HomeMy WebLinkAboutMinutes - City Council - 2019-09-11114 Redding City Council, Regular Meeting Civic Center Council Chambers 777 Cypress Avenue Redding, CA 96001 September 17, 2019, 6:00 PM The meeting was called to order by Mayor Julie Winter with the following Council Members present: Michael Dacquisto, Adam McElvain, Erin Resner, and Kristen Schreder. Also present were: City Manager Barry Tippin, Assistant City Manager Sheri DeMaagd, City Attorney Barry E. DeWalt, City Clerk Pamela Mize, and Executive Assistant Anette Cates. The City Manager introduced Department Directors that were in attendance: Public Works Director Chuck Aukland, Fire Chief Cullen Kreider, Police Chief Bill Schueller, Community Services Director Kim Niemer, Director of Information Technology Tony Van Boekel, Finance Director/City Treasurer Allyn Van Hooser, and Development Services Director Larry Vaupel. The Pledge of Allegiance to the Flag was led by Mayor Winter. The Invocation was provided by Ken Ficklin, Associate Spiritual Leader, Unity Church in Redding. PRESENTATIONS 2A. Presentation by Joy Feuer, Founding Director of ART from the ashes, regarding its mission to support communities affected by wildfire through the cathartic power of art made possible by contributing artists, volunteers, sponsors, grants, and donations. Joy Feuer and Josh Boyer presented a PowerPoint presentation, incorporated herein by reference. 2B. Presentation by the Redding Roots Revival Committee regarding its upcoming Redding Roots Revival Music Festival to be held October 18 and 19, 2019, in Downtown Redding. PUBLIC COMMENT Alex Bielecki opined that there are lots of problems at the north end of Redding. Rebecca O'Brien thanked the City Council for everything that was done during the Carr Fire and for the revitalization efforts in downtown. The following spoke regarding Solar Energy: James Wilson, Bruce Blake, (Power House Solar), Pete Marsh, (Green Power), Jeremy Hufft, (Top Hat Energy), and Russ Holpuch. Alissa Johnson expressed that she sees no end to her personal situation, because more and more people become homeless. People need to stop criminalize the homeless. Debbi Starr thanked the Redding Police Department for making her neighborhood peaceful again. Joshua Brown opined that people do not take their civil liberty for granted, but they do not realize how much they are corroded. Mary Ann McCrary opined that global climate change is a big issue that needs to be addressed. Brenda Woods pointed out that the City Council is voted into office, not self-employed, and wants to know what the City Council is doing regarding the homeless problem. 9/17/2019 115 CONSENT CALENDAR The following matters were considered inclusively under the Consent Calendar and each Report to the City Council (staff report) is incorporated herein by reference: 4(c). Adopt Ordinance No. 2610, an ordinance of the City Council of the City of Redding, adopting an addendum to the Mitigated Negative Declaration prepared for the City of Redding Zoning Map and Amendments to the City of Redding Map (RZ-2019-00361, RZ-2019-00496, and RZ-2019-00522). City Attorney DeWalt noted that Council Member Dacquisto will recuse himself from voting regarding 4710, 4900, and 4950 Shasta View Drive, GPA -2019-00360 due to owning properties in the area. Adopt Ordinance No. 2611, an ordinance of the City Council of the City of Redding, amending Title 18 (Zoning), Chapter 18.31 (Residential Districts: "RE" Residential Estate, "RS" Residential Single Family, and "RM" Residential Multiple Family) by amending Section 18.31.020 (Land Use Regulations); Chapter 18.33 (Commercial Districts: "NC" Neighborhood Commercial, "SC" Shopping Center; "RC" Regional Commercial, "GC" General Commercial, and "HC" Heavy Commercial) by amending Section 18.33.020 (Land Use Regulations); Chapter 18.34 (Industrial Districts: "GI" General Industry and "HI" Heavy Industry) by amending Section 18.34.020 (Land Use Regulations); Chapter 18.43 (Standards for Specific Land Uses) by amending Sections 18.43.180 (Short Term Rentals), all relating to clean-up and updating of the Zoning Code. 4(e). Adopt Ordinance No. 2612, an uncodified ordinance of the City Council of the City of Redding, repealing Ordinance No. 2589 and rescinding Resolution No. 2018-070 in relation to the proposed project of approximately 1.2 acres located at 2450 Goodwater Avenue in the City of Redding. 4.4(b). Authorize assignment of the City of Redding's 2019 Single -Family Private Activity Bonds to the Golden State Finance Authority (GSFA); and authorize the City Manager, or designee, to send an assignment request letter with attachment to the California Debt Limit Allocation Committee and GSFA. 4.5(a). Following public comment by Jeff Morrow in opposition to revising the Renewable Portfolio Standard Procurement, the item was moved to the Regular Calendar item number 9.5(a) at the request of Mayor Winter. 4.6(a). The item was moved to the Regular Calendar, item number 9.6(a), at the request of Council Member Dacquisto. 4.6(b). The item was moved to the Regular Calendar, item number 9.6(b), at the request of Council Member Dacquisto. 4.11(a).Authorize the following action related to the Downtown to Turtle Bay Non -Motorized Improvement Project: (1) accept State Transportation Improvement Program funds; and (2) adopt Resolution No. 2019-089, a resolution of the City Council of the City of Redding, approving and adopting the 10th Amendment to City of Redding Budget Resolution No. 2019-050 appropriating $1,170,000 for Fiscal Year 2019-20. 9/17/2019 116 4.11(c).Authorize the following actions relative to Bid Schedule No. 5069 (Job No. 2645), Replace Asphalt Concrete Surfacing 2019: (1) award to Tullis, Inc. in the amount of $512,200; (2) approve an additional $65,000 to cover the cost of contract administration and inspection fees; (3) approve $70,000 to provide construction contingency funding; (4) approve $25,000 for project development costs; and (5) authorize the City Manager to approve additional increases, in either the construction management or construction contingency amounts, up to a total of $15,000. 4.15(a).Approve Resolution No. 2019-090, a resolution of the City Council of the City of Redding, adjusting the International Brotherhood of Electrical Workers - Maintenance Employees Unit Schedule of Wage Rates for the newly created classification titled Parts Attendant, effective September 18, 2019. A MOTION WAS MADE by Council Member McElvain, seconded by Council Member Resner, that the forgoing items on the Consent Calendar be accepted, acknowledged, adopted, approved, and/or authorized as recommended with the exception of those item(s) voted on separately above. REGULAR CALENDAR: REPORTS & COMMUNICATIONS OF DEPARTMENTS BOARDS, COMMISSIONS, AND COMMITTEES 9.1(a). Resolution - creating a new police lieutenant position in the Redding Police Department. City Manager Tippin provided an overview of the Report to the City Council (staff report), incorporated herein by reference. A MOTION WAS MADE by Council Member Schreder, seconded by Council Member McElwain, to adopt Resolution No. 2019-091, a resolution of the City Council of the City of Redding, approving and adopting the 12th Amendment to City Budget Resolution No. 2019-050 creating a new lieutenant position in the Redding Police Department to serve as Interim Director of the Shascom-911 Agency and appropriate $199,470 in fiscal year 2019-20 and $276,850 in fiscal year 2020-21 to fund the position. Oral presentation regarding the City of Reddina's cybersecurity posture. Information Technology Director Van Boekel summarized the Report to the City Council (staff report), and presented a PowerPoint presentation, both incorporated herein by reference, regarding the City's cybersecurity posture. Informational Item only. 9/17/2019 117 9.5(a) Revised Renewable Portfolio Standard Procurement and Enforcement Plan. (Moved from Consent Calendar Item No. 4.5(a) per Mayor Winter's request.) Assistant Director of Electric Utility Nick Zettel provided an overview of the report to the City Council (staff report) and a PowerPoint presentation, both incorporated herein by reference. A MOTION WAS MADE by Council Member Schreder, seconded by Council Member Resner, to approve the revised Renewable Portfolio Standard Procurement and Enforcement Plan pursuant to Senate Bill 2 in the First Extraordinary Session and later enforced in the Public Utilities Code §339.30. The Vote: Unanimous Ayes. 9.6(a). Encroachment Permit for the construction of a fish channel and funding of pedestrian bridges at the Henderson Open Space Area. (Moved from consent calendar item number 4.6(a) per Council Member Dacquisto 's request.) Community Services Director Niemer presented the report to the City Council (staff report), incorporated herein by reference. A MOTION WAS MADE by Council Member Schreder seconded by Council Member Resner, to authorize the City Engineer to approve an Encroachment Permit for the construction of a fish channel and funding of pedestrian bridges at the Henderson Open Space Area pending legal review. The Vote: Unanimous Ayes. 9.6(b). Fencing in Parkview Riverfront Park. (Moved from consent calendar item number 4.6(a) per Council Member Dacquisto's request.) Community Services Director Niemer highlighted the report to the City Council (staff report), incorporated herein by reference. A MOTION WAS MADE by Council Member Resner seconded by Council Member Schreder, to authorize staff to erect permanent fencing in Parkview Riverfront Park to protect the riparian vegetation restoration project. The Vote: Unanimous Ayes. 9.9(a). Grant - application for the U.S. Department of Justice 2019 Edward Byrne Memorial Justice Assistance Grant. Police Chief Schueller provided an overview of the Report to the City Council (staff report), incorporated herein by reference. A MOTION WAS MADE by Council Member Dacquisto, seconded by Council Member Resner, to affirm submission of an application for the U.S. Department of Justice 2019 Edward Byrne Memorial Justice Assistance Grant in the amount of $46,589. There are no required matching funds. The funds will be used by the Redding Police Department to purchase needed equipment related to active shooter incidents; protective helmets for SWAT; defensive tactics equipment; and software for tracking and managing internal affairs investigations and for reporting and tracking use of force incidents; and authorize the City Manager to sign the grant application Certifications and Assurances that the governing body was notified of the application and an opportunity for citizens to comment on the application was provided. The Vote: Unanimous Ayes. 9/17/2019 118 9.9(b). Resolution - add three additional community service officer positions to the Redding Police Department. Police Chief Schueller summarized the report to the City Council (staff report), and presented a PowerPoint presentation, both incorporated herein by reference. A MOTION WAS MADE by Council Member McElvain, seconded by Council Member Dacquisto, to adopt Resolution No. 2019-092, a resolution of the City Council of the City of Redding, approving and adopting the 11th Amendment to City Budget Resolution No. 2019-050 creating three new full time community service officer positions in the Redding Police Department. The Vote: AYES: Council Members - Dacquisto, McElvain, Resner, Schreder, and Winter NOES: Council Members - None ABSTAIN: Council Members - None ABSENT: Council Members - None Resolution No. 2019-092 is on file in the Office of the City Clerk. 9.14(a). Resolution - amending protest procedures for property -related fees. City Attorney DeWalt presented the Report to the City Council (staff report), incorporated herein by reference. Mary Machado, Executive Director of Shasta Voices, spoke in support of the Resolution. A MOTION WAS MADE by Council Member Resner, seconded by City Council Schreder, to adopt Resolution No. 2019-093, a resolution of the City Council of the City of Redding, amending the procedures for the conduct of protest proceedings for new or increased property -related fees and charges. The resolution, as presented, was revised by adding an additional section related to Council approval of the Notice. The Vote: AYES: Council Members - McElvain, Schreder, and Winter NOES: Council Members - None ABSTAIN: Council Members - None ABSENT: Council Members - None Resolution No. 2019-093 is on file in the Office of the City Clerk. 3. RESUME PUBLIC COMMENT Rome Perez opined that there should be good options to allow the citizens of Redding be able to get solar. POTENTIAL TOPICS FOR FUTURE CITY COUNCIL MEETINGS. At Council Member McElvain's suggestion, a consensus of the Council directed the City Manager to return at the September 30, 2019, Special Council meeting with options relating to how the City will deal with the issue of grandfathering contracts for current Photovoltaic Interconnection Agreements (Solar) and any new Solar applications received prior to the new state regulations effective January 1, 2020; and at Council Member Schreder's suggestion, provide the projected cost to ratepayers of each grandfathering option. At Mayor Winter's suggestion, a consensus of the Council directed the City Manager to return at a future meeting with a report regarding use of the City of Redding's Transient Occupancy Tax for funding of the Garden of Lights at Turtle Bay Exploration Park. At Council Member Dacquisto's suggestion, a consensus of the Council directed the City Attorney to present an Ordinance to move Closed Session from the end of regular City Council meetings to prior to the beginning of the meetings. 9/17/2019 119 CLOSED SESSION At the hour of 8:33 p.m., Mayor Winter announced that the Council would adjourn to Closed Session. At the hour of 9:03 p.m., Mayor Winter reconvened to Open Session and reported that in reference to: 13A.
