HomeMy WebLinkAboutMinutes - City Council - 2019-06-1870 Redding City Council, Regular Meeting Civic Center Council Chambers 777 Cypress Avenue Redding, CA 96001 June 18, 2019, 6:00 PM The meeting was called to order by Mayor Julie Winter with the following Council Members present: Adam McElvain, Erin Resner, and Kristen Schreder. Council Member Michael Dacquisto was absent. Also present were: City Manager Barry Tippin, Assistant City Manager Sheri DeMaagd, Electric Utility Director Daniel Beans, City Attorney Barry E. DeWalt, City Clerk Pamela Mize, and Executive Assistant Anette Cates. The City Manager introduced Department Directors that were in attendance: Public Works Director Chuck Aukland, Fire Chief Cullen Kreider, Police Chief Roger Moore, Community Services Director Kimberly Niemer, Director of Information Technology Tony Van Boekel, Finance Director/City Treasurer Allyn Van Hooser, and Development Services Director Larry Vaupel. The Pledge of Allegiance to the Flag was led by Mayor Winter. The Invocation was provided by Dr. Rick Penner, Executive Pastor, Redding Christian Fellowship. PRESENTATIONS 2A. Presentations to Leslie Williem in recognition of her service on the Planning Commission from April 19, 2016, to April 30, 2019. The City Council took no action on this informational item. 2B. Presentation by the City of Redding and the Redding Trail Alliance providing an update regarding the 2019 Mayor's Mountain Bike Challenge, and the associated economic benefits of trails and biking to the Redding community. Assistant Redevelopment/Community Project Coordinator Travis Menne provided a PowerPoint presentation, incorporated herein by reference. The City Council took no action on this informational item. PUBLIC COMMENT Rick Penner and Jeff Lange invited the City Council and the public to attend the Global Leadership Summit at Redding Christian Fellowship on August 8-9, 2019. Ric Weber, Randy Carter, and Norman Brower expressed their concern about the Winriver Casino Expansion. Anne Connors thanked the City Council for encampment clean-ups that help make Redding a beautiful place to live. Ben Ivy (Representative of Caregiver Healthcare Employee Union), Heather MacNamara, Mary Jo Warren, Stephanie Somer, Frances Lloyd, and Michelle Gaffney asked the City Council and the public to support the nurses and caregivers of Shasta Regional Medical Center in their effort to improve staffing levels at the facility. In addition, Mr. Ivy presented a petition regarding the issues. Dale Ball and Amanda Smith urged the City Council to find a solution regarding the fire hazard created by transients at Henderson Open Space. 6/18/2019 71 CONSENT CALENDAR The following matters were considered inclusively under the Consent Calendar and each Report to the City Council (staff report) is incorporated herein by reference: 4(a). Authorize the following related to Landscape Maintenance Districts: (1) Adopt Resolution No. 2019-053, a resolution of the City Council of the City of Redding, relative to Landscape Maintenance Districts A, B, and C: (a) approving the Engineer's Report for Fiscal Year 2019-20 for Landscape Maintenance Districts (LMD) A, B, and C as filed with the City Clerk; (b) setting a Public Hearing for 6:00 p.m., July 16, 2019, in the City Council Chambers, 777 Cypress Avenue, Redding, California, regarding LMD A, B, and C; and (c) declaring the City Council's intention to levy and collect assessments for Fiscal Year 2019-20 pursuant to the Landscaping and Lighting Act of 1972; and 6/18/2019 72 (2) Adopt Resolution No. 2019-054, a resolution of the City Council of the City of Redding, relative to Landscape Maintenance Districts D, E, F, G, H, H1, J, K, L, M, N, O, P, Q, R, S, S1, T, U, V, W, 01-06, 02-06, 03-06, 04-06, 05-06, 06-06, 07-06, 08-06, 09-06, 11-06, 01-07, 02-07, 02-09, 03-09, 01-11, 02-11, 03-11, 01- 13, 02-14, 03-14, 01-15, 02-16, 03-16, and 01-17: (a) approving the Engineer's Report for Fiscal Year 2019-20 for Landscape Maintenance Districts (LMD) as listed above as filed with the City Clerk; (b) setting a public hearing for 6:00 p.m., July 16, 2019, in the City Council Chambers, 777 Cypress Avenue, Redding, California, regarding LMDs as listed above; and (c) declaring the City Council's intention to levy and collect assessments for Fiscal Year 2019-20 pursuant to the Landscaping and Lighting Act of 1972. 4.9(a). Adopt Resolution No. 2019-055, a resolution of the City Council of the City of Redding, authorizing the acceptance of a grant in the amount of $40,240 from the California Department of Alcoholic Beverage Control for overtime, training, and operating expenses designed to address alcohol enforcement issues in the City of Redding; and authorize the Chief of Police to execute said contract and any associated amendments. 4.10(b).Adopt Resolution No. 2019-056, a resolution of the City Council of the City of Redding, establishing the appropriation limit for Fiscal Year 2019-20 for the City of Redding at $236,152,196. 4.11(a).Accept Bid Schedule No. 4950 (Job No. 2280), Quartz Hill Road Improvement Project, awarded to Eddie Axner Construction Inc., as satisfactorily complete, with a final cost of $4,069,041.54. 4.11(d).Adopt Resolution No. 2019-057, a resolution of the City Council of the City of Redding, relative to Sanitary Sewer Maintenance District 01-07 Hope Lane, authorizing the following: (1) approving the Engineer's Report for Fiscal Year 2019- 20 as filed with the City Clerk; (2) setting a public hearing for 6:00 p.m., July 16, .� 2019, in the City Council Chambers, 777 Cypress Avenue; and (3) declaring the City Council's intention to levy and collect assessments for Fiscal Year 2019-20 pursuant to the Improvement Act of 1911. 4.15(a).Adopt Resolution No. 2019-058, a resolution of the City Council of the City of Redding, approving the California State Association of Counties -Excess Insurance Authority (CSAC-EIA) Workers' Compensation Program as the City of Redding's (City) excess workers' compensation insurance provider for Fiscal Year 2019-20; and authorize the City Manager, or designee, to officially act on behalf of the City and enter into agreements as required with the CSAC-EIA for the Workers' Compensation Program (C-4633) for as long as the City is a member of the Joint Powers Agreement. Community Services Director Niemer presented the Report to the City Council (staff report), incorporated herein by reference. The hour of 6:00 p.m. having arrived, Mayor Winter opened the Public Hearing regarding a Resolution to establish a land value basis for Park in -lieu fees. The Affidavit of Publication — Notice of Public Hearing is on file in the Office of the City Clerk. Mayor Winter determined that no one present wished to speak to this item and closed the Public Hearing. A discussion amongst the City Council ensued. A MOTION WAS MADE by Council Member Schreder, and seconded by Council Member Resner, to adopt Resolution No. 2019-059, a resolution of the City Council of the City of Redding, to establish a land value basis for Park in -lieu fees pursuant to the requirements of Section 17.54.070 of the Subdivision Ordinance, thereby lowering the in -lieu fee from $1,936 to $1,928 per unit. The Vote: AYES: Council Members - McElvain, Resner, Schreder, and Winter NOES: Council Members - None ABSTAIN: Council Members - None ABSENT: Council Members - Dacquisto Resolution No. 2019-059 is on file in the Office of the City Clerk. Public Hearing to consider adoption of a Resolution to adjust the City's Schedule of Fees and Service Char es. Finance Officer Ronald Penington highlighted the Report to the City Council (staff report), and provided a PowerPoint presentation, both incorporated herein by reference. The hour of 6:00 p.m. having arrived, Mayor Winter opened the Public Hearing regarding a Resolution to adjust the City of Redding's Schedule of Fees and Service Charges. The Affidavit of Publication — Notice of Public Hearing is on file in the Office of the City Clerk. David Ledger spoke in support of adjusting the City of Redding's Schedule of Fees and Service Charges. Mary Machado, Executive Director of Shasta Voices, opposed the adjustment. Mayor Winter determined that no one else present wished to speak to this item and closed the Public Hearing. A discussion amongst the City Council ensued. A MOTION WAS MADE by Council Member Schreder, and seconded by Council Member Resner, to adopt Resolution No. 2019-060, a resolution of the City Council of the City of Redding, to adjust the City of Redding's Schedule of Fees and Service Charges. The Vote: AYES: Council Members - Resner, Schreder, and Winter NOES: Council Members - McElvain ABSTAIN: Council Members - None ABSENT: Council Members - Dacquisto Resolution No. 2019-060 is on file in the Office of the City Clerk. 6/18/2019 74 6.3 Public Hearing to consider adoption of a Resolution regarding the proposed 2019-20 Annual Action Plan prepared for the U.S. Department of Housing and Urban Development. Housing Manager Nicole Smith provided an overview of the Report to the City Council (staff report), incorporated herein by reference. The hour of 6:00 p.m. having arrived, Mayor Winter opened the Public Hearing regarding a Resolution accepting the 2019-20 Annual Action Plan. The Affidavit of Publication — Notice of Public Hearing is on file in the Office of the City Clerk. Mayor Winter determined that no one present wished to speak to this item and closed the Public Hearing. A discussion amongst the City Council ensued. A MOTION WAS MADE by Council Member McElvain, and seconded by Council Member Schreder, to adopt Resolution No. 2019-061, a resolution of the City Council of the City of Redding, accepting the proposed 2019-20 Annual Action Plan (Action Plan); and authorize the City Manager, or designee, to sign all necessary documents and submit the Action Plan to the U.S. Department of Housing and Urban Development. REGULAR CALENDAR: REPORTS & COMMUNICATIONS OF DEPARTMENTS, BOARDS, COMMISSIONS, AND COMMITTEES 9.4(a). Oral report regarding City of Redding Home Occupation Regulations. Assistant Planner Lily Toy presented the Report to the City Council (staff report), and a PowerPoint presentation, both incorporated herein by reference. A discussion amongst the Council ensued. A MOTION WAS MADE by Mayor Winter to direct staff to revise Redding Municipal Code Section 18.43.110 (Home occupations) to increase the types of business active allowed to include barbers and cosmetologist; to limit the number of clients allowed per day; and implement an annual permit fee to cover cost of enforcement. This motion failed due to a second vote. A SECOND MOTION WAS MADE by Council Member Resner, seconded by Council Member McElvain, to accept the report and directed staff to review the feasibility of revising Redding Municipal Code (RMC) Section 18.43.110 (A)(6) (Home occupations, Standards, Employee on premises) to permit up to one employee, and, when procedures regarding revising the RMC have been completed, return to a future City Council meeting for a vote. The Vote: AYES: Council Members - McElvain, Resner, Schreder, and Winter NOES: Council Members - None ABSTAIN: Council Members - None ABSENT: Council Members - Dacquisto 6/18/2019 75 9.4(b). Consideration — review of Redding Municipal Code regarding TemporarSign Regulations -Banners. Development Services Director Vaupel provided an overview of the Report to the City Council (staff report), and provided a PowerPoint presentation, both incorporated herein by reference. The following spoke in opposition to the current regulations: Tyler Thompson, Randy Bright, Dale Ball, Jake Mangas, Mary Machado, James Luna, and Joli Hayes. A discussion amongst the City Council ensued. A MOTION WAS MADE by Council Member Resner, seconded by Council Member McElwain, to direct staff to review the Redding Municipal Code as it relates to sign regulations, specifically size, location, display period, and aesthetics of banners; and return to the City Council at a future meeting as appropriate. The Vote: AYES: Council Members - McElvain, Resner, Schreder, Winter NOES: Council Members - None ABSTAIN: Council Members - None ABSENT: Council Members - Dacquisto 9.5(a). Consideration - 2019 Redding Electric Utility's (REU) Wildfire Mitigation Plan. Electric Utility Director Beans highlighted the Report to the City Council (staff report), and presented a PowerPoint presentation, both incorporated herein by reference. A discussion amongst the City Council ensued. A MOTION WAS MADE by Council Member Schreder , seconded by Council Member Resner, to approve the first annual REU Wildfire Mitigation Plan (Plan) in response to Senate Bill 901; and authorize the Electric Utility Director to contract with a third -party vendor to audit this Plan and to provide a report to the City Council before January 1, 2020. A MOTION WAS MADE by Council Member McElwain, and seconded by Council Member Resner, to offer Ordinance No. 2607, an ordinance of the City Council of the City of Redding, amending RMC Title 11 (Vehicles and Traffic), Chapter 11.12 (Speed Limits) by amending Section 11.12.010 (Established on Certain Streets) for first reading by title only and waive the full reading; and authorize the City Attorney to prepare and the City Clerk to publish the summary ordinance according to law.
