HomeMy WebLinkAboutOrdinance 2144 - Amending Portions Title Chapter 9.20 • • ORDINANCE . /1/4/ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDDING AMENDING PORTIONS OF REDDING MUNICIPAL CODE CHAPTER 9.20, FIRE PREVENTION. The City Council of the City of Redding does ordain that Chapter 9.20 of the Redding Municipal Code be amended as follows, and that the City Clerk shall certify to the adoption of this ordinance and cause its publication according to law. 1. SECTION 9.20.010 SHALL READ AS FOLLOWS: 9.20.010 Uniform Fire Code Adopted. A. That certain document entitled "1994 Edition of the Uniform Fire Code with Appendices, of the International Conference of Building Officials, the Western Fire Chiefs Association, and the International Association of Fire Chiefs" is adopted as the Uniform Fire Code of the City and included in and made a part of this Code as though set forth at length herein. B. Three copies of the 1994 Edition of the Uniform Fire Code with Appendices, all certified to be true copies by the City Clerk, are on file in the office of the City Clerk and open to public inspection. C. As an amendment to the Uniform Fire Code, in addition to the requirements of Section 1003 of the Uniform Fire Code, no structure requiring a fire flow of 3,000 GPM or more as determined by Appendix III-A of the Uniform Fire Code, Fire Flow Requirements for Buildings, or more than two stories in height, shall be constructed or altered per the Uniform Building Code unless protected by an automatic sprinkler system meeting the requirements of Section 1001 of the Uniform Fire Code. All existingstructures shall meet the requirements of this section when, in the q ` opinion of the Chief, a change of occupancy or character of the occupancy is 1� made and a greater hazard to life or property exists or the required fire flows are increased. ; , Exceptions: 1. R-3 occupancies. • • 2. Alterations to buildings not exceeding fifty percent of the building value and not increasing the total fire flow requirement of the building. 2. SECTION 9.20.030 SHALL READ AS FOLLOWS: 9.20.030 Explosive and Blasting Agent Storage Limits. The limits referred to in Section 7702.2.1.1 of the Uniform Fire Code, in which the storage of explosives and blasting agents is prohibited, are established as the corporate limits of the City. 3. SECTION 9.20.040 SHALL READ AS FOLLOWS: 9.20.040 Flammable Liquid Storage Limits. A. The limits referred to in Section 7902.2.2.1 of the Uniform Fire Code, in which the storage of flammable liquids in outside aboveground tanks is prohibited, are established as the corporate limits of the City. Exceptions: 1. In residential districts, up to 50 gallons may be stored above ground; however, such storage shall not be within 50 feet of any sleeping quarters. 2. A maximum of 10,000 gallons may be stored above ground in tanks within special enclosures constructed as allowed by Section 5202.3.6 of the Uniform Fire Code, when approved by the Chief. B. Section 5202.4.1 is amended to add the following exception: Exception: Class I and Class II liquids may be dispensed into the fuel tank of a motor vehicle when the tank is enclosed as allowed by Section 5202.3.6 of the Uniform Fire Code, and the tank does not exceed a 10,000-gallon capacity. C. New bulk plants for flammable or combustible liquids shall be permitted only in M-2 industrial districts where such use is permitted by a use permit and meets the requirements of Section 7904.4 et seq. of the Uniform Fire Code. 2 • • 4. SECTION 9.20.050 SHALL READ AS FOLLOWS: 9.20.050 Liquefied Petroleum Gas Bulk Storage Limits. The limits referred to in Section 8204 of the Uniform Fire Code, in which the bulk storage of liquefied petroleum gas is restricted, are established as the corporate limits of the City, except for M-2 industrial districts where such storage may be permitted only with a use permit. 5. SECTION 9.20.060 SHALL READ AS FOLLOWS: 9.20.060 Explosive and Blasting Agent Transporting Route. The routes referred to in Section 7703.2 of the Uniform Fire Code for vehicles transporting explosives and blasting agents are established as provided by state law. 6. SECTION 9.20.080 SHALL READ AS FOLLOWS: 9.20.080 Marking Unsafe Areas. Whenever, in the opinion of the Chief of the Fire Department, the walls of a burned building are unsafe, or any pole, chimney, spire, steeple, electric wire, or other thing or object is in such a condition as to endanger human life or property on the public streets or elsewhere, the Chief of the Fire Department, or his authorized representative, may rope, fence or wall off parts of the public or private property adjacent thereto, and post suitable signs marked "DANGER" about same and red lights at night, and it shall be unlawful for any person to remove, mutilate, tear down or otherwise damage any sign, fence, wall or rope, or to walk, drive, operate or move any vehicle inside such rope, fence or wall. 7. SECTION 9.20.090 SHALL READ AS FOLLOWS: 9.20.090 Incinerator Permits. It is unlawful for any person to use, permit to be used, or cause to be used any incinerator within the corporate limits of the City for which an incinerator permit has not been issued. Incinerator permits will be issued only for commercial incinerators as described in the Uniform Mechanical Code and approved by the Air Pollution Control Board of the County. 3 • • 8. SECTION 9.20.110, BURNING AT CITY LANDFILL, IS REPEALED. I HEREBY CERTIFY that the foregoing ordinance amending portions of Redding Municipal Code Chapter 9.20, Fire Prevention, was introduced and read at a regular meeting of the City Council on the 2nd day of January , 1996; and read and adopted at a regular meeting of the City Council on the 16th day of January, 1996, by the following vote: AYES: COUNCIL MEMBERS: R.
