ORDINANCE NO. 2 1 1
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDDING
AMENDING REDDING MUNICIPAL CODE SECTIONS 13.12.020
(FILLING DRIVEWAYS AND CURB-CUT AREAS) AND 16.06.020
(REQUIREMENTS WHERE GRADES NOT AVAILABLE).
Section 1. Section 13.12.020 (Filling Driveway and Curb-cut Areas) of the Redding Municipal Code is
amended to read as follows:
"Whenever the change of use of a property removes the need for driveways and curb cuts, it is the duty of
the property owner to fill the driveway and curb-cut areas to conform to adjacent sidewalk and curb
improvements."
Section 2. Section 16.06.020 (Requirements Where Grades Not Available) of the Redding Municipal Code
is amended as follows:
"If grades are not established for one or more of the streets surrounding the proposed construction requiring
a building permit, and it is the opinion of the Department of Public Works that it is impractical at the time
of the permit application to establish such grades, the permit applicant shall sign and acknowledge an
agreement for completion of improvements titled "PUBLIC WORKS DEFERRED IMPROVEMENT
AGREEMENT," prepared by the Director of Public Works/City Engineeer and approved by the City
Attorney. This will obligate the applicant, its heirs, successors or assigns, to construct the required curb,
gutter and sidewalk improvements within ninety days of demand for same by the Department of Public
Works after such grades have been established."

Section 3. The passage of this ordinance is a ministerial project as defined under section 15268 of the
California Environmental Quality Act (CEQA) Guidelines and is exempt from the requirements of CEQA.
Section 4. This ordinance shall take effect 30 days after the date of its adoption, and the City Clerk shall
certify to the adoption thereof and cause its publication according to law.
