HomeMy WebLinkAboutOrdinance 2240 - Amend Title 4.20 • • ORDINANCE NO. 2 ?AO AN ORDINANCE OF THE CITY OF REDDING AMENDING CHAPTER 4.20 OF THE MUNICIPAL CODE TO AUTHORIZE DESIGNATED CITY OFFICIALS TO ENTER INTO CONTRACTS TO PURCHASE SUPPLIES AND EQUIPMENT NOT EXCEEDING $100,000 AND SERVICES NOT EXCEEDING $75,000 AND TO ESTABLISH ALTERNATIVES TO FORMAL BIDDING THE CITY COUNCIL OF THE CITY OF REDDING DOES ORDAIN AS FOLLOWS: Section 1. Section 4.20.080(A) (Bidding-Dispensed with when) of the Redding Municipal Code is amended to read as follows: "A. Purchase of supplies, services, equipment and the sale of personal property shall be by bid procedures pursuant to Sections 4.20.120 and 4.20.130, except that bidding may be dispensed with only in the following instances: 1. When an emergency requires that an order be placed with the nearest available source of supply; 2. When the commodity can be obtained from only one vendor; 3. When personal services are required of such nature as not to be customarily subject'to bid procedure; 4. When a sole source procurement is based on standards previously adopted by the city council; 5. When prices have been established by other governmental entities or associations of governmental entities in such a manner as to ensure the best value available to the city; or 6 When, at the request of the city manager, approved by the city council, goods or services are proposed to be purchased which do not constitute public works projects." Section 2. Section 4.20.090(B) (Bidding-Opening procedure) of the Redding Municipal Code is amended to read as follows: "B. A formal report of the full contents of supplies and equipment bids exceeding$100,000 shall be made in tabulated form and a formal report of the full contents of service bids exceeding$75,000 shall be made to the city council as soon as practicable after the opening of bids. The bid opening procedure set forth herein is designed to expedite the conduct of official business at regular council meetings, and is an alternative procedure only, and nothing contained in this section shall be deemed to deprive the city council of its right to require that bids for certain projects r� or contracts be opened only in the presence of the city council." �1 • • Section 3. Sections 4.20.120(E) and 4.20.120(H) (Formal contract procedures) of the Redding Municipal Code are amended, and Section 4.20.120(1) is hereby added, to read as follows: "E. Contract Award 1. Contracts for the purchase of supplies and equipment between $25,000 and $100,000 shall be awarded to the lowest responsible bidder by the purchasing officer with additional authorization from the head of the department for whom the purchase is being made and either the assistant city manager,deputy city manager, or director of support services except as otherwise provided in this chapter; 2. Contracts for services between$25,000 and $75,000 shall be awarded to the service provider representing the best value for the city by the purchasing officer with additional authorization from the head of the department for whom the service is being made and either the assistant city manager, deputy city manager, or director of support services except as otherwise provided in this chapter; and 3. Contracts for the purchase of supplies and equipment exceeding $100,000 and contracts for services exceeding $75,000 shall be awarded by the city council except as otherwise provided in this chapter." "H. The purchasing officer, with additional authorization from the head of the department for whom the bid is being made and either the assistant city manager, deputy city manager, or director of support services, may reject supplies, equipment and service bids if the bids received are in excess of the budgeted funds available for the purchase and rebid or commence open-market negotiations to award a purchase order or contract to the vendor that can provide the supplies, equipment or service to the city's satisfaction within budgeted amounts." "I. The city council or appropriate city officials as authorized by subparagraph E of this section may authorize the execution of a contract for supplies, services or equipment without any previous publication or posting of notice inviting bids or proposals when the city council or appropriate officials find and declare that any one or more of the following situations exist: 1. When a bid or bids have been received for the subject supplies, services or equipment obtained in accordance with all the provisions of this chapter, including publication or posting of notice, and the city has rejected any and all bids, and wherein the city finds further that the public interest will not permit the delay of readvertising for bids, and has authorized negotiation with one or more bidders or other parties who possess the capability of supplying the required supplies, services or equipment, and the city finds that the proposed contract so negotiated is more favorable to the city than any which could be made in accordance with the bids 2 • 411/ or proposals heretofore requested; 2. When there is only one available source which can supply the subject matter of the contract; 3. When the contract is for personal services including peculiar or specialized skill or ability; 4. When an emergency exists which makes it essential to the health, safety or welfare of the people that emergency action be taken; 5. When a sole source procurement is based on standards previously adopted by the city council; 6. When prices have been established by other governmental entities or associations of governmental entities in such a manner as to ensure the best value available to the city; or 7. When, at the request of the city manager, and upon approval thereof by the city council, goods or services are proposed to be procured which do not constitute public works projects." Section 4. Section 4.20.150 (Surplus supplies and equipment) of the Redding Municipal Code is amended to read as follows: "All using agencies shall submit to the purchasing officer, at such times and in such form as he shall prescribe, reports showing all supplies and equipment which are no longer used or which have become obsolete or worn out. The purchasing officer shall have authority to sell all supplies and equipment which cannot be used by any agency or which have become unsuitable for city use, or to exchange them for, or trade them in on, new supplies and equipment. The sales shall be made pursuant to Section 4.20.120 or 4.20.130, whichever is applicable, except that surplus supplies and equipment may be sold for fair value without competitive bidding to other public agencies or to non-profit agencies providing valuable community services in Redding." Section 5. The passage of this ordinance is a ministerial project as defined under Section 15268 of the California Environmental Quality Act (CEQA) Guidelines and is exempt from the requirements of CEQA. Section 6.
