HomeMy WebLinkAboutOrdinance 2184 - Revise Title 10 ORDINANCE NO. 2/fl/ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDDING REVISING THE REDDING MUNICIPAL CODE BY (1) ADDING CHAPTER 10.25, ALCOHOLIC BEVERAGES IN PUBLIC AREAS, AND (2) REPEALING SECTIONS 6.38.062 AND 6.38.063 (CHAPTER 6.38, REDDING DOWNTOWN MALL). The City Council of the City of Redding does ordain as follows: Section 1. There is hereby added to the Redding Municipal Code Chapter 10.25, Alcoholic Beverages in Public Areas, to read as follows: TITLE 10, PUBLIC PEACE, MORALS AND WELFARE Chapter 10.25 Alcoholic Beverages in Public Areas Sections: 10.25.010 Alcoholic Beverages on Public Streets or on Private Property Adjacent Thereto. 10.25.020 Violations—Penalty. 10.25.010 Alcoholic Beverages on Public Streets or on Private Property Adjacent Thereto. No person shall consume or have in his or her possession an open container of any alcoholic beverage: (1) on any public highway, alley, crosswalk, street or sidewalk or other place open for pedestrian travel; (2) on any public property; or (3) within fifty (50) feet of any public highway, alley, crosswalk, street or sidewalk or other place open for pedestrian travel while on private property open to public view without the express permission of the owner, his or her agent, or the person in lawful possession of the property. This section shall not apply to any person participating in events in a city park for which a permit has been issued pursuant to Chapter 10.20, so long as the person is in compliance with the terms of the permit. This section shall not apply to any person participating in events for which a special event permit has been issued pursuant to Chapter 11.44, if the special event permit contains the following conditions: A. Alcoholic beverages consumed or possessed at such events shall not be in glass or metal containers; B. The organizer of the special event shall comply with all state and local laws relating to the sale of alcoholic beverages; C. The organizer of the special event shall provide adequate toilet facilities; D. The organizer of the special event shall comply with all other conditions as required by the Police Department, Department of Community Services —Recreation and Parks Division, Redding Convention Center, and Risk Management Department. Nothing in this section shall be construed to make unlawful any act or acts which are permitted by any law of the state. 10.25.020 Violations—Penalty. Violations of Section 10.25.010 shall constitute an infraction punishable by a fine not to exceed one hundred dollars ($100.00); a second violation within one year is an infraction punishable by a fine not to exceed two hundred dollars ($200.00); and a third violation within five (5) years of a first violation is a misdemeanor. Section 2. Sections 6.38.062 and 6.38.063 of the Redding Municipal Code are hereby repealed. Section 3. The passage of this ordinance is not a "project" according to the definition in the California Environmental Quality Act, and therefore is not subject to the provisions requiring environmental review. Section 4. This ordinance shall take effect 30 days after the date of its adoption, and the City Clerk shall certify the adoption thereof and cause its publication according to law.
