A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
ADOPTING THE MITIGATED NEGATIVE DECLARATION AND
APPROVING AN AMENDMENT TO THE GENERAL PLAN DIAGRAM
OF THE CITY OF REDDING RELATING TO THE LAND USE
CLASSIFICATION OF THE RANDHAWA PROPERTY (APN 109-080-
007) CONSISTING OF APPROXIMATELY 1.2 ACRES LOCATED AT
2450 GOODWATER AVENUE IN THE CITY OF REDDING (GPA-2019-
01429) AND APPROVAL OF THE SITE DEVELOPMENT PERMIT (SDP-
2019-1426)
WHEREAS,the City Council adopted the General Plan on October 3, 2000; and
WHEREAS, Government Code sections 65356 and 65358 permit amendment of the General
Plan by resolution adopted by an affirmative vote of not less than a majority of the total
membership of the City Council; and
WHEREAS, General Plan Policy CDD13A provides that amendments to the General Plan
Diagram not initiated by the Planning Commission will be considered appropriate where there is
a demonstrated need for additional retail commercial land to serve the existing and projected
retail market and that applicants for General Plan amendments shall provide a market analysis
sufficiently detailed to determine if the above market criteria are in evidence; and
WHEREAS, General Plan sets forth "Implementation Tasks" whereby the goals and policies of
the General Plan are to be furthered by implementation programs; and
WHEREAS, General Plan Implementation Task No.14 tasks the Development Services Director
with the obligation to develop guidelines for the project-size thresholds of the independent
market analysis required in General Plan Goal CDD13A and further limits the necessity for a
market analysis only to those General Plan Amendment requests for "significant retail and office
commercial land;" and
WHEREAS, Development Services Director Policy 2018-01 was adopted by the Director of
Development Services on July 24, 2018; and
WHEREAS, Development Services Director Policy 2018-01 directs that only those retail
developments of approximately ten (10) or more acres to be community serving and, therefore,
significant retail commercial developments and further provides that only proposed General Plan
amendments that allow for the development of retail commercial projects of approximately ten
(10) or more acres require the preparation of a market analysis pursuant to General Plan Policy
CDD13A.
WHEREAS, the amendment to the General Plan Diagram is desired to allow for the
development of a 3,180-square-foot convenience gas mart and carwash as identified in Site
Development Permit Application SDP-2019-01426 (the "Project"); and
WHERAS, the Planning Commission has reviewed the plans and conditions of approval for Site
Development Permit Application SDP-2019-01426 and recommended to the City Council that
the application be approved based upon the findings stipulated below; and
WHEREAS, the Planning Commission held a duly noticed public hearing pertaining to said
amendment on November 261h 2019, for General Plan Amendment Application GPA-2019-
01429 as described on the attached amendment to the General Plan Diagram and
WHEREAS, the Planning Commission has reviewed pertinent documents prepared in
accordance with the requirements of the California Environmental Quality Act and
recommended that the Mitigated Negative Declaration be adopted for GPA-2019-01429 after
consideration of all testimonial and written evidence submitted prior to and during the
aforementioned public hearing; and
WHEREAS, the City Council held a duly noticed public hearing on GPA-2019-01429 on
January 21, 2020;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDDING FINDS AND
RESOLVES as follows:
1. The above recitations are true, correct, and are adopted herein.
2. Based on the Initial Study and the information contained in the record, there will be no
significant effect on the environment. The City Council has reviewed the proposed
Mitigated Negative Declaration, all reports submitted by staff, and all testamentary and
documentary evidence presented at the public hearing, and hereby determines that the
Project as mitigated will not have an adverse impact on the environment.
3. The City Council, in the exercise of its independent judgment, hereby adopts the
Mitigated Negative Declaration for GPA-2019-01429 as referred to the City Council by
the Planning Commission.
4. The City Council hereby finds that the Project is a retail development of less than ten (10)
acres in size, that the application for a General Plan Amendment therefore does not
represent a request for"significant retail" land within the meaning of General Plan Policy
CCD13A, General Plan Implementation Task No. 14, and Development Services
Director Policy 2018-01 and therefore requires no market analysis.
5. The City Council hereby finds that the Applicant has demonstrated a need for additional
retail commercial land to serve the existing retail market as follows:
A. The Project will allow for the development of a convenience gas market and car
wash.
B. The Project area has only one other gas market located on the North side of State
Highway 44 and there are no other gas markets within a 2 mile radius and this
project.
C. The Project will facilitate service to the public living or working in the immediate
area of the Project due to the availability of more choices for the consumer.
D. The Project will further facilitate provision of gasoline for those traveling on State
Highway 44.
6. The City Council hereby approves the amendments to the General Plan Diagram as set
forth on the map attached hereto and made part hereof by;

7. The City Council hereby approves the Site Development Permit Application(SDP-2019-
01427) based on the following findings:
1. The proposed use will not be detrimental to the health, safety, and general
welfare of persons residing or working in the neighborhood of such proposed use.
The convenience gas mart use with the associated carwash at this site will have
impacts to the neighborhood in regards to traffic and general activity at the site for
longer hours. The conditions of approval require improvements that address these
impacts such as road improvements, additional landscaping, fencing and a new
traffic signal. Overall, the addition of a traffic signal and other improvements will
mitigate the impacts so that the use will not be detrimental to the health, safety
and general welfare of the neighborhood.
2. The proposed use will not be injurious or detrimental to the general welfare of the
city. The proposed project would not result in any detrimental effects upon the
health, safety, and general welfare of persons residing or working in the
surrounding neighborhood because the site has adequate distance separated by a
public road from residences and traffic flow will be improved by adding a traffic
signal. For the same reasons described under Finding 1, the proposed
convenience store and carwash would not be injurious or detrimental to the
general welfare of the City.
3. The proposed use is consistent with the goals and policies established by the
General Plan and the Redding Zoning Ordinance. The site is currently zoned
"LO" Limited Office with a General Plan classification of "Limited Office."
These current designations do not allow for convenience gas marts with a
carwash. The project requires a general plan amendment and rezoning to
Neighborhood Commercial and "NC" Neighborhood Commercial, respectively,
to allow for the development of a convenience gas mart with carwash at this site.
With the approval of the general plan amendment and rezoning applications, the
construction of the proposed convenience gas mart would be permissible. The
Redding Zoning Ordinance provides a process by which property owners can
petition the City Council to amend the General Plan classification and Zoning
designation of their property through a deliberative process that includes a public
hearing. This process was followed per the requirements established by the
Redding Zoning Ordinance.
4. The proposed use and project design are consistent with the design guidelines
established by resolution of the City Council in accordance with Redding Zoning
Ordinance Section 18.40.050, Design Criteria. The proposal is subject to the
adopted design criteria for commercial development referenced in the Redding
Zoning Ordinance. In accordance with the design criteria, the architectural design
of the proposal incorporates the use of various building materials and forms and
design techniques that provide interest and avoid long, blank walls along the
street front. The clear story on the roof elevation breaks up the boxy style of the
building. The varying stucco and colors add visual interest and help the proposal
meet the design criteria approved by City Council.
