required to establish the River Crossing Marketplace Specific Plan, including: 1) General Plan Amendment GPA-2017-00067 to amend the General Plan Diagram from "Shopping Center" and "Residential, 6 to 10 units per acre" to "Regional Commercial;" 2) Rezoning RZ-2017-00063, to rezone the 25-acre project area from "SC" Shopping Center District" and "RM-10," Residential Multiple Family District to "RC," Regional Commercial District, said Rezoning to be adopted by ordinance; 3) Specific Plan Application SP-2017-00082, River Crossing Marketplace Specific Plan to establish the development regulations, standards, guidelines, site layout for the Specific Plan area, said plan to be adopted by ordinance. C. Pursuant to Government Code Section 65454, the River Crossing Marketplace Specific Plan is consistent with the General Plan's goals and policies including those that direct the City to take actions to maintain and expand Redding's influence as a regional trade center and encourage proposals for major shopping, specialty retail and other facilities that are regional in scale and to satisfy the retail market by providing a range of site sizes and locations in the community. The River Crossing Marketplace Specific Plan is necessary to properly implement these goals and policies of the General Plan. D. Pursuant to Government Code Section 65451, the River Crossing Marketplace Specific Plan includes all required text and diagrams. E. The boundaries of said Specific Plan are identified in Exhibit "A," attached hereto and incorporated herein by reference. F. The River Crossing Marketplace Specific Plan land use and zoning designations are consistent with the balance of the General Plan and Zoning Ordinance, respectively. G. The public necessity, convenience, and general welfare require adoption of the River Crossing Marketplace Specific Plan and proposed amendments to the Zoning Map district boundaries. H. The Redding Planning Commission held a public hearing on April 28, 2020, after providing all public notices required by State law and the Redding Municipal Code, at which time all members of the public were provided an opportunity to comment on all related environmental and planning documents submitted as required by law. At the meeting, the Planning Commission reviewed the River Crossing Marketplace Specific Plan and related Proposed Actions and, following the public hearing, recommended by Resolution No. 2020-02 that the City Council adopt the Proposed Actions cited above. I. An Environmental Impact Report has been prepared and certified by resolution of the City of Redding City Council on May 19, 2020, that describes and analyzes the significant effects of the River Crossing Marketplace Specific Plan, including discussion of ways to avoid the significant effects and those effects that will remain significant after mitigation measures are applied. Findings of Fact and a Statement of Overriding Considerations and the Mitigation Monitoring Program were adopted by said resolution of the City Council. J. The City Council on May 19, 2020, did conduct a public hearing, after providing all public notices required by State law and the Redding Municipal Code, to receive and consider evidence and testimony for and against the Proposed Actions at which time all members of the public were provided an opportunity to comment on the Proposed Actions as required by law. Section 2. Amendment of Zoning Map The "Zoning Map of the City of Redding, California," dated January 7, 2003, as amended, is hereby altered as set forth on the map attached hereto and made a part hereof, and, as provided for in Chapter 18.57 of the Redding Municipal Code, the "SP"" Specific Plan Overlay District is hereby combined with the zoning districts within the River Crossing Marketplace Specific Plan as depicted on the attached map exhibit, and the text of the new zoning district is set forth in the River Crossing Marketplace Specific Plan and is incorporated herein by reference. Section 3. Adoption of the River Crossing Marketplace Specific Plan The City Council does hereby adopt the River Crossing Marketplace Specific Plan. Section 4. Effective Date This ordinance shall take effect 30 days after the date of its adoption; and the City Clerk shall certify to the adoption of this ordinance and cause its publication according to law.
