The meeting was called to order by Mayor Adam McElvain with the following Council
Members present: Erin Resner, Kristen Schreder, and Julie Winter. Council Member
Michael Dacquisto participated by teleconference.
Also present were: City Manager Barry Tippin, Assistant City Manager Sheri DeMaagd,
City Attorney Barry E. De Walt,Electric Utility Director Dan Beans,Fire Chief Cullen Kreider,
and Executive Assistant Anette Cates.
CLOSED SESSION
At the hour of 5:15 p.m., Mayor McElvain opened the Special Meeting and announced that the
Council would adjourn to Closed Session.
At the hour of 5:47 p.m., Mayor McElvain reconvened the Special Meeting to Open Session
and reported that in reference to:

Pursuant to Government Code section 54957.1(a), the City Council took no reportable
action on this item.
3C. Closed Session pursuant to California Government Code Section 54956.9(d)(4):
CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION
Initiation of Litigation
Two (2) potential cases
Pursuant to Government Code section 54957.1, the City Council hereby reports out
that, by unanimous vote, the City Attorney has been granted permission to seek to
intervene in Pacific Coast Federation of Fisherman's Association v. Ross (Case No.
3:19-cv-07897-LB) and California Natural Resources Agency v. Ross(Case No. 3:20-
cv-01299). The two cases are interrelated and relate to challenges to a biological
opinion issued by the National Marine Fisheries Service which, if upheld, would
authorize the incidental take of protected fish species resulting from the draw of surface
water by the City of Redding and others pursuant to their settlement contracts with the
Bureau of Reclamation.
