HomeMy WebLinkAboutOrdinance 2123 - Amending Title 18.06.020 ORDINANCE NO. �2.3 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDDING AMENDING SECTION 18.06.020 OF THE REDDING MUNICIPAL CODE RELATING TO THE REZONING OF CERTAIN REAL PROPERTY IN THE CITY OF REDDING (PD-3-94). The City Council of the City of Redding does ordain as follows: Section 1. That the boundaries of the districts referred to in Section 18.06.020 of the Redding Municipal Code as designated on a Map entitled "Zoning Map of the City of Redding, California," dated March 19, 1956, are hereby altered as set forth in the map attached hereto and made a part hereof by: Rezoning: 300 Mammoth Path From: "U" Unclassified District To: "PD" Planned Development District, subject to the Conditions of Approval attached hereto and made a part hereof. Section 2. The City Council has ratified the Negative Declaration prepared in connection herewith, finding that the project has no significant effect on the environment. Section 3. This Ordinance shall take effect 30 days after the date of its adoption. Section 4. The City Clerk shall certify to the adoption of this Ordinance, and cause its publication according to law. The standard conditions for subdivisions delineated in Resolution 92-18 shall be met, except as specified in the following conditions. 2. A final map is to be recorded prior to issuance of any building permit within Unit 2 of Phase I. 3. A current title report is to be submitted with the final map. 4. The City Attorney is to approve final annexation documents of the homeowner association's agreement prior to recording the final map. 5. Prior to the recording of a subdivision, an application to apportion any special assessment district lien (Improvement Bond Act of 1915)shall be on file with the City Treasurer with all fees to be paid. Streets and Circulation 6. Prior to recording a final map for Unit 2 of Phase I, the developer shall design and construct a center-lane turn pocket on Churn Creek Road at its intersection with Golden Gate Trail. The work shall include all necessary street widening and restriping. 7. Access rights along Churn Creek Road shall be waived. 8. A public-service easement shall be recorded over all private streets. 9. All private streets are to be improved on 1 side with a rolled or vertical curb and 3-foot-wide sidewalk on the same side as the parking lane. Either rolled or vertical curb shall be used on the side opposite the parking lane. 10. Prior to recordation, the developer shall improve the entrance to the clubhouse parking lot with a vertical curb and 3-foot-wide sidewalk. 11 . Names of private streets shall end in trail, path, trace, or walk as per Code Section 17.32.080.B3. 12. Low-profile, exterior lighting is to be provided for private streets at the time of development. April 21 , 1995 PD-3-94 Conditions of Approval Page 2 Sewer, Water, and Utilities 13. Sewer lines are to be extended, sized, and set at grades to permit the orderly extension of sewer service in accordance with the Master Sewer Plan. The developer shall obtain any necessary off-site easements for the extension of sewer lines to the planned development. 14. Water is to be provided in accordance with the requirements of the Bella Vista Water District and the Public Works Department, provided ISO standards are met. 15. Prior to recordation of a final map, a will-serve letter from the Bella Vista Water District shall be submitted to the Department of Public Works. 16. To provide City of Redding electric service, the developer shall extend City electric lines in accordance with adopted policies, standards, and charges of the City of Redding Electric Department. 17. Sewer, water, and other utilities; drainage facilities; necessary easements; and street dedications are to be provided in accordance with the Redding City Code and as approved by the Public Works Department. Drainage 18. Storm drains shall discharge into natural drainage courses. Off-site easement or drainage release shall be acquired, as necessary, to convey the storm runoff into a natural drainage course. 19. In accordance with Council Policy 1806, storm-drain detention measures, or other appropriate mitigation measures, shall be incorporated into project design to ensure that increases in storm-water runoff from the property would not occur as a result of development. This requirement may be met through the use of detention or retention facilities as approved by the City Engineer. These facilities may be located on or off site. Fire and Emergency Services 20. Fire hydrants to City specifications are to be installed in locations approved by the Fire Marshal and the Bella Vista Water District. 21 . Any perimeter fencing adjacent to an open-space parcel or lot fencing within 30 feet of an open-space parcel shall be constructed of noncombustible materials. 22. Prior to recordation of Unit 2, Phase 1, the developer shall remove the 2 barriers and construct 2 temporary emergency-vehicle turnarounds at the southern terminus of both Golden Gate Trail and Volcano View Trail per the specifications of the Fire Marshal. s � April 21 , 1995 PD-3-94 Conditions of Approval Page 3 Planned Development Requirements and Site Design 23. Final plans shall be approved by the Board of Administrative Review prior to recording of a final map. These plans shall consist of the final map and development details for grading, drainage, landscape, fencing, access control, street lighting, architectural standards, and common amenities. 24. Roofing and siding material shall be nonreflective. Roof pitches shall be 3 and 12 or greater. Roofing shall be limited to composition shingles or shake substitute. Siding shall be wood or masonite type. All units shall have 16-inch roof overhangs. 25. Front-yard setbacks shall be varied between 5 and 25 feet to prevent a straight-wall effect throughout the development. 26. The front yards of all lots are to be landscaped within 3 months of occupancy of any unit. This requirement is to be included in the conditions, covenants, and restrictions for the subdivision. 27. Exterior building setbacks are to be in accordance with Section 18.36.060 of the Redding Municipal Code. 28. The final map shall show easements or other mapped provisions for the placement of centralized mail-delivery units. Specific locations for such units shall be to the satisfaction of the Postal Service and the Public Works Department. 29. The developer shall provide 26 recreational vehicle parking spaces and a turnaround area per Section 18.62 of the Municipal Code. The storage area indicated on the site plan shall be improved with a minimum 6-foot-wide landscape planter along the north boundary line of the storage area behind a 6-foot-high masonry block wall, a 6-foot-wide block wall along the west boundary, and a 6-foot-wide landscape planter along the frontage of Buckhorn Walk. Screen trees shall be planted 25 feet on center within the planter along the north property line. The area between the existing block wall and the sidewalk along Churn Creek Road shall be landscaped. A landscape plan shall be incorporated with final plan review. Required landscape shall be installed prior to acceptance of improvements. 30. The existing gate and driveway located along the Churn Creek Road frontage of the recreational vehicle storage yard shall be limited to emergency access only. The access gate shall comply with the Control Gate Standards policy adopted by the City Fire Department. 31 . Prior to recordation of each phase, the developer shall provide recreational amenities per the schedule outlined in Exhibit "A" and as illustrated on Exhibits "B-1 " and "B-2." An irrigated landscape area shall be installed between the existing clubhouse facility and Golden Gate Trail and also between the west property line and the clubhouse facility and parking lot. All parking lot and landscape improvements shall be completed prior to the issuance of an occupancy permit. A landscape plan is to be approved by the Planning Department prior to issuance of a building permit. 33. All landscaped areas required by the approved landscape plans shall be properly and continuously maintained during the life of the use or activity authorized by the permit. Maintenance shall include providing an operational,automatic irrigation system;weeding; replacing dead and missing plant materials; mowing lawns; pruning; and other appurtenances as required to keep all planted areas neat, healthy, and attractive. 34. The area indicated as open space along the south boundary of the tentative map shall be established as a common area which shall then be maintained as open space by the homeowners' association of PD-4-86 and PD-3-94. 35. Prior to recordation of the final map, the developer shall pay in-lieu park fees in accordance with Chapter 17.42 of the Redding Municipal Code prior to recording the final map. The developer may receive credit up to 75 percent of the in-lieu park fees for any land dedications or active recreational amenities and/or improvements which are provided for residents of the planned development. The City Recreation and Parks Department shall make the determination as to how much credit will be given based upon information submitted by the developer about the design, construction, and cost of the amenities. 36. The type of home to be built within this planned development shall be limited to 1 of 3 floor plans which are indicated on Exhibit "C" (Plan 1276, Plan 1450, and Plan 1545). These units shall be constructed per the elevations indicated on Exhibits "D-1 ," "D-2," and "D-3." Additional plans or amended plans may be approved by final plan review. Exterior designs and materials may be approved with final plan review if approved by the Shasta Hills Estates Homeowners Association. i • EXHIBIT "A" The following recreational amenities shall be provided prior to recordation of Phase I, Unit 2: ► A shuffleboard court or comparable active recreational amenity. ► A walking trail (covered with Class 2 aggregate base) from Golden Gate Trail at the corner of Lot 91 following the existing abandoned fire road in the greenbelt along the rear of Lots 92 through 100, continuing to the top of the hill above the clubhouse and following the east crest of such hill to the clubhouse.
