HomeMy WebLinkAboutMinutes - City Council - 2019-10-15129 Redding City Council, Regular Meeting Civic Center Council Chambers 777 Cypress Avenue Redding, CA 96001 October 15, 2019, 6:00 PM The meeting was called to order by Mayor Julie Winter with the following Council Members present: Michael Dacquisto, Adam McElwain, Erin Resner, and Kristen Schreder. Also present were: City Manager Barry Tippin, Assistant City Manager Sheri DeMaagd, City Attorney Barry E. DeWalt, Assistant City Clerk Sharlene Tipton, and Executive Assistant Anette Cates. The City Manager introduced Department Directors that were in attendance: Public Works Director Chuck Aukland, Electric Utility Director Dan Beans, Fire Chief Cullen Kreider, Community Services Director Kim Niemer, Police Chief Bill Schueller, Information Technology Director Tony Van Boekel, Finance Director/City Treasurer Allyn Van Hooser, and Development Services Director Larry Vaupel. The Pledge of Allegiance to the Flag was led by Mayor Winter. The Invocation was provided by Pastor Mike Cruz, The Stirring Church. PRESENTATIONS 2A. Mayor's Proclamation presented to Christine Hixenbaugh on behalf of One Safe Place declaring October 2019 as Domestic Violence Awareness Month in the City of Redding. The City Council took no action on this informational item. 2B. Presentation of City of Redding Employee Service Recognition Awards to the following employees in attendance: Police Chief Bill Schueller (25 years); Purchasing Officer Elizabeth Peer (20 years); City Manager Barry Tippin (15 years); and Public Works Director Chuck Aukland (15 years). The City Council took no action on this informational item. PUBLIC COMMENT Alex Bielecki opined the following: (1) Pacific Gas and Electric (PG&E) should reimburse customers for service not provided; and (2) the Redding Police Department is corrupt. Christina Prosperi invited the City Council and community members to attend The Women's Fund of the Shasta Regional Community Foundation's 10th Anniversary Celebration to be held on Monday, October 28, 2019, in the City of Redding Community Room located at 777 Cypress Avenue Monique Welin thanked the Redding Police Officer that helped her friend's mentally ill daughter with transportation to the hospital to receive the help she needs. James Crockett asked the City Council to direct the Redding Electric Utility to add a solar subsidy on the electric bill, so non -solar customers know how much is being paid for solar customers. William Susanto thanked the City Council for all of the downtown improvements done for the future of Redding. For the record, Council Member Schreder expressed disappointment with the disparaging remarks made by some speakers regarding public service workers; and noted that Redding Electric Utility continued to provide power to City of Redding rate -payers during the PG&E power safety shut -offs. 10/15/2019 130 10/15/2019 CONSENT CALENDAR The following matters were considered inclusively under the Consent Calendar and each Report to the City Council (staff report) is incorporated herein by reference: 4(a). Approve Minutes – Special Meeting of September 11, 2019; Regular Meeting of September 17, 2019; Special Meeting of September 30, 2019 - Closed Session; and Special Meeting of September 30, 2019 - Open Session. 4.4(a). Authorize the Mayor to execute the First Amendment to Consulting and Professional Services Contract (C-7611) with SHN Consulting for an amount not to exceed $297,305 for completion of the Dignity Health North State Pavilion Project Environmental Impact Report. 4.4(c). Adopt Resolution No. 2019-105, a resolution of the City Council of the City of Redding, rescinding Resolution No. 2017-128 and authorizing Affordable Housing and Sustainable Communities Program funds. 4.6(a). Authorize the City Manager, or designee, to enter into License Agreement (C-8250) with the Redding Tennis Club for the use of the tennis courts at South City Park. 4.11(a).Approve Second Amendment to the Consulting and Professional Services Agreement (C-7674) with West Yost Associates in the amount of $59,000, bringing the total contract amount to $184,000. 4.11(b).Accept Bid Schedule No. 5040 (Job No. 2499), Arroyo Manor Sewer Project, awarded to Site Work Solutions, as satisfactorily complete, with a final cost of $411,466.34. 4.11(c).Accept Bid Schedule No. 4984 (Job No. 2600), Hallmark Sewer Improvement Project, awarded to Eddie Axner Construction, Inc., as satisfactorily complete, with a final cost of $1,072,912.68. 4.11(d).Accept Bid Schedule No. 5047, Carr Fire Damaged Culverts Citywide Project (64263-C), awarded to Iron Mountain General Engineering, Inc., as satisfactorily complete, with a final cost of $151,775. 4.11(e).Authorize the purchase of a Caterpillar 600 kilowatt standby generator for emergency capabilities at the Churn Creek Lift Station. The Sourcewell quote for this generator is $144,329. 4.11(f).Authorize the Mayor to approve the final map for Center Court Village Subdivision, (S-2014-01170), contingent upon formation of a Landscape Maintenance District, thereby instructing the City Clerk to file the map with the Shasta County Recorder. 4.11(g).Authorize the Mayor to execute a Subdivision Agreement with Sierra Pacific Industries, and approve the final map for Salt Creek Heights Subdivision, Unit 3 (S-15-07/PD-11-07), thereby instructing the City Clerk to file the map with the Shasta County Recorder. 4.15(b).Adopt Resolution No. 2019-106, a resolution of the City Council of the City of Redding, affirming California Public Employees’ Retirement System (CalPERS) Employee Pension Contribution through a Government Code Section 20516 Contract Amendment for Classic CalPERS Unrepresented Public Safety Management employees (Police and Fire) totaling three percent - for a total contribution of 12 percent, effective December 29, 2019, and for Classic CalPERS Unrepresented Non- Safety employees and Elected Officials totaling one percent - for a total contribution of 8 percent, effective December 27, 2020. A MOTION WAS MADE by Council Member Resner, seconded by Council Member McElvain, that the forgoing items on the Consent Calendar be accepted, acknowledged, adopted, approved, and/or authorized, as recommended. City Attorney DeWalt presented the Report to the City Council (staff report), incorporated herein by reference. The hour of 6:00 p.m. having arrived, Mayor Winter opened the Public Hearing to consider an ordinance relating to regulation of State Cable Television Franchise Holders. The Affidavit of Publication — Notice of Public Hearing is on file in the Office of the City Clerk. Mayor Winter determined that no one present wished to speak to this item and closed the Public Hearing. A MOTION WAS MADE by Council Member Schreder, seconded by Council Member Resner, to adopt Ordinance No. 2614, an ordinance of the City Council of the City of Redding, amending Redding Municipal Code Title 6 (Business Taxes, Licenses, and Regulations) by repealing Chapter 6.40 (The Granting of Franchises for Cable Communications Systems) and replacing said chapter by enacting Chapter 6.40 (Regulation of State Video Franchise Holders), Sections 6.40.010 through 6.40.190, inclusive for first reading by title only and waive the full reading; and authorize the City Attorney to prepare and the City Clerk to publish a summary ordinance according to law. The Vote: AYES: Council Members - Dacquisto, McElvain, Resner, Schreder, and Winter NOES: Council Members - None ABSTAIN: Council Members - None ABSENT: Council Members - None City Attorney DeWalt read Ordinance No. 2614 by title only. 6.2 Public Hearing - consider a resolution forming Landscape Maintenance District 02-19 (Center Court Village); confirming election results; approving the Annual Assessments; and levying and collection of same for Fiscal Year 2020-21. Public Works Director Aukland highlighted the Report to the City Council (staff report), and provided a PowerPoint presentation, both incorporated herein by reference. The hour of 6:00 p.m. having arrived, Mayor Winter opened the Public Hearing to consider Landscape District (LMD) 02-19 (Center Court Village) for Fiscal Year 2020- 21. The Affidavit of Publication — Notice of Public Hearing is on file in the Office of the City Clerk. Mayor Winter relayed the voting regulations and provided an opportunity for comments and submission of final ballots by affected property owners. Mayor Winter determined that no one present wished to speak to this item and closed the Public Hearing. Following tabulation, Assistant City Clerk Tipton announced the ballot results as follows: of one mailed ballot, one ballot was received by the Clerk's Office, of which zero opposed and one favored formation of the LMD; therefore a majority protest was not received and formation of LMD 02-19 (Center Court Village) may proceed for City Council consideration. 10/15/2019 132 A MOTION WAS MADE by Council Member Resner, seconded by Council Member Schreder, to adopt Resolution No. 2019-108, a resolution of the City Council of the City of Redding relative to Landscape Maintenance District (LMD) 02-19 (Center Court Village), authorizing the following: (1) confirming results of the election of the assessment district; (2) confirming the assessments contained in the Engineer's Report for said District; (3) ordering the formation of territory into LMD 02-19 for Fiscal Year 2020-21; and (4) approving the annual assessments for Fiscal Year 2020-21 pursuant to the Landscaping and Lighting Act of 1972, commencing with Section 22500 of the Streets and Highways Code and levying and collecting of the same for Fiscal Year 2020-21. The Vote: AYES: Council Members - Dacquisto, McElvain, Resner, Schreder, and Winter NOES: Council Members - None ABSTAIN: Council Members - None ABSENT: Council Members - None Resolution No. 2019-108 is on file in the Office of the City Clerk. REGULAR CALENDAR: REPORTS & COMMUNICATIONS OF DEPARTMENTS, BOARDS, COMMISSIONS, AND COMMITTEES 9.1(a). Funding for the Garden of Lights. City Manager Tippin, provided an overview of the Report to the City Council (staff report), and a PowerPoint presentation, both incorporated herein by reference. Jake Mangas, President/Chief Executive Officer of Redding Chamber of Commerce, and its 501(c)(3) the Forward Redding Foundation serving as the fiscal agent for the Redding City Identity Project, explained the process taken to select the idea of the Garden of Lights, and spoke in favor. In response to Mayor Winter and Council Member Dacquisto, Mr. Mangas noted that they have funding commitments in the approximate amount of $300,000 of the $800,000 needed, and would look into commercial financing if necessary. Jenny -Lynn Buntin provided a PowerPoint presentation, incorporated herein by reference, showcasing the various Garden of Lights displays in other cities. A MOTION WAS MADE by Mayor Winter, seconded by Council Member Schreder, to: (1) accept the report; and (2) authorize funding for the Garden of Lights by redirecting funds that would otherwise be allocated to the Convention and Visitor Bureau in the amount of $250,000 on or about July 1, 2020 and July 1, 2021. Ordinance - altering City Council Order of Business related to when Closed Session may be held. City Attorney DeWalt presented the Report to the City Council (staff report), incorporated herein by reference. A MOTION WAS MADE by Council Member McElvain, seconded by Council Member Dacquisto, to adopt Ordinance No. 2615, an ordinance of the City Council of the City of Redding, amending Redding Municipal Code Title 2 (Administration and Personnel), Chapter 2.04 (City Council), by amendment to Section 2.04.120 for first reading by title only and waive the full reading. The Vote: AYES: Council Members - Dacquisto, McElvain, Resner, Schreder, and Winter NOES: Council Members - None ABSTAIN: Council Members - None ABSENT: Council Members - None City Attorney DeWalt read Ordinance No. 2615 by title only. 10/15/2019 133 9.15(a).Uncodified Ordinance - amending the City of Redding contract with the Board of the California Public Employees' Retirement System regarding the International Association of Fire Fighters Local 1934. Assistant City Manager DeMaagd provided an overview of the report to the City Council (staff report), incorporated herein by reference. A MOTION WAS MADE by Council Member Schreder, seconded by Council Member Resner, to adopt Ordinance No. 2613, an uncodified ordinance of the City Council of the City of Redding, authorizing an amendment to the contract between the City Council of the City of Redding and the Board of Administration of the California Public Employees' Retirement System as allowed in Government Code Section 20516 of the Public Employees' Retirement Law (Employees Sharing Additional Cost) for International Association of Fire Fighters Local 1934 covered employees; and waive the full reading. POTENTIAL TOPICS FOR FUTURE CITY COUNCIL MEETINGS At Mayor Winter's suggestion, a consensus of the Council directed staff to prepare a letter from the Mayor to the Governor of California requesting that a state of emergency be declared statewide regarding the homelessness crisis; and return to Council for consideration at future meeting.
