AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
REDDING AMENDING REDDING MUNICIPAL CODE TITLE 2,
ADMINISTRATION AND PERSONNEL, AND VARIOUS OTHER
SECTIONS, AS FOLLOWS:
1) Add Chapter 2.55, Community Services Advisory Commission;
2) Repeal Chapter 2.50, Tourism and Convention Commission;
3) Repeal Chapter 2.56, Recreation and Parks Commission—
Operations;
4) Amend all references to the Tourism and Convention Commission
and the Recreation and Parks Commission in various sections to
read the Community Services Advisory Commission;
5) Amend all references to the Director of Recreation and Parks and
the Parks Director to read the Director of Community Services;
6) Add Section 2.04.270, Acceptance and Use of Gifts, to Chapter
2.04 (City Council); and
7) Repeal Section 2.42.010, Terms of Boards and Commissions.
THE CITY COUNCIL OF THE CITY OF REDDING DOES ORDAIN AS
FOLLOWS:
Section 1. There is added to the Redding Municipal Code Chapter 2.55,
Community Services Advisory Commission, to read as follows:

COMMUNITY SERVICES ADVISORY COMMISSION

2.55.010 Commission Established.
There is created and established a community services advisory commission
which is named the "Community Services Advisory Commission," and which is
referred to in this chapter as the "commission."
2.55.020 Members—Appointment, Terms, Vacancies.
A. The commission shall consist of eight members—to be reduced to seven
members upon the resignation, removal or completion of term of office of one
of the members—who shall be either residents of the city, employed within the
city, or business owners of businesses located within the city.
B. The mayor shall appoint the members of the commission, subject to the
approval of a majority of the members of the city council.
C. The terms of office of the members of the commission shall be for four years,
commencing on January 1st of the year of appointment and continuing until the
end of the term or until removed or earlier vacated by the appointee.
D. The mayor shall appoint the initial members of the commission for the
following terms of office: three members shall be appointed for four years;
three members shall be appointed for three years; and two members shall be
appointed for two years. Subsequent appointments shall be for the regular
term of office as set forth in this section.
E. Except as provided in paragraph A, if a vacancy on the commission occurs for
any reason other than the expiration of a term of office of a member, the
mayor shall appoint a successor to the office for the unexpired portion of the
term of office, subject to the approval of a majority of the members of the city
council. The city clerk shall notify the mayor of any and all vacancies on the
commission.
2.55.030 Members—Removal.
A. Any member of the commission may be removed for any reason by a majority
of the members of the city council.
B. Any member of the commission who fails to attend two consecutive regular
meetings of the commission without the consent of the mayor to be absent shall
be considered automatically removed and a vacancy on the commission shall
be deemed to have occurred, unless a majority of the members of the city
council in their sole discretion finds good cause for the member's absence

and/or the member's failure to secure the consent of the mayor.
C. Upon the removal of a member of the commission pursuant to this section, the
mayor shall appoint a successor to the office for the unexpired portion of the
term, subject to the approval of a majority of the members of the city council.
2.55.040 Appointment of Commission Member Representative.
Unless otherwise provided in this code, if a member of the commission is
required or requested to be appointed as a representative of the commission to
another commission or other local, state or federal government committee or task
force, and this code does not specify the means or manner of the appointment, a
majority of the members of the commission shall select the member to be so
appointed.
2.55.050 Council and Department Liaisons to Commission.
The director of the community services department or his or her designee shall
act as a liaison between the community services department and the commission and
shall attend commission meetings. All staff services to the commission shall be
provided by the community services department. The director of the community
services department or his or her designee and the city council liaison appointed to the
commission pursuant to Section 2.04.230, if any, shall not be considered members of
the commission for any purpose.
2.55.060 Compensation.
All members of the commission shall serve without compensation.
2.55.070 Officers.
A. There shall be two officers in the commission, a chairperson and a vice-
chairperson. The chairperson shall preside at all meetings of the commission,
and in his or her absence the vice-chairperson shall preside.
B. The director of the community services department shall designate a staff
member of the department to serve as secretary to the commission. The
secretary shall make and keep a record of all the resolutions, transactions,
fmdings and determinations of the commission, and shall record and keep the
minutes of the commission meetings.
C. The commission shall elect the chairperson and vice-chairperson at the first
regular meeting of the commission in January of each year. The elected
chairperson and vice-chairperson shall hold office for a term of one year.
D. The initial members of the commission shall elect the initial chairperson and
vice-chairperson of the commission at the first meeting of the commission. The
terms of office of the initial chairperson and vice-chairperson shall commence
on the first meeting of the commission and continue until the first regular
meeting of the commission in January of the second year after the election.

Subsequent elections shall be for the regular term of office as set forth in this
section.
E. If a vacancy in the office of chairperson or vice-chairperson occurs for any
reason, the commission shall elect a successor to the office at the first regular
meeting of the commission after the vacancy occurs. The successor officer shall
serve the unexpired term of the office.
F. The chairperson and/or vice-chairperson may be removed from office for any
reason by a vote of the majority of the members of the commission. Upon the
removal of the chairperson or vice-chairperson, the commission shall elect a
successor to the vacant office. The successor officer shall serve the unexpired
term of the office.
2.55.080 Meetings.
The commission shall meet not less frequently than once each month, at such
day, hour and place as the members of the commission shall mutually agree upon.
The commission may adjourn any regular meeting of the commission from time-to-
time or place-to-place so long as the adjournment shall not extend to a point in time
beyond the day of the next regular meeting of the commission. The meetings of the
commission shall be open to the public, and notice of meetings shall be given as
required by law and to any news agency which files a request for notice with the
director of the community services department.
2.55.090 Meetings—Special.
A. The chairperson, or in his or her absence the vice-chairperson, or a majority
of the members of the commission may call a special meeting of the commission
by delivering personally or by certified mail to the following persons or
organizations a signed written notice of the special meeting at least seventy-two
(72) hours prior to the date that the meeting is to be held:
1. The director of the community services department.
2. All members of the commission who did not sign the written notice.
Written notice pursuant to this subsection may be dispensed with as to
any member who is actually present at the special meeting at the time it
convenes.
3. All newspapers, radio stations, and television stations which have filed
with the director of the community services department a written
request for notice of commission meetings.
4. All other persons or organizations to which notice of the special meeting
is required by law.
B. The signed written notice of the meeting shall specify the time and place of the
special meeting and the agenda therefor. At the special meeting, the
commission shall not consider any business not appearing on the agenda.

2.55.100 Meetings—Quorum.
A majority of the members of the commission shall constitute a quorum for the
transactions of business at any regular or special meeting of the commission.
2.55.110 Duties and Responsibilities of Commission.
The commission shall have the following duties and responsibilities:
A. To make recommendations to the city council and the department of
community services regarding the establishment of policies which foster,
facilitate, establish, encourage and maintain a systemized program of leisure
activities which may be made available to the residents and visitors of the city,
including the use of park or recreational facilities which may be located outside
of the city;
B. To make recommendations to the city council and the department of
community services regarding long-range planning of the development of park
improvements and open space policy improvements, as well as the funding
sources of said plans;
C. To make recommendations to the city council and the department of
community services regarding the city's tourism and convention promotion
activities;
D. To make recommendations to the city council and the department of
community services regarding the establishment of policies which are designed
to foster, facilitate, establish and maintain positive tourism, marketing,
publicity, advertising and promotion programs which will encourage tourists
to visit the Redding area, encourage convention activity, and seek to optimize
the use of the convention center;
E. To review proposed capital expenditures regarding parks, open space,
recreational programs and facilities and advise the city council and the
department of community services as to how the proposed capital expenditures
relate to the objectives and policies of the city regarding parks and recreation.
F. To review and make recommendations to the city council and the department
of community services regarding the pricing guidelines of the convention
center.
G. To make recommendations to the city council and the department of
community services regarding programs or proposals which may facilitate,
enhance or encourage positive tourism promotion programs and expanded
convention activities.
H. To make recommendations to the city council and the department of
community services regarding the funding and coordination of various tourism,
parks and recreation activities with other local and state or federal agencies.
I. To make recommendations to the city council and the department of
community services regarding additional parks, recreation, tourism or
convention center programs where deemed appropriate, and to review and

recommend policies for city council approval with respect to park development,
open space policies, recreational programs, tourism promotion programs, and
convention activities.
2.55.120 Use of Park and Recreational Facilities—Permits, Agreements.
A. Any and all persons or organizations desiring to engage in the following
activities shall apply to the director of the community services department for
a permit, agreement, lease or funding for such activity, and shall secure a
special event permit pursuant to Chapter 11.44 if required for such activity:
1. Use of any part or portion of the park and recreational facilities of the
city for an organized activity or event; or
2. Operation of a concession in connection with or upon any portion of the
park and recreational facilities of the city; or
3. Instruction of a city recreation-sponsored class; or
4. Any youth organization receiving budget-approved funding from the city
to offset its costs and expenses incurred in providing referees, umpires,
and related contractual responsibilities in connection with the various
types of sports and recreation activities participated in within the
framework of the city's recreational programs.
B. The director of the community services department shall administer the
issuance or denial of such requests in accordance with the ordinances of the city
and the regulations and policies established in connection therewith by the city
council and the commission.
C. In connection with such administration, the city council herein expressly
authorizes the director of the community services department to execute for
and on behalf of the city all such funding and service agreements, concession
leases, and park use permits, approved as to form by the city attorney,
provided the terms and conditions thereof are consistent with ordinances,
resolutions, regulations, and policies in effect at the time of such execution; and
provided further that the funding agreements do not exceed twenty-five
thousand dollars and are included in the adopted budget.
Section 2. Chapter 2.50, Tourism and Convention Commission, of the
Redding Municipal Code is repealed.
Section 3. Chapter 2.56, Recreation and Parks Commission—Operations,
of the Redding Municipal Code is repealed.
Section 4. All references to the Tourism and Convention Commission and
the Recreation and Parks Commission in the following Redding Municipal Code

Section 6. There is added to the Redding Municipal Code Section 2.04.270,
Acceptance and Use of Gifts, to Chapter 2.04 (City Council), to read as follows:
2.04.270 Acceptance and Use of Gifts.
Gifts, donations, legacies, or bequests of either real or personal property
or funds, from either a public or private source, designated to be for either park
or recreational use, or both, shall be considered by the city council, together
with any conditions or reservations contained therein, and the council shall
determine whether such gifts, donations, legacies, or bequests shall be accepted
subject to the conditions or reservations imposed, if any, or shall be rejected.
If accepted, funds from such gifts, donations, legacies, or bequests shall be
deposited in the city treasury and shall be used only for the purposes set forth
in the conditions or reservations set forth in the gift, donation, legacy, or bequest,
and only with specific approval of the city council.
Section 7. Redding Municipal Code Section 2.42.010, Terms of Boards
and Commissions, is repealed.
Section 8. The passage of this ordinance is not a "project" according to
the definition in the California Environmental Quality Act, and therefore is not
subject to the provisions requiring environmental review. In addition, portions of

this ordinance are ministerial actions listed in Council Policy No. 1805 as allowed
by Section 15268(c) of the California Environmental Quality Act Guidelines.
Section 9. This ordinance shall take effect 30 days after the date of its
adoption, and the City Clerk shall certify the adoption thereof and cause its
publication according to law.
