The City Council of the City of Redding does ordain as follows: i n 1. There is hereby added to the Redding Municipal Code Chapter L1.44, Special Events, to read as follows: TITLE 11, VEHICLES AND TRAFFIC Chapter 11.44 Special Events Sections: 11.44.010 Definition and Purpose. 11.44.020 Issuance of Permits, Generally. 11.44.030 Use of City Park and Recreational Facilities - Permit. 11.44.040 Standard Parade Routes - Permit. 11.44.050 Other Special Events - Permit. 11.44.060 Use of State Highways, Sacramento River or Bridges. 11.44.070 Vehicular Traffic and Parking Closures. 11.44.080 Cost of Special Event. 11.44.010 Definition and Purpose. A. The words "special event" as used in this chapter shall include any organized s activity or event, whether organized by a non-profit entity, private enterprise, 'V individual, or other, which utilizes city streets or property, city park and \ recreational facilities, or which impacts pedestrian and/or vehicular traffic or parking, including, but not limited to, film productions, parades, races, marches, walks, celebrations, stationary events, or large gatherings. B. In enacting this chapter, the City Council finds that the issuance of permits for special events and the imposition of terms and conditions to any such permits, including provisions for the temporary closure of streets, are actions that may be delegated to the appropriate city staff. 11.44.020 Issuance of Permits, Generally. Except for permits which may be issued solely by the Department of Community Services, Recreation and Parks Division, all permits shall be issued by the City Clerk subject to the provisions of this ordinance and subject to the resolutions and policies of the City Council not in conflict herewith. 11.44.030 Use of City Park and Recreational Facilities - Permit. Persons or organizations wishing to use any portion of city park and recreational facilities for a special event shall apply to the Department of Community Services, Recreation and Parks Division, for a permit pursuant to section 2.55.120. If the special event impacts pedestrian and/or vehicular traffic or parking, the applicant must also apply to the City Clerk for a special event permit pursuant to section 11.44.050. The Department of Community Services, Recreation and Parks Division, may impose terms and conditions upon any permit for the use of any portion of city park and recreational facilities. 11.44.040 Standard Parade Routes - Permit. The City Council may establish standard parade routes by resolution. Persons or organizations wishing to use a standard parade route shall apply to the City Clerk for a special event permit pursuant to section 11.44.050. Ref. Resolution 90-429 11.44.050 Other Special Events - Permit. Persons or organizations wishing to hold a special event shall apply to the City Clerk for a special event permit. Upon receipt of an application for a special event permit, the City Clerk shall circulate the application to the following departments of the city for comment and approval: Police Department; Fire Department; Department of Community Services, Recreation and Parks Division; Public Works Department, Streets and Transportation Divisions; Redding Convention Center; and Risk Management Department. These departments may impose terms and conditions upon the special event permit, and issuance and approval of the permit is conditioned upon compliance with the required conditions. 2 11.44.060 Use of State Highways, Sacramento River or Bridges. A. Any special event which requires use of state highways shall require a permit from the California Department of Transportation. Persons or organizations wishing to hold a special event which utilizes any portion of a state highway are responsible for obtaining any necessary permits or approvals from the California Department of Transportation. B. Any special event which requires the use of the Sacramento River or bridges across it may require a permit from the state or other appropriate jurisdiction. Persons or organizations wishing to hold a special event which utilizes the Sacramento River or bridges across it are responsible for obtaining any necessary permits or approvals from the state or other appropriate jurisdiction. 11.44.070 Vehicular Traffic and Parking Closures. A. The Director of Public Works or his or her designee, in cooperation with the Chief of Police or his or her designee, may temporarily prevent vehicular and/or pedestrian traffic and/or parking on any street for a special event when, in the opinion of the Director of Public Works or his or her designee, the prevention of vehicular and/or pedestrian traffic and/or parking is necessary for the safety and protection of persons who are to use that portion of the street(s) during the special event. B. If the Director of Public Works or his or her designee determines that street closure is necessary, then upon compliance by the applicant of the terms and conditions of the special event permit and any permit issued by the California Department of Transportation, the Director of Public Works or his or her designee, in cooperation with the Chief of Police or his or her designee, shall temporarily prevent vehicular and/or pedestrian traffic and/or parking on all streets impacted by the permitted special event for such length of time as is deemed necessary for the safety and protection of persons who are to use that portion of the street(s) during the special event. C. If the Director of Public Works or his or her designee determines that street closure is necessary, then at least five business days prior to the special event the Director of Public Works or his or her designee shall provide notice of the closure to owners and/or tenants of property located on the street that is to be closed. The Director of Public Works or his or her designee shall, in his or her discretion, determine the appropriate form of the notice required to be given under this section. The Director of Public Works or his or her designee may require, as a condition of the special event permit, that the organizer of the special event provide the notice required to be given under this section. 3 11.44.080 Cost of Special Event. A. The organizer of a special event shall be responsible for the costs associated with the special event, including, but not limited to, the cost of city services related to the special event. B. The organizer of a special event may apply to the City Council for co-sponsorship of a special event and request a waiver of some or all of the cost of city services related to the special event. The organizer of a special event making such a request shall make the request in writing directed to the City Council. Any portion of the cost of city services not waived by the City Council is the sole responsibility of the organizer of the special event. Section 2. The passage of this ordinance is a ministerial action listed in Council Policy No. 1805 (established by Resolution 93-114) as allowed by section 15268(c) of the California Environmental Quality Act Guidelines. Section 3. This ordinance shall take effect 30 days after the date of its adoption, and the City Clerk shall certify the adoption thereof and cause its publication according to law.
