HomeMy WebLinkAboutReso 2020-035 - Shasta County Urgency Ordinance RESOLUTION NO. 2020-035 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING REQUESTING THE SHASTA COUNTY BOARD OF SUPERVISORS TO AMEND SHASTA COUNTY URGENCY ORDINANCE NO. SCC 2020-01 IN ORDER TO INCLUDE ALL AREAS WITHIN THE JURISDICTIONAL LIMITS OF THE CITY OF REDDING WITHIN THE SCOPE OF ORDINANCE NO. SCC 2020-01 WHEREAS, Redding Municipal Code 4.22.120 empowers the City Council of the City of Redding to declare a local emergency; and WHEREAS, on March 17, 2020, the City Council of the City of Redding, by resolution, adopted a declaration of local emergency due to the COVID-19 pandemic; and WHEREAS, on March 16, 2020, Governor Gavin Newsom issued Executive Order N- 28-20, which authorized local governmental entities to suspend evictions of tenants if the basis for the eviction is non-payment of rent arising out of a substantial decrease in household or business income caused by the COVID-19 pandemic; and WHEREAS, on March 24, 2020, the Board of Supervisors of the Count of Shasta adopted Urgency Ordinance SCC 2020-01, which enacted Chapter 8.65 of the Shasta County Code; and WHEREAS, Chapter 8.65 of the Shasta County Code prohibits evictions in the unincorporated areas of the County of Shasta through May 31, 2020, when such evictions result from a failure to pay rent caused by a substantial loss of income due to the COVID-19 pandemic; and WHEREAS, the City Council likewise anticipates that the COVID-19 pandemic will negatively impact the ability of commercial and residential tenants to make rental payments; and WHEREAS, the City Council desires to protect the health, safety, and welfare of the residents of the City of Redding by protecting commercial and residential tenants who have suffered a substantial loss of income due to the COVID-19 pandemic from evictions through May 31. 2020; and WHEREAS, the City Council hereby finds that inclusion of all areas within the jurisdictional limits of the City of Redding within the scope of Urgency Ordinance No. SCC 2020-01 will encourage a consistency of approach and application of the suspension of COVID- 19 related evictions between the City of Redding and the Count of Shasta; NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL THAT: 1. The recitals set forth above are true and correct. 2. The City Council does hereby request that the Board of Supervisors of the County of Shasta amend Urgency Ordinance No. SCC 2020-01 as soon as practicable so that Chapter 8.65 of the Shasta County Code applies within the jurisdictional limits of the City of Redding. 3. The City Clerk shall transmit a certified copy of this resolution to the Clerk of the Board of Supervisors.
