AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF REDDING ESTABLISHING A MORATORIUM ON THE
ISSUANCE OF ALL BUILDING PERMITS AND OTHER
DEVELOPMENT PERMITS WHICH PROVIDE FOR OR
ALLOW FOR USES NOT IN CONFORMITY WITH THE
GENERAL PLAN.
THE CITY COUNCIL OF THE CITY OF REDDING DOES ORDAIN
AS FOLLOWS:
Section 1. Findings of Fact. The City Council finds and declares as
follows:
A. Certain R-3 Zoning Districts remain within the City which
are not in conformity with the Land Use Element of the General Plan applicable to
the area subject to the R-3 Districts. Where such zoning inconsistencies exist, the
inconsistency with the General Plan violates the provisions of Government Code
Section 65860.
B. An urgency ordinance is necessary for the immediate
preservation of the public peace, health, and safety in that the issuance of a
building permit to allow development which is inconsistent with the General Plan
inhibits community-desired development patterns and prevents the General Plan
from acting as the constitution for development within the City, the foundation
upon which all land use decisions are to be based.
Section 2. Ordinance Provision. Effective immediately, no building
permit or other development permit shall be issued which conflicts with the
applicable density requirement of the Land Use Element of the General Plan.
Any such development permit is deemed to be inconsistent with the General Plan,
notwithstanding its consistency with a zoning district.

Section 3. Pursuant to the findings of fact made herein, this ordinance is
hereby declared to be an urgency ordinance, and shall take effect immediately.
I HEREBY CERTIFY that this ordinance was introduced, read and
adopted at a special meeting of the City Council on the 4th day of August, 1998,
by the following four-fifths vote:

NOES: COUNCIL MEMBERS: None
ABSENT: COUNCIL MEMBERS: Anderson
