A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
SUMMARILY VACATING THE CITY'S INTEREST IN THE 10 -FOOT WATER
EASEMENT ACROSS PARCELS 4, 5 AND 6 AS SHOWN ON PARCEL MAP
NO. LS -42-91, FOR W-4 PARTNERSHIP, FILED JANUARY 17, 1992 IN BOOK
29 OF PARCEL MAPS, PAGE 11, SHASTA COUNTY RECORDS
WHEREAS:
A. The 10 -foot Water Easement being considered for summary vacation was acquired by the
recordation of the Parcel Map for Salyer Land Company, filed on November 12, 1985 in Book 25
of Parcel Maps, Page 71, Shasta County records.
B. The 10 -foot Water Easement has been determined to be superseded in location by the filing of
Parcel Map LS -42-91 on January 17, 1992 in Book 29 of Parcel Maps, Page 71, Shasta County
Records. Therefore, it is appropriate to vacate the Water Easement described in Exhibit "A" and
shown on Exhibit "B" attached and made a part hereof by reference.
C. The summary vacation falls within the criteria of CEQA Section 15305 and is categorically
exempt.
NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES, AND ORDERS AS
FOLLOWS:
The City Council elects to proceed in this matter under the provisions of the California Streets
and Highways Code, Section 8333.
2. The City Council approves the request to summarily vacate the 10 -foot Water Easement as
described in Exhibit "A" and shown hatched on Exhibit `B."
The easement being vacated is superseded in location; therefore, from and after the date this
Resolution is recorded, the Water Easement, described in Exhibit "A" and shown on Exhibit "B,"
shall be vacated in its entirety and longer constitutes an easement for public purposes.
4. This proposed vacation would not result in any significant environmental impacts and falls within
the criteria of a CEQA Section 15305 and is categorically exempt.
The City Clerk is directed to cause a certified copy of this Resolution of Vacation, attested by the
Clerk under seal, to be recorded in the Office of the Shasta County Assessor/Recorder.
I HEREBY CERTIFY, that the foregoing resolution was introduced and adopted at a regular meeting of
the City Council of the City of Redding on the 20th day of August, 2019, by the following vote:

All that real property designated as "10 foot Water Easement" across Parcels 4, 5 and 6 as shown
on Parcel Map No. LS -42-91 for W-4 Partnership filed January 17, 1992 in Book 29 of Parcel
Maps, Page 11, Shasta County records located in a portion of the Southwest one-quarter of Section
18, and the Northwest one-quarter of Section 19, Township 32 North, Range 4 West, M.D.M. in
the City of Redding, County of Shasta, State of California, being more particularly described as
follows:
That certain 10 foot wide strip of land designated as "10 foot Water Easement" across said Parcels
4, 5 and 6 lying Easterly and Southerly of the following described line:
Commencing at the most Westerly corner common to Parcels 3 and 4 as shown on said Parcel
Map thence on and along the Westerly line of said Parcel 4 South 11° 57' 01" West 65.33 feet to
the True Point of Beginning;
Thence from said point of beginning and leaving said westerly line South 0° 04'16" East 146.41
feet;
Thence South 54° 35' 55" West 45.01 feet to a point on the westerly line of said Parcel 6 as shown
on said Parcel Map and the termination of described easement.
The Easterly line of the described 10 foot Water Easement, to be lengthened or shortened to
coincide with the westerly lines of said Parcels 4 and 6.
