ORDINANCE NO. 2113 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDDING AMENDING SECTION 18.06.020 OF THE REDDING MUNICIPAL CODE RELATING TO THE REZONING OF CERTAIN REAL PROPERTY IN THE CITY OF REDDING (PD-1-94). The City Council of the City of Redding does ordain as follows: Section 1. That the boundaries of the districts referred to in Section 18.06.020 of the Redding Municipal Code as designated on a Map entitled "Zoning Map of the City of Redding, California," dated March 19, 1956, are hereby altered by: REZONING: Tierra Oaks Estates Planned Development PD-1-94 as shown on the map attached hereto as Exhibit A and made a part hereof by reference FROM: "U" Unclassified District TO: "PD" Planned Development District, subject to the Conditions of Approval attached hereto as Exhibit B and made a part hereof by reference. Section 2. The City Council has ratified the Negative Declaration prepared in connection herewith, finding that no significant effect on the environment is created hereby. Section 3. The City Clerk shall certify to the adoption of this Ordinance, and cause its publication according to law. All conditions apply, as appropriate, to any final map(s) filed as a phase of the approved tentative map, as determined by the County. Dedications and/or easements may be required for any such final map, as necessary, to provide for future s improvements, facilities, and/or access of a later phase. 2. The requirements of all concerned governmental agencies having jurisdiction,including, but not limited to, the issuance of appropriate permits, shall be met. 3. Note on the final map attachment sheet that the project is located in "Open Range" and is subject to all restrictions pertaining to "Open Range." 4. Approval of this final map is contingent upon approval for a rezoning of the project site to "PD" and/or appropriate zone district(s). 5. Road names shall be approved by the Development Services Department, Planning Division, prior to the recordation of the map. Road names shall be submitted at least 30 days prior to map recordation. 6. This project will be required to provide school bus stop area(s) and/or turnouts if and as required by the Shasta Lake Union School District and Shasta Union High School District. The location, design, and improvement of said areas shall be reviewed and approved by the Shasta Lake Union and Shasta Union High School District, Department of Public Works, and the California Highway Patrol prior to recordation of the final map. 7. The minimum front-yard building setback shall be 35 feet for all lots with an average depth of 150 feet or greater and 25 feet for all lots with an average depth of less than 150 feet. The average depth shall be determined by measuring the depth of the lot at the mid-point of the lot's street frontage. 8. If, in the course of development, any archaeological, historical, or paleontological resources are uncovered, discovered, or otherwise detected or observed, construction activities in the affected area shall cease and a qualified archaeologist shall be contacted to review the site and advise the County of the site's significance. If the findings are deemed significant by the Environmental Review Officer, appropriate mitigations shall be required prior to any resumption of work on the project. 9. Underground facilities that are to be placed under pavement or concrete shall be installed prior to the installation of the pavement or concrete. 10. Water supply main lines, appurtenant facilities, and service connections to each buildable parcel shall be installed in accordance with the construction and testing standards of the operating entity and the County's Fire Safety Standards and shall be approved by the operating entity and the responsible fire protection entity prior to the filing of the final map for Units 3, 4, 5, and 6. Wastewater collection system main lines, appurtenant facilities, and service connections to each buildable parcel shall be installed in accordance with the construction and testing standards of the operating entity and shall be approved by the operating entity prior to the filing of the final map. 12. The improvement plans for the water supply and wastewater collection facilities shall be reviewed and approved by the operating entity prior to the installation of the facilities. Prior to the filing of the final map, the applicant's project engineer shall provide as-built plans, a certificate of completion, and, if requested, an operations and maintenance manual to the operating entity. 13. Prior to the filing of the final map, the applicant shall pay all inspection, capital improvement, connection, and other capacity charges or fees as established by the operating entity for the water supply and wastewater collection facilities. 14. Ownership of all new water supply and wastewater collection facilities and the related rights-of-way and easements shall be dedicated to the operating entity prior to the filing of the final map. 15. All drainage from golf course shall be diverted to the on-site ponds. 16. No building permits shall be issued until sewer service is available from the City of Redding. Note on final map attachment sheet. Upon approval by Environmental Health Department, an interim sewage disposal facility for the golf course facility may be temporarily established and may be operated for up to 3 years from recording of the map for Unit 1 or until hook-up to the sewer system are available, whichever is earlier. 17. No structures shall be located within 50 feet of the top of the bank of Stillwater Creek. Note on final map attachment sheet. 18. Mitigation of impact fees to the Shasta Lake Union School District (or Gateway Unified School District after June 30, 1992) shall be paid prior to issuance of building permits unless alternative financing (such as A Mello Roos District) is approved by the district. Note on the final map attachment sheet. 19. The following conditions shall apply for future traffic improvements to the Oasis Road area. This condition and subconditions (a) and (b) shall be recorded on the final map and noted in the title report in their entirety. The escrow instructions for the sale of each lot shall require the purchaser and seller of each lot to sign a statement that they have read and understand the conditions as noted below; a copy of the statement shall be recorded with the sale of each lot; noncompliance with this provision shall not nullify or affect the requirements of the conditions noted below: a. The fee for street improvements shall be $411 for each single-family lot and shall be due upon issuance of a building permit. The fee shall be adjusted annually on July 1 in accordance with the construction cost index as established by the Engineering News Record (ENR). Improvements to be funded by this fee include, but are not limited to, signalization at the Churn Creek Road/Oasis Road intersection and the reconstruction of the Oasis Road/Interstate interchange. c. In the event a formal benefit district is established by the City Council for traffic improvements associated with Oasis Road, the benefit district fee shall prevail over the fee established by this condition. 20. Street lighting shall be supplied to the residential portions of the project. Shasta County Fire Department/California Division of Forestry: 21. Note on map attachment sheet: The land division is located in a "High" Fire Hazard Severity Zone under Section 4203 of the Public Resources Code of the State of California. 22. The California Division of Forestry/Shasta County Fire Department shall approve the installation of any gates or traffic control devices on the emergency access roads and main roads. 23. Cul-de-sacs shall be limited to 600 feet in length unless they are provided with a greenbelt (golf course) on both sides. 24. Driveways and street address markers will be required to meet the requirements of the Fire Safety Standards during the building permit process. Note on final map attachment sheet. 25. A California Division of Forestry/Shasta County Fire Department approved fire hydrant system is required. The system shall be installed and in service or bonded for prior to recording the map. The system shall be capable of providing a fire flow of 750 gpm in addition to the average domestic/irrigation use. Hydrants shall be spaced not more than 500 feet apart with no building site being more than 300 feet driving distance from a fire hydrant. 26. Untreated wood shake or shingle roofs are not permitted. Note on final map attachment sheet. 27. Brush and trees removed during land clearing and road construction shall be disposed of in accordance with Shasta County Standards prior to recording the map. 28. Unit 3 will require temporary turnarounds on Alicia Parkway and Sunny Heights Road. 29. Unit 5 will require that San Vincente Drive connect Alicia Parkway to Sunny Heights Road. 30. The design of the project includes the golf course. Road designs have been approved utilizing the golf course as a greenbelt. Therefore,the golf course must be constructed and the greenbelts established prior to commencing with the development of Unit 3. Y PD-1-94/Tierra Oaks Pla*Aevelopment - Amendment Conditions of Approval Page 4 31 . The following data shall appear on the final map: a. The limits of the area subject to inundation during a 100-year flood. b. The water surface elevation of the 100-year flood within the project limits. c. The location and elevation of all permanent vertical control bench marks within the project limits. Permanent bench marks shall be installed within the flood hazard areas at intervals not exceeding 1 ,000 feet along the watercourses. d. Conditions b. and c. above may be waived if the areas within the 100-year flood boundaries are designated as nonbuildable areas on the final map and buildings are prohibited within that area. Department of Public Works: 32. Alicia Parkway is to be a one-way street exiting the subdivision only unless the necessary widening is completed to the 2 bridges on Old Oregon Trail to allow for the installation of a left-turn pocket and acceleration tapers meeting County standards. An intersection plan will have to be approved by Public Works and alternate intersection locations will be considered. 33. Install approach guardrailing on all corners of both bridges on Old Oregon Trail north and south of the intersection of Alicia Parkway. The approach guardrail is to be installed at the time that the connection is made from Alicia Parkway to Old Oregon Trail. 34. Note on the map and the deed to all lots to be carried forth with the title to the land, the following: a. If the owners of the lots within the subdivision desire to create a two-way traffic connection at the south end of the subdivision (Alicia Parkway at Old Oregon Trail), it shall be all the owners' responsibility to provide widening of the 2 bridges in that vicinity and Old Oregon Trail to allow for the installation of a left-turn pocket and acceleration tapers meeting County standards. 35. Improvement plans prepared by a registered civil engineer must be submitted to and approved by the Department of Public Works prior to any construction. A plan checking fee will be required at the time the improvement plans are first submitted. 36. Construction of road improvements shall be completed or bonded for prior to recording the final map. 37. Drainage plans prepared by a registered civil engineer must be submitted to and approved by the Department of Public Works and Department of Environmental Health with the improvement plans. 38. All drainage work shall be completed or bonded for prior to recording the final map. PD-1-94/Tierra Oaks Plated Development - Amendment VP Conditions of Approval Page 5 39. Install main distribution lines as required by utilities to service all lots. Where underground utilities are located beneath the new pavement or concrete section, such utilities shall be installed, or conduits shall be installed to allow for future installation. These installations shall be approved by the utility company prior to placing pavement or concrete. 40. Label all non-County roads on a final map attachment sheet as private roads with a note that the owners of the property shown thereon shall participate in the maintenance of said roads through an approved Road Maintenance Agreement, acceptable to County Counsel. 41 . A 30-foot-reciprocal easement for all the double flag-lot driveways and a road maintenance agreement, in a form acceptable to County Counsel, shall be recorded with the deed to each parcel at the time it is first conveyed, and a note to this effect shall be placed on a final map attachment sheet. The road maintenance agreement shall be a part of the CC&Rs for the subdivision. 42. Install all street signs, traffic delineation devices, warning and regulatory signs, guardrail, barricades, and other similar devices where required by the Department of Public Works. Signing shall be in conformance with the Department of Public Works' standards and the current State of California Uniform Sign Chart. Installation of traffic devices shall be subject to review and modification after construction. The Department of Public Works will, at the subdivider's request and expense, install the signs. 43. Obtain street name approval form for required sign(s) from the Shasta County Development Services Department, then install or order from the Opportunity Center double plate street name signs at all intersections. Signs must meet the Board of Supervisors' approved standard. Contact the Opportunity Center at 1265 Redwood Boulevard for details on specifications or ordering of, sign(s). Street signs shall be paid for and a receipt submitted to the Subdivision Engineering Section prior to filing the final map. Unit No. 1: 44. Relocate fence along Old Oregon Trail to new right-of-way line prior to filing the final map for Unit 1 . Bonding will not be allowed. 45. Offer for dedication to Shasta County the following rights-of-way prior to filing the final map. Street name: Old Oregon Trail Limits: Along entire frontage Minimum Width: 30 feet from existing centerline or on an approved alignment. 46. At the time of recordation of Unit 3, the street connection of Old Oregon Trail with La Crescenta Drive will be improved with a left-turn pocket and acceleration/deceleration lanes as specified by the Department of Public Works. 48b. A fee of $639 per lot shall be paid to the City of Redding at the time of issuance of a building permit to be placed in a fund solely for the purpose of financing the realignment of Old Oregon Trail between Bear Mountain Road and Paso Robles Avenue. The fee shall be adjusted annually on July 1 in accordance with the construction cost index as established by the Engineering News Record (ENR). Collection of this fee will cease in the event of construction of the street. This condition shall be stated on the final map and noted in the title report. The escrow instruction for the sale of each lot shall require the purchaser and seller of each lot to sign a statement that they have read and understand this condition; a copy of the statement shall be recorded with sale of each lot; noncompliance with this provision shall not nullify or affect the fee-payment requirement. 48c. At the time of recordation of the 150th lot as cumulatively totalled between this project and PD-2-94,Tierra Oaks Villa, the developer shall acquire all necessary rights-of-way and construct Old Oregon Trail between La Crescenta Drive and Paso Robles Avenue PD-1-94/Tierra Oaks Pla"edevelopment - Amendment Conditions of Approval Page 7 generally along the alignment illustrated on the tentative map dated January 4, 1995, subject to approval by the County and City Public Works Departments. The road improvements shall consist of a 32-foot-wide paved section with a TI rating of 9 with 4-foot-wide gravel shoulders constructed to arterial street standards. The developer may be reimbursed from funds collected by the City or County specifically for the purpose of the Old Oregon Trail realignment, but will not be reimbursed beyond the amount collected. Unit No. 4: No conditions. Unit No. 5: 49. Offer for dedication to Shasta County and construct the following streets to Shasta County standards: a. Air Quality Management District: 53. Any future wood stove installation within project development shall be EPA certified Phase II systems. Note on final map attachment sheet. 54. Prior to any on-site grading, a fugitive dust permit shall be issued by the Air Quality Management District. PD-1-94/Tierra Oaks Plar'Rfed Development - Amendment Conditions of Approval Page 9 55. The developer shall cause the dedication of right-of-way necessary to achieve a 48-foot half section for Old Oregon Trail adjacent to the project frontage of the Tierra Oaks Planned Development and golf course from the point the realigned segment meets the existing street to the north project boundary. 56. Prior to recordation of the 155th lot, the project frontage of the Tierra Oaks Planned Development and golf course on Old Oregon Trail (Assessor's Parcel 306-560-30)from the point the realigned segment meets the existing street to the north project boundary shall be improved as follows: a. Vertical curb, gutter, and 5-foot-wide sidewalk on the west side of the right-of-way. b. Placement of road base, tie-in paving, street widening on the east side, and necessary overlay to provide a uniform 36-foot-wide street section. c. Four-foot-wide graveled shoulder adjacent to the east side of the paved section. d. Necessary drainage facilities. e. Street lights as per the standards of the City Electric Department. f. All striping, marking, and signing. 57. Curb, gutter, sidewalk, and other street-frontage improvements shall not be required for the development or issuance of a building permit on the 6 lots within Unit 2. 58. The minimum net lot size shall be 20,000 square feet. 59. The area of Lots 1 through 6 of Unit 2 located within the 100-year floodplain of Stillwater Creek shall be placed in an open-space easement dedicated to the City for open-space and flood-protection purposes. 60. The finished-floor elevation of all habitable structures on Lots 1 though 6 of Unit 2 shall be a minimum of 1 foot above the 100-year flood elevation of Stillwater Creek. The elevation shall be certified by a licensed surveyor or civil engineer with submittal of a building permit application. 61 . An on-site fire hydrant meeting the specifications of the City Fire Marshal shall be provided for flag Lots 43 and 44 of Unit 5, 18 and 19 of Unit 6, and 85 and 86 of Unit 6. 62. The existing access gate on La Crescenta Drive and the future gate at the south end of Alicia Parkway shall comply with the control gate standards policy adopted by the City Fire Department. Although an exit only, the Alicia Parkway gate shall be developed so as to allow access to the subdivision by the Fire Department for emergency response. The gates shall be set back a minimum of 100 feet from Old Oregon Trail to allow a driveway access to the adjoining City fire station site. 63. For the purpose of providing adequate emergency circulation, Alicia Parkway shall be improved with gravel, road base, or equivalent between Tierra Heights Road and San Vicente Drive to the satisfaction of the Fire Marshal prior to issuance of the 40th building permit within Unit 3. z PD-1-94/Tierra Oaks Plar1Tf"ed Development - Amendment Conditions of Approval Page 10 64. Prior to recordation of a final map,the Tierra Oaks Golf Course property shall be placed in an open-space easement granted to the City of Redding on behalf of the property owners within the Tierra Oaks residential development for the purpose of vacation and transfer of residential development rights. The form and content of the easement is to be approved by the City Attorney and the document is to be recorded by the City Clerk. 65. Prior to recordation of a final map, the developer/owner shall secure City Council approval of an amendment to the Tierra Oaks Annexation and Development Agreement to exceed the 225-residential-unit maximum specified in the agreement. 66. The developer/owner shall dedicate to the City a 15-foot-wide, public-service easement;install City-supplied, 6-inch conduit and substructures;and install developer- supplied, 4-inch conduit and substructures along that portion of Old Oregon Trail improved with curb, gutter, and sidewalk. 67. Upon recordation of the 6 lots identified as Unit 2, the developer shall install the following: a. Standard %-inch Bella Vista Water District service and meter. b. Standard 1-inch RPP backflow preventer, concrete pad, and metal enclosure. c. Necessary piping to connect the water meter to the RPP device. 68. Individual lot development shall conform to the architectural guidelines established with recording of the Tierra Oaks final map. Additional requirements shall be as follows: a. Minimum front-yard setbacks shall be in accordance with Condition 7; minimum side-yard setbacks shall be 10 feet; the minimum rear-yard setback shall be 15 feet. b. The maximum building height shall be 35 feet as measured from the average foundation grade to the midpoint of the highest gable of a pitched or hip roof or deck line of a mansard. 69. The standard conditions for subdivisions delineated in Resolution 92-18 shall be satisfied. A 50 percent credit toward the in-lieu park fee shall be granted upon development of the common recreational parcel in Unit 3 with a swimming pool, tennis courts, club house, or equal amenities. Full in-lieu fees shall be paid for any lots recorded prior to development of this parcel. The allowed credit shall not be retroactive. do RESOLUTION NO. 92-18 STANDARD SUBDIVISION CONDITIONS 1. Subdivision improvements are to conform to Title 17 of the Redding City Code. 2. A current title report is to be submitted with the final map. 3. Sewer lines, watenines, electric-service facilities and other utilities: drainage facilities. necessary electric- and public-service easements: and street dedications are to be provided in accordance with the Redding Municipal Code and as specified by the Public Works Department. 4. The final improvement plans are to be reviewed by the Shasta Mosquito Abatement District. 5. No construction is to occur pnor to approval of improvement plans and issuance of a grading permit. Grading plans shall include, but not be limited to, all erosion-control measures, retaining walls required, slopes, and elevations. 6. The developer shall consult with the Electric Department after initial Public Works review of the subdivision improvement plans for preparation of an electric-service plan. A copy of the electric-service plan, developed by the Electric Department, shall be incorporated into the final subdivision improvement plans. 7. A soils report is to be submitted to the Public Works Department at the time construction drawings are submitted. 8. The street side-yard setback for comer lots is to be 10 feet and illustrated on the final map. 9. Grading is to be restricted to the period from April 15 to October 15 of any year unless a waiver is granted by the Director of Public Works. A discharge report is to be filed with the Regional Water Quality Control Board. Grading shall not occur in areas depicted as open space on the tentative map. 10. Prior to the recording of a subdivision. an application to apportion any special assessment- district lien (Improvement Bond Act of 1915), accompanied by any applicable fees, shall be on file with the City Treasurer. 11. All street names proposed within the subdivision shall be given to the Planning Department at the time of submittal of subdivision improvement plans. One alternative street name shall be supplied for every four streets. A final map may not be recorded until Planning Commission approval of all street names. 12. A bamcade shall be installed at the end of all stub streets in accordance with specifications of the Public Works Department. 13. New utilities within the project. including, but not limited to, electric, cable television, and telephone, shall be installed underground. 14. Electric-suppiy facilities shall be fumisnea and installed in accordance with the Electric Utility Service Policy resolution currently in effect at the time the electric-service plan for the subdivision is signed by the City E ectric 0/ecartment.
