Z2/ O AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDDING AMENDING PORTIONS OF REDDING MUNICIPAL CODE CHAPTER 18.72, VARIANCES. The City Council of the City of Redding does ordain as follows: Section 1. Portions of Redding Municipal Code Chapter 18.72, Variances, are amended as follows: I. The first paragraph of Section 18.72.020, Application, is amended to read as follows [subsections A, B and C remain the same]: 18.72.020. Application. Applications for variances shall be made in writing by the property owner to the Planning Commission. The application shall be filed with the Development Services Department on a form prescribed by the Planning Commission, and be accompanied by the prevailing filing and investigation fee as established by the City Council by resolution and a written statement of the reasons justifying the variance, together with plans and evidence showing the following: [Subsections A, B and C remain the same]. II. Subsections A and B of Section 18.72.050, Appeal, is amended to read as follows [Subsections C and D remain the same]: 18.72.050. Appeal. A. In case the applicant or others affected are not satisfied with the action of the Planning Commission, they may appeal in writing to the City Council within ten (10) days following the Commission's decision. The appeal shall be filed with the City Clerk per the requirements of Chapter 18.74. B. The City Clerk shall set a date for a public hearing within forty-five (45) days of the appeal and give notice thereof in the manner and form set forth in Section 18.72.030. [Subsections C and D remain the same]. • • • I Section 2. The passage of this ordinance is not a "project" according to the definition in the California Environmental Quality Act, and therefore is not subject to the provisions requiring environmental review. Section 3. This ordinance shall take effect 30 days after the date of its adoption; and the City Clerk shall certify to the adoption of this ordinance and cause its publication according to law.
