HomeMy WebLinkAboutReso 2020-018 - Schedule of Administrative Fines RESOLUTION NO. 2020-018 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING AMENDING THE SCHEDULE OF ADMINISTRATIVE FINES WHEREAS, Redding Municipal Code 1.13.070 provides that an enforcement officer of the City of Redding charged with enforcement of the Redding Municipal Code ("RMC") shall have authority to issue administrative citations to any persons responsible for violation of the RMC; and WHEREAS, RMC 1.13.090 provides that the amount of administrative fines imposed shall be set forth in a schedule of fines established by resolution of the City Council; and WHEREAS, RMC 1.13.090 further provides that the schedule of fines shall specify increased fines for repeat violations of the RMC within thirty-six (36) months, and shall further specify the amount of any late payment charges imposed for the payment of a fine after its due date; and WHEREAS, Government Code sections 53069.4 and 36900 establish parameters for the amount of administrative fines and penalties which may be assessed for violations of ordinances which are denominated as infractions; and WHEREAS, on June 21, 2016, by Resolution 2016-074, the City Council adopted a Schedule of Administrative Fines in accordance with RMC 1.13.090; and WHEREAS, on June 5, 2018, by Resolution 2018-057, the City Council adopted a Schedule of Administrative Fines in accordance with RMC 1.13.090; and WHEREAS, on March 19, 2019, by Resolution 2019-019, the City Council adopted a Schedule of Administrative Fines in accordance with RMC 1.13.090; and WHEREAS, amendments to the RMC necessitate that the Schedule of Administrative Fines be updated; NOW, THEREFORE, IT IS RESOLVED by the City Council of the City of Redding that the Schedule of Administrative Fines, are hereby amended and restated on the document entitled "Schedule of Administrative Fines," attached hereto and made a part hereof, and BE IT FURTHER RESOLVED that, in assessing the merits of any case, the Administrative Hearings Board and Finance Director are hereby vested with authority to reduce interest charges and establish a payment schedule for fines set forth in the Schedule of Administrative Fines as the interests of justice may require; and BE IT FURTHER RESOLVED that the Schedule of Administrative Fines attached hereto and approved pursuant to this resolution shall be effective as of the date of its adoption. d 0G' I HEREBY CERTIFY that the foregoing resolution was introduced and adopted at a regular meeting of the City Council of the City of Redding on the 18th day of February, 2020, by the following vote: AYES: COUNCIL MEMBERS: Dacquisto, Schreder, Winter, and McElvain NOES: COUNCIL MEMBERS: None ABSENT: COUNCIL MEMBERS: Resner ABSTAIN: COUNCIL MEMBERS: None ADAM McELVAIN, Mayor ATTEST: APPROVED AS TO FORM: PAMELA MIZE, City Jerk BAkXY E. The Finance Director (or designee) and Administrative Hearings Board may establish payment schedules and reduce or eliminate interest charges, on a case by case basis and at the sole discretion of the Finance Director or Administrative Hearings Board, respectively. Such payment schedules shall be in writing. In cases where the Finance Director has determined to enter into a written payment schedule, determinations to reduce or eliminate interest shall only be made in cases of financial hardship, as determined and at the sole discretion of the Finance Director.
