HomeMy WebLinkAboutMinutes - City Council - 2019-11-05135 Redding City Council, Regular Meeting Civic Center Council Chambers 777 Cypress Avenue Redding, CA 96001 November 5, 2019, 6:00 PM The meeting was called to order by Mayor Julie Winter with the following Council Members present: Michael Dacquisto, Adam McElvain, Erin Resner, and Kristen Schreder. Also present were: City Manager Barry Tippin, Assistant City Manager Sheri DeMaagd, City Attorney Barry E. DeWalt, Development Services Director Larry Vaupel, City Clerk Pamela Mize, and Executive Assistant Anette Cates. The City Manager introduced Department Directors that were in attendance: Public Works Director Chuck Aukland, Electric Utility Director Dan Beans, Fire Chief Cullen Kreider, Community Services Director Kim Niemer, Information Technology Director Tony Van Boekel, and Finance Director/City Treasurer Allyn Van Hooser. The Pledge of Allegiance to the Flag was led by Mayor Winter. The Invocation was provided by Jen McCloskey, Redding Police and Fire Department's Chaplain. PRESENTATIONS 2A. Resolution - honoring Roger Moore for his distinguished service as the Redding Police Department Chief of Police. Mayor Winter read and presented a resolution of the City Council of the City of Redding to retired Police Chief Roger Moore and, on behalf of the City Council and a grateful community, she thanked Chief Moore for his dedication, exemplary service, and the manner in which he served the City as a Redding police officer and Chief of Police for 24 years. Retired Police Chief Moore expressed his appreciation to Council and praised his staff for their hard work, enthusiasm and dedication to serving the community. He also thanked the City Council for their support over the years, opining that effective law enforcement is a partnership which requires cooperation at all levels of local government and the assistance of the community. Bruce Ross and Erin Ryan, representing State Senator Brian Dahle and U.S. House of Representatives Congressman Doug LaMalfa, presented Chief Moore with Certificates of Recognition for his years of dedicated service to the community. Police Captain Brian Barrier presented a Thin Blue Line American Flag signed by the Redding Police Department to Chief Moore. A MOTION WAS MADE by Council Member Resner, seconded by Council Member Schreder, to adopt Resolution No. 2019-107, a resolution of the City Council of the City of Redding, honoring retired Chief of Police Roger Moore for 24 years of outstanding services to the City of Redding. Presentation provided by Brandy Isola, Interim Branch Director of the County of Shasta Health and Human Services Agency, Public Health Services, including a PowerPoint presentation, incorporated herein by reference, regarding vaping regulations and associated issues. The City Council took no action on this informational item. PUBLIC COMMENT Amos Ford thanked the Council for all the new improvements and events in Redding. Mr. Ford also thanked the Council for all their support to Police and Fire. Cathy Tipton opined that there is no low-income housing available for people with a fixed income. Trudi Dupree stated she will become homeless on January 1, 2020, because investors bought the apartment complex and gave her a 60 -day notice. They plan to remodel the apartment complex and increase the rent beyond her ability to pay. Ms. Dupree opined that many people in the same situation. Joey Nickerson thanked the City Council for: (1) new development of the HomeGoods store and the Sprouts Farmers Market at the Mt. Shasta Mall, as well as the Market Street Redevelopment Project; (2) 19 new firefighter positions; and (3) safety patrols on the Sacramento River Trail. Alex Bielecki opined that the Redding Police Department needs to be held accountable. CONSENT CALENDAR The following matters were considered inclusively under the Consent Calendar and each Report to the City Council (staff report) is incorporated herein by reference: 4(a). Approve Minutes - Special Meeting of October 15, 2019 - Closed Session; and Regular Meeting of October 15, 2019. 4(b). Accept Accounts Payable Registers No. 6 and No. 7 and Payroll Registers No. 5 and No. 6: (1) Accounts Payable Register No. 6 for period of September 14, 2019, through September 30, 2019, for a total of $11,769,402.47 for check numbers 148323 through 148715, inclusive, ACH Transfer numbers 15530 through 15578, inclusive, Wire Transfer numbers 8755 through 8797, inclusive; (2) Accounts Payable Register No. 7 for period of October 1, 2019, through October 11, 2019, for a total of $3,648,412.54 for check numbers 148716 through 149083, inclusive, ACH Transfer numbers 15579 through 15608, inclusive, Wire Transfer numbers 8798 through 8823, inclusive: (3) Payroll Register No. 5 for the period of August 25, 2019, through September 7, 2019, in the amount of $3,086,649.22, for electronic deposit transaction numbers 494172 through 495100, inclusive, and check numbers 605533 through 605556, inclusive; and (4) Payroll Register No. 6 for the period of September 8, 2019, through September 21, 2019, in the amount of $3,118,607.36, for electronic deposit transaction numbers 495101 through 495998, inclusive, and check numbers 605557 through 605605, inclusive; SUMMARY TOTAL: $21,623,071.59. 4(c). Accept the Treasurer's Report for the month of September 2019. 4(d). Accept Proof of Cash reconciliation and ACR133 report for the month of September 2019. 4(e). Adopt Ordinance No. 2614, an ordinance of the City Council of the City of Redding, amending Redding Municipal Code Title 6 (Business Taxes, Licenses and Regulations) by repealing Chapter 6.40 (The Granting of Franchises for Cable Communications Systems) and replacing said chapter by enacting Chapter 6.40 (Regulation of State Video Franchise Holders), Sections 6.40.010 through 6.40.190, inclusive, in order to provide for regulation and administration of state video franchise holders. 11/5/2019 137 4(f). Adopt Ordinance No. 2615, an ordinance of the City Council of the City of Redding, amending Redding Municipal Code Title 2 (Administration and Personnel), Chapter 2.04 (City Council) by amending Section 2.04.120 (Meetings — Order of Business) relating to removal of the Closed Session line item as part of the Order of Business. 4.4(e). The item was moved to the Regular Calendar, item number 9.4(e), at the request of Mayor Winter. 4.6(a). Authorize the City Manager to: (1) negotiate a Personal Services Agreement with the Shasta County Probation Department to provide enhanced programs and services at the Martin Luther King, Jr. Center utilizing grant funds obtained by Shasta County; (2) implement the program; (3) appropriate funds; and (4) execute the agreement and all related documents. 4.11(a).Approve setting a Public Hearing on Tuesday, November 19, 2019, at 6:00 p.m. in the City Council Chambers, 777 Cypress Avenue, Redding, California, regarding the adoption of vendor permit fees related to sidewalk vending. 4.11(b).Accept Bid Schedule No. 5061 (Job No. 8302), Redding Civic Auditorium Roof Repair 2019 Project, awarded to Foam Experts Company, as satisfactorily complete, with a final project cost of $52,951.83. 4.14(a).Adopt Resolution No. 2019-109, a resolution of the City Council of the City of Redding, transferring land use plans, planning controls and related plans and functions of the former Redding Redevelopment Agency to the City of Redding for the Market Street Redevelopment Project. 4.15(a).Approve the following actions relative to the International Brotherhood of Electrical Workers - Maintenance Employees, Local 1245 (IBEW Maintenance); and International Brotherhood of Electrical Workers — Electric Department, Local 1245 (IBEW Electric): (1) adopt Resolution No. 2019-110, a resolution of the City Council of the City of Redding, revising the IBEW Maintenance Exhibit A: Schedule of Wage Rates, specifically A-1; and (2) adopt Resolution No. 2019-111, a resolution of the City Council of the City of Redding, revising the IBEW Electric Exhibit A: Schedule of Wage Rates, specifically A-1 through A-3, to correct typographical errors. Public Works Director Aukland presented the Report to the City Council (staff report), incorporated herein by reference. The hour of 6:00 p.m. having arrived, Mayor Winter opened the Public Hearing to consider the annexation of the Stonesfair Subdivision into LMD 08-06. The Affidavit of Publication — Notice of Public Hearing is on file in the Office of the City Clerk. Mayor Winter determined that no one present wished to speak to this item and closed the Public Hearing. 11/5/2019 138 A MOTION WAS MADE by Council Member Schreder, seconded by Council Member Resner, to adopt Resolution No. 2019-112, a resolution of the City Council of the City of Redding: (1) ordering the annexation of the Stonesfair Subdivision into LMD 08-06; (2) approving the Engineer's Report, and confirming the map of the assessment district located therein, for LMD 08-06 Annexation of the Stonesfair Subdivision; and (3) approving the annual assessments for Fiscal Year 2019-20 pursuant to the Landscaping and Lighting Act of 1972 commencing with Section 22500 of the Streets and Highways Code. REGULAR CALENDAR: REPORTS & COMMUNICATIONS OF DEPARTMENTS, BOARDS COMMISSIONS, AND COMMITTEES 9.4(a). Ordinance - Adopting the 2019 California Building Standards Code and related amendments to Chapters 16.01 through 16.09 of the Redding Municipal Code. Building Official James Wright, provided an overview of the Report to the City Council (staff report), incorporated herein by reference. Robert Grosch and Katie Swartz expressed their concerns regarding the California Building Code allowing commercial buildings to implement a 15 second delay before emergency doors will open. A MOTION WAS MADE by Council Member Schreder, seconded by Council Member Resner, to: (1) offer Ordinance No. 2616, an ordinance of the City Council of the City of Redding, amending Redding Municipal Code Title 16 (Buildings and Construction), Chapter 16.02 (Building Code) by amending Sections 16.02.010 (California Building Code Adopted); Chapter 16.03 (Residential Code) by amending Section 16.03.010 (California Residential Code Adopted); Chapter 16.04 (Mechanical Code) by amending Section 16.04.010 (California Mechanical Code Adopted); Chapter 16.05 (Plumbing Code) by amending Section 16.05.010 (California Plumbing Code Adopted); Chapter 16.06 (Electrical Code) by amending Section 16.06.010 (California Electrical Code Adopted); Chapter 16.07 (Energy Code) by amending Section 16.07.010 (California Energy Code Adopted); Chapter 16.08 (Green Building Code) by amending Section 16.08.010 (California Green Building Code Adopted); Chapter 16.09 (Housing Code) by amending Section 16.09.010 (International Maintenance Code Adopted), and making findings of facts relating to local climatic, geological, and topographic conditions, all relating to the adoption of the California Building Standards Codes for first reading by title only and waive the full reading; (2) authorize the City Attorney to prepare and the City Clerk to publish a summary ordinance accordance to law; and (3) direct staff to investigate the code allowing commercial building to implement a 15 second delay before emergency doors will open and return to Council at a future meeting regarding a potential amendment to the ordinance. Consider Developer's request for Wastewater Utility Service outside the City Limits. City Manager Tippin relayed that Redding Reserve Two, LLC, Managing Partner Marcus Partin, (Developer), has requested this item be delayed to a future meeting to allow time for additional discussions with the Tierra Oaks Homeowners Association. Mr. Partin addressed the Council confirming the Developer's wish to delay this item to a future meeting. 11/5/2019 139 A letter was received from the Tierra Oaks Homeowners Association, incorporated herein by reference, supporting a delay on this item until additional discussions with the Developer take place. A MOTION WAS MADE by Council Member Dacquisto, seconded by Council Member Resner, to delay to a future meeting, consideration of the Developer's request to provide wastewater utility services to the Villages at Tierra Oaks subdivision located outside the City limits and its sphere of influence. The Vote: Unanimous Ayes. 9.4(c). Annual Report by Shasta Cascade Wonderland Association on Tourism Activity. Laurie Baker, Chief Executive Officer of the Shasta Cascade Wonderland Association, presented the Report to the City Council (staff report), and a PowerPoint presentation, both incorporated herein by reference. A MOTION WAS MADE by Council Member McElvain, seconded by Council Member Resner, to accept the Annual Report by the Shasta Cascade Wonderland Association, and the accompanying oral presentation, relating to the operation of the Redding Convention and Visitors Bureau under a service agreement with the City of Redding (C-5348). The Vote: Unanimous Ayes. 9.4(e). ITEMNO. 4.4(e) Moved to Regular Calendar at Mayor Winter's request. Resolution - Authorizing staff to apply for a Planning Grant from the State of California's Department of Housing and Community Development. Development Services Director Vaupel presented the Report to the City Council (staff report), and a PowerPoint presentation, both incorporated herein by reference. Jeff Morrow spoke in support of applying for the Planning Grant. A MOTION WAS MADE by Council Member Resner, seconded by Council Member Dacquisto, to authorize staff to adopt Resolution No. 2019-113, a resolution of the City Council of the City of Redding, authorizing staff to apply for a Planning Grant from the State of California's Department of Housing and Community Development in the amount of $310,000 to facilitate the construction of primary and accessory dwelling units. The Vote: AYES: Council Members - Dacquisto, McElwain, Resner, Schreder, and Winter NOES: Council Members - None ABSTAIN: Council Members - None ABSENT: Council Members - None Resolution No. 2019-113 is on file in the Office of the City Clerk. 9.6(b). Oral report regarding security at the Shasta Public Library. Community Services Director Niemer highlighted the Report to the City Council (staff report), incorporated herein by reference. Police Captain Brian Barrier presented a PowerPoint presentation, incorporated herein by reference, outlining efforts to increase security at the Library. A MOTION WAS MADE by Council Member McElwain, seconded by Council Member Dacquisto, to accept the informational report regarding security at the Shasta Public Library. The Vote: Unanimous Ayes. COUNCIL TRAVEL REPORT Council Member Resner attended the League of California Cities Annual Conference & Expo 2019 on October 16 -18, 2019, held in Long Beach, California. 11/5/2019 140 POTENTIAL TOPICS FOR FUTURE CITY COUNCIL MEETINGS. At Vice Mayor McElvain's suggestion, a consensus of the Council directed staff to prepare updated statistics on safety at the Shasta Public Library in 12 months. At Council Member Schreder's suggestion, a consensus of the Council directed staff to work with Shasta County regarding vaping regulations and associated issues, and return to the Council with additional information, if necessary.
