A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
DECLARING FORMER RIGHT OF WAY PROPERTY LOCATED IN
SECTION 17, TOWNSHIP 31 NORTH, RANGE 4 WEST (PORTION OF
APN 070-180-034) AS EXEMPT SURPLUS PROPERTY, SUBJECT TO
THE RETENTION OF ANY EASEMENT(S), IF REQUIRED, FOR
PUBLIC SERVICE UTILITIES AND AUTHORIZING THE CITY
MANAGER, OR DESIGNEE, TO NEGOTIATE THE TERMS OF THE
SALE AND EXECUTE ANY OTHER DOCUMENTS NECESSARY TO
CONCLUDE THE SALE AND TO TRANFER TITLE TO THE BUYER
WHEREAS, the City of Redding owns right of way property located at Section 17,
Township 31 North, Range 4 West (Portion of APN 070-180-034), described in Exhibit A and
Exhibit B, attached; and
WHEREAS, the City of Redding has determined that there is not a need to retain the
property for public purposes, which was formerly designated street right of way and is eligible to
be summarily vacated; and
WHEREAS, the Surplus Property Act (California Government Code 54220 et seq.)
provides guidelines for localities to follow regarding the sale of City -owned property including
approval of the local governing body by resolution; and
WHEREAS, City -owned property prior to sale must be declared surplus or exempt
surplus with qualifying guidelines for disposal for said property; and
WHEREAS, surplus land that is former street, right of way, or easement, and is
conveyed to an owner of an adjacent property can be classified as exempt surplus property (Gov.
Code 54221(f)); and
WHEREAS, the property described in Exhibit A has, by resolution of the City Council
on May 19, 2020, been vacated for public use and is therefore former street and right of way; and
WHEREAS, the adjacent parcel is owned by Shasta Land Holdings, LLC, the potential
buyer;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDDING DOES
HEREBY RESOLVE THAT: 7'
1. The above recitals are true and correct..

2. The Property is declared exempt surplus property, subject to the retention of any
easement(s), if required, for public service purposes, and summarily vacated.

Sale of the Property by the City is categorically exempt from the requirements of the
California Environmental Quality Act (CEQA) pursuant to Section 15312 of the CEQA
Guidelines (Surplus Government Property Sales).
4. The Property will be sold to the adjacent property owner.
I HEREBY CERTIFY that the forgoing resolution was introduced at a regular meeting
of the City Council of the City of Redding on the 19th day of May, 2020, and was duly adopted at
said meeting by the following vote:

LEGAL DESCRIPTION
The land described herein is situated in the State of California, County of Shasta, City of Redding,
described as follows:
Being a portion of land located in Section 17, Township 31 North, Range 4 West, in the City of
Redding, Shasta County, State of California, more particularly described as follows:
All that portion of Bechelli Lane as described in that certain Relinquishment of Highways Right of
Way in the County of Shasta, Road 02 -SHA -5-6.811-18.811 Request No. 10003 recorded November
16, 1996 in Book 901 at Page 382, Shasta County Records and being a portion of Location 8
indicated by shading on those certain maps filed for April 19, 1965 in State Highway Map Book 7
at pages 8 through 27, inclusive, Shasta County Records, more particularly described as follows:
Beginning at the Southerly most corner of that 0.32 acre parcel described in Deed recorded in
Book 1442 at Page 546, Shasta County Records and being a point on the Westerly line of Parcel
1-A as described in the Final Order of Condemnation in Book 758 at Page 224; thence South
14°57'42" East along said Westerly line a distance of 158.61 feet; thence continuing along said
Westerly line South 13'19'10 East a distance of 144.62 feet to a point on the Southerly line of
Section 17 and being the Southeasterly corner of Parcel 1-C as described in the Final Order of
Condemnation in Book 758 at Page 224; thence South 89°42'31" East along the Southerly line of
said Section 17 a distance of 61.73 feet to a point on the Westerly line of State Highway
Interstate 5 as shown on Record of Survey recorded in Book 36 of Land Surveys at Page 53 (36 LS
53); thence North 13°19'10" West along the Westerly line of Interstate 5 (36 LS 53), also being
the Easterly line of said Location 8 a distance of 305.15 feet; thence North 17°47'08" West along
said Westerly line of Interstate 5 (36 LS 53) and the Easterly line of said Location 8 a distance of
17.53 feet; thence South 72°12'52" West a distance of 63.37 feet to the point of beginning.
