The City Council of the City of Redding does ordain as follows: Section 1. That the boundaries of the districts referred to in Section 18.06.020 of the Redding Municipal Code as designated on a Map entitled "Zoning Map of the City of Redding, California," dated March 19, 1956, are hereby altered by: REZONING: Tierra Oaks Villa Planned Development PD-2-94 as shown on the map attached hereto as Exhibit A and made a part hereof by reference FROM: "U" Unclassified District TO: "PD" Planned Development District, ;subject to the Conditions of Approval attached hereto as Exhibit B and made a part hereof by reference. Section 2. The City Council has ratified the Negative Declaration prepared in connection herewith, finding that no significant effect on the environment is created hereby. Section 3. The standard conditions for subdivisions delineated in Resolution 92-18 shall be satisfied. 2. Prior to recordation of a final map, the developer/owner shall secure City Council approval of an amendment to the Tierra Oaks Annexation and Development Agreement to exceed the 225-residential-unit maximum specified in the agreement. 3. Prior to recordation of a final map,the Tierra Oaks Golf Course property shall be placed in an open-space easement granted to the City of Redding on behalf of the property owners within the Tierra Oaks residential development for the purpose of vacation and transfer of residential development rights. The form and content of the easement is to be approved by the City Attorney and the document is to be recorded by the City Clerk. Streets and Circulation 4. Upon recoidation'of a final map for Unit 1,the developer/owner shall dedicate necessary right-of-way along the entire project frontage on Old Oregon Trail to achieve a 48-foot-wide half section and 30-foot radius corner roundings at the intersection of Street "A." 5. The project frontage on Old Oregon Trail from the north boundary of the recreational vehicle parking area to the south project boundary shall be improved as follows: a. Vertical curb, gutter, and 5-foot-wide sidewalk adjacent to the subdivision. b. A 36-foot-wide paved section. c. Four-foot-wide graveled shoulder adjacent to the paved section. d. Necessary drainage facilities. e. A left-hand turn pocket at the intersection of Street "A" and at the entrance to the 10 RV parking area. f. Necessary transition tapers, including right-of-way acquisition. g. All striping and marking. These street improvements may be constructed in two phases with the first phase encompassing the frontage of Unit 1 at the time of its recording and the remainder of the street constructed with the recordation of Unit 3. 6. The improvements to Old Oregon Trail shall include additional right-of-way and paving as necessary for a bus turnout and additional width sidewalk to accommodate a bus shelter at the intersection of Road "A." The final design shall be incorporated into the PD-2-94/Tierra Oaks Villa Conditions of Approval Page 2 project improvement plans and be subject to approval by the Redding Area Bus Authority. 7. Ingress and egress rights to all property abutting Old Oregon Trail shall be waived, excepting Street "A" and the existing access to the Bella Vista Water District property. 8. A fee of $639 per lot shall be paid to the City of Redding at the time of issuance of a building permit to be placed in a fund solely for the purpose of financing the realignment of Old Oregon Trail between Bear Mountain Road and Paso Robles Avenue. The fee shall be adjusted annually on July 1 in accordance with the construction cost index as established by the Engineering News Record. Collection of this fee will cease in the event of construction of the street. This condition shall be stated on the final map and noted in the title report. The escrow instructions for the sale of each lot shall require the purchaser of each lot to sign a statement that they have read and understand this condition. A copy of the statement shall be recorded with the sale of each lot; noncompliance with this provision shall not nullify or affect the fee-payment requirement. 9. At the time of recordation of the 150th lot as cumulatively totalled between this project and the County-approved Tierra Oaks Planned Development,the developer shall acquire all necessary rights-of-way and construct Old Oregon Trail between La Crescenta Drive and Paso Robles Avenue generally along the alignment illustrated on the tentative map of PD-1-94 dated January 4, 1995, subject to approval by the County and City Public Works Departments. The road improvements shall consist of a 32-foot-wide paved section with a TI rating of 9 with 4-foot-wide gravel shoulders constructed to arterial street standards. The developer may be reimbursed from funds collected by the City or County specifically for the purpose of the Old Oregon Trail realignment, but will not be reimbursed beyond the amount collected. 10. The following conditions shall apply for future traffic improvements to the Oasis Road area. This condition and subconditions (a) and (b) shall be recorded on the final map and noted in the title report in their entirety. The escrow instructions for the sale of each lot shall require the purchaser of each lot to sign a statement that they have read and understand the conditions as noted below. A copy of the statement shall be recorded with the sale of each lot; noncompliance with this provision shall not nullify or affect the requirements of the conditions noted below: a. The fee for street improvements shall be $447 for each single-family lot and shall be due upon issuance of a building permit. The fee shall be adjusted annually on July 1 in accordance with the construction cost index as established by the Engineering News Record. b. Improvements to be funded by this fee include, but are not limited to, signalization at the Churn Creek Road/Oasis Road intersection and the reconstruction of the Oasis Road/Interstate 5 interchange. In the event a formal benefit district is established by the City Council for traffic improvements associated with Oasis Road,the benefit district fee shall prevail over the fee established by this condition. 11 . Street "A" shall have a 40-foot,vertical curb-to-curb section with 4-foot-wide sidewalk on both sides. Street "B" and Street "C" shall have 36-foot and 32-foot, curb-to-curb sections, respectively, with vertical curb on both sides and a 4-foot-wide sidewalk on one side. Parking shall be limited to 1 side of the street only. The Public Works Department shall approve the structural section of all private streets. 12. The interior private streets shall meet the standards for a design speed of 25 mph. Street grades shall not exceed 12 percent, except on Street "C" between Lot 8 of Unit 2 and Lot 6 of Unit 3, inclusive, where the maximum grade shall be 15 percent. 13. City-standard street lights shall be installed along Old Oregon Trail in accordance with the specifications of the City Electric Department and Electric Service Policy. Street lighting shall also be installed along the private streets in a manner approved during final plan review. Sewer, Water, and Utilities 14. Adjacent to Old Oregon Trail, the developer/owner shall dedicate to the City a 15-foot-wide, public-service easement; install City-supplied, 6-inch conduit and substructures; and install developer-supplied, 4-inch conduit and substructures in accordance with the specifications of the City Electric Department. 15. The developer/owner shall dedicate to the City a 15-foot-wide,public-service easement south of and adjacent to the existing Pacific Telephone and Telegraph easement along the north project boundary. 16. The developer/owner shall dedicate a 10-foot-wide, public-service easement between Lots 15 and 16 of Unit 3. 17. A public-service easement shall be recorded over all private streets. 18. Prior to recordation of a final map, a "will serve letter" from the Bella Vista Water District shall be submitted to the City Public Works Department. 19. Sewer service shall be extended to the project site in a manner approved by the Public Works Department. Approval of the tentative map does not infer City acceptance of the existing private lift station for provision of sewer service to this project; the City's preference is for gravity service. Drainage 20. The project shall include the design and construction of a storm-water detention facility designed to ensure that the existing rate of runoff from the property is not exceeded PD-2-94lTierra Oaks Villa Conditions of Approval Page 4 during a 10-, 25-, or 100-year peak event due to project development. The facility, location, design, and substantiating data shall be submitted with the project improvement plans. The detention facility may be located on site or off site. 21 . A construction Activity Storm Water Permit shall be acquired from the Regional Water Quality Control Board prior to the commencement of construction activity. Grading 22. During construction of the subdivision, clearing and grading shall be limited to those areas necessary to construct streets and install infrastructure. Installation of erosion- and sediment-control measures to protect Stillwater Creek shall be coordinated with the sequence of grading so as to be in place prior to October 15 of any year. 23. Slab construction requiring more than 3 feet of cut or fill is prohibited, excepting garages. House construction shall accommodate existing topography through split-level design, retaining walls, and raised stem walls. 24. Sufficient grading information for each individual lot development shall be submitted to the Public Works Department for a determination of the need for a grading permit prior to issuance of a building permit. A grading permit shall be issued concurrent with the building permit or a statement signed by the Public Works Department that a permit is not necessary. Up until the time that a residence is constructed on the lot, the escrow instructions for the sale of each lot shall require that the purchaser of each lot sign a statement that he/she has read and understands this requirement. This condition shall be noted on the final map. Fire and Emergency Services 25. A 20-foot-wide,emergency-access road shall be constructed from the cul-de-sac at the end of Street "B" to the existing driveway access to the Bella Vista Water District tank. The access shall be paved and gated in accordance with the specifications of the Public Works Department. 26. The access gate at Street "A" shall comply with the control gate standards policy adopted by the City Fire Department. 27. A firebreak management zone shall be created by selective clearing within 100 feet of all building pads, including encroachment into the open-space parcels as necessary. Selective clearing shall consist of the removal of a minimum of 75 percent of the underbrush and the limbing of trees from the ground to a height of 8 feet and shall occur in mass with construction of each phase of the project. To minimize any earth disturbance on steep slopes,the clearing shall occur by hand tools and small equipment; use of heavy equipment is prohibited. The cleared areas shall be immediately seeded and mulched to prevent erosion. A clearing plan shall be submitted with the subdivision improvement plans. The firebreak management zone shall be maintained by the property owners'association through periodic removal of combustible materials to ensure the viability of its fire-safety intent to the satisfaction of the City Fire Marshal. If this area is not adequately maintained, the City may maintain it at the property owner's expense. This provision shall be incorporated into the property owners' association documents of the planned development. 29. A 15-foot-wide, paved emergency access to the open-space areas shall be provided from the cul-de-sac at the end of Street "B" to open-space Parcel "A." The access shall be paved. 30. Any perimeter fencing adjacent to an open-space parcel or lot fencing within 30 feet of an open-space parcel shall be constructed of noncombustible materials. Planned Development Requirements and Site Design 31 . Final plans shall be approved by the Board of Administrative review prior to recording of a final map. These plans shall consist of the final map and development details for grading, drainage, landscape, fencing, access control, street lighting, architectural standards, and common amenities. 32. Individual building site development shall meet the following standards: a. Building height: A maximum of 30 feet as measured from the average foundation grade to the midpoint of the highest gable of a pitched or hip roof or deck line of a mansard. No residence shall have an exterior elevation greater than 2 stories in height as viewed from the street. b. Driveways: The maximum grade of driveways shall be 15 percent, and all driveways shall be paved. c. Setbacks: Front-yard setbacks may vary from 15 to 30 feet, excepting garages shall have a minimum 20-foot, front-yard setback where the garage door faces the street. Side-yard setbacks shall be 5 and 10 feet. The side-yard setback on the street side of a corner lot shall be 10 feet. Rear-yard setbacks shall be 15 feet on lots backing onto other lots and 30 feet for lots backing onto the perimeter property line or unimproved open space. d. Parking: Each dwelling unit shall have not less than 2 covered parking spaces in accordance with the standards of the City's Parking Ordinance. e. Accessory structures: A maximum of 1 accessory structure, excepting detached covered parking structures, is allowed on each lot. Accessory structures shall be located on the rear half of the lot within a minimum property-line setback of 5 feet and shall have a maximum height of 15 feet. PD-2-94/Tierra Oaks Villa Conditions of Approval Page 6 f. Landscape: All cleared areas from home construction shall be revegetated to control erosion. g. Retaining walls: All retaining walls which can be viewed from the street or adjoining lots shall be of decorative masonry material,stucco, heavy timber, or other material approved by the Planning Director. h. Fences and walls: Fences and walls shall be designed to appear as an extension of the architecture of the main residence. Chain-link or wire fencing is prohibited. Fencing within 15 feet of any of the open-space parcels shall conform to the requirements of the City's General Plan Safety Element. 33. A draft of provisions for ultimate ownership and maintenance of the commonly held parts of the development, including streets, utilities, structures, and open spaces, and a preliminary homeowners' association annual operating budget containing a sinking fund reasonably calculated to accumulate reserve funds to pay for major anticipated maintenance, repair, or replacement expenses, is to be approved by the City Attorney prior to recording of the final map. 34. The project shall be physically connected to the Tierra Oaks Golf Course through construction of a minimum 10-foot-wide paved access to the path within the course. 35. Full in-lieu park fees shall be paid at the time of recordation of a final map. 36. A 6- to 8-foot-high masonry wall or masonry post with wood-insert fence shall be constructed at the rear of Lots 1, 20, and 21 of Unit 1 and shall be set back 10 feet from Old Oregon Trail. The areas between the fence and the back of the sidewalk shall be improved with an automatic irrigation system and landscape to be maintained by the property owners' association. 37. The RV parking area shall be provided with Unit 3. The parking lot shall be screened from view by an 8-foot-high masonry wall or block-post fence with wood inserts or 6-foot-high fence on an earth berm a minimum of 2 feet in height. The fence shall be set back a minimum of 15 feet from the right-of-way line of Old Oregon Trail. This setback area shall be provided with an automatic irrigation system intensively landscaped with a combination of 15-gallon street trees, evergreen trees, and shrubbery designed to screen the area from view from Old Oregon Trail. The area between the property line and the back of the sidewalk on Old Oregon Trail shall be landscaped and added to the 15 feet of landscape on site. RESOLUTION NO. 92-18 STANDARD SUBDIVISION CONDITIONS 1 . Subdivision improvements are to conform to Title 17 of the Redding City Code. 2. A current title report is to be submitted with the final map. 3. Sewer lines, waterlines, electric-service facilities and other utilities. drainage facilities: necessary eiectric- and public-service easements: and street dedications are to be provided in accordance with the Redding Municipal Code and as specified by the Public Works Department. 4. The final improvement pians are to be reviewed by the Shasta Mosquito Abatement District. 5. No construction is to occur prior to approval of improvement plans and issuance of a grading permit. Grading plans shall include, but not be limited to, ail erosion-control measures, retaining wails required, slopes, and elevations. 6. The developer shall consult with the Electric Department after initial Public Works review of the subdivision improvement plans for preparation of an electric-service plan. A copy of the electric-service plan, developed by the Electric Department, shall be incorporated into the final subdivision improvement pians. 7. A soils report is to be submitted to the Public Works Department at the time construction drawings are submitted. 8. The street side-yard setback for comer lots is to be 10 feet and illustrated on the final map. 9. Grading is to be restricted to the period from April 15 to October 15 of any year unless a waiver is granted by the Director of Public Works. A discharge report is to be filed with the Regional Water Quality Control Board. Gracing shall not occur in areas depicted as open space on the tentative map. 10. Prior to the recording of a subdivision. an application to apportion any special assessment- district lien (Improvement Bond Act of 1915), accompanied by any applicable fees, shall be on file with the City Treasurer. 11. All street names proposed within the subdivision shall be given to the Planning Department at the time of submittal of subdivision improvement pians. One alternative street name shall be supplied for every four streets. A final map may not be recorded until Planning Commission approval of all street names. 12. A bamcade shall be installed at the end of all stub streets in accordance with specifications of the Public Works Department. 13.
