HomeMy WebLinkAboutOrdinance 2154 - Amending Title 9.20.190 And Title 1.12.020 y r i , • • ORDINANCE NO.0?/5 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDDING AMENDING SECTION 9.20.190 OF RMC CHAPTER 9.20 (FIRE PREVENTION) AND SECTION 1.12.020 OF RMC CHAPTER 1.12 (GENERAL PENALTY). Section L Section 9.20.190 of Redding Municipal Code Chapter 9.20 (Fire Prevention) is amended to read as follows: 9.20.190 Penalties A. In addition to any other remedy the City may have, a violation of the Uniform Fire Code as adopted pursuant to section 9.20.010,the provisions of Chapter 9.20, section 9.32.010, subsection E of section 16.08.020, or any state statute addressing fire prevention or fire control is punishable as follows: 1. A violation is an infraction punishable by a fine not to exceed one hundred dollars ($100.00); 2. A second violation of the same section within one year is an infraction punishable by a fine not to exceed two hundred dollars($200.00); and 3. A third violation of the same section within five(5)years of a first violation is a misdemeanor. B. In addition to any other remedy the City may have, a violation of section 9.20.180 is punishable as follows: 1. A violation is an infraction punishable by a fine of not less than one hundred dollars ($100.00)nor more than five hundred dollars($500.00); 2. A second violation within five (5) years of a first violation is an infraction punishable by a fine ofnot less than two hundred fifty dollars($250.00)nor more than five hundred dollars($500.00) Ri 3. A third violation within five (5) years of a first violation is a misdemeanor punishable by a fine of not less than five hundred dollars($500.00). ) Section 2. Section 1.12.020 of Redding Municipal Code Chapter 1.12 (General Penalty) is \ amended to read as follows: • • 4 1.12.020 Penalty. A. Any person convicted of a misdemeanor under the provisions of this code, unless provision is otherwise made in this code, shall be punishable by a fine of not more than one thousand dollars ($1000.00) or by imprisonment in the county jail for a period not more than six months, or by both such fine and imprisonment. B. Any person convicted of an infraction of the provisions of this code, unless provision is otherwise made in this code, shall be punishable upon a first conviction by a fine of not more than one hundred dollars, and for a second conviction within a period of one year by a fine of not more than two hundred dollars, and for a third or any subsequent conviction within a period of one year by a fine of not more than five hundred dollars. C. A bail schedule for parking violations shall be adopted by the city council and amended from time to time by resolution. Section 3. The adoption of this ordinance is exempt from the application of the California Environmental Quality Act pursuant to California Resources Code section 21080(b)(15). Section 4. This ordinance shall take effect 30 days after the date of its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause its publication according to law.
