HomeMy WebLinkAboutMinutes - City Council - 2019-05-07 48 Redding City Council, Regular Meeting Civic Center Council Chambers 777 Cypress Avenue Redding, CA 96001 May 7, 2019, 6:00 PM The meeting was called to order by Mayor Julie Winter with the following Council Members present: Michael Dacquisto, Adam McElvain, Erin Resner, and Kristen Schreder. Also present were: City Manager Barry Tippin,City Attorney Barry E. DeWalt,Electric Utility Director Dan Beans, City Clerk Pamela Mize, and Executive Assistant Anette Cates. The City Manager introduced Department Directors that were in attendance: Public Works Director Chuck Aukland, Fire Chief Cullen Kreider, Police Chief Roger Moore, Community Services Director Kimberly Niemer, Information Technology Director Tony Van Boekel, and Finance Director/City Treasurer Allyn Van Hooser. The Pledge of Allegiance to the Flag was led by Mayor Winter. The Invocation was provided by Debbie Ivey,Redding Police and Fire Departments' Chaplain. PRESENTATIONS 2A. Mayor's Proclamation presented to Community Action Agency Manager Toni Cardilino, declaring May 2019 as Community Action Agency Month in the City of Redding. Ms. Cardilino presented a PowerPoint presentation to the City Council, incorporated herein by reference. The City Council took no action on this informational item. 2B. Mayor's Proclamation declaring May 2019, as Shasta Bike Month in the City of Redding. Peter Alexander and Cameron Lievense provided a PowerPoint presentation to the City Council, incorporated herein by reference. The City Council took no action on this informational item. 2C. Presentation by Debra Lucero, Executive Director of the Shasta County Arts Council, regarding its receipt of four Western Access Video Excellence awards selected from over 100 finalists statewide; and provided an overview of the Shasta County Arts Council and Redding Cultural Districts' past and present activities. Ms. Lucero presented a PowerPoint presentation to the City Council, incorporated herein by reference. The City Council took no action on this informational item. PUBLIC COMMENT Bob Holsinger commented that the City of Redding needs to find a new approach for repeat misdemeanor offenders,and expressed concern that the City is not involved in the development of the Life Center being planned by Shasta County. Alex Bielecki opined that kids should be taught the meaning of being a citizen. Shannon Hicks spoke against a one percent public safety tax. Marcia Greene congratulated Police Chief Moore regarding his upcoming retirement. Bob Reitenbach opined that he mistrusts the City Council and the Life Center project will fail. 5/7/2019 49 Nick Gardner opined that he does not trust the City Council. Kristie Ewen, resident of Blazingwood Drive, is concerned that Canyon Creek Road is still a fire hazard. CONSENT CALENDAR The following matters were considered inclusively under the Consent Calendar and each Report to the City Council (staff report) is incorporated herein by reference: 4(a). Approve Minutes - Regular Meeting of January 15, 2019; Special Meeting of January 111 31,2019;Regular Meeting of February 5,2019; Regular Meeting of February 19,2019; Special Meeting of February 20, 2019; Special Meeting of February 28, 2019; Regular Meeting of March 5, 2019; Special Meeting of March 7, 2019; Regular Meeting of April 2, 2019; and Regular Meeting of April 16, 2019. 4(b). Accept Accounts Payable Register and Payroll Register. (1) Accounts Payable Register No. 19 for the period of March 30, 2019, through April 12,2019,for a total of$6,188,146.97 for check numbers 143682 through 144027, inclusive, ACH Transfer numbers 15141 through 15165, inclusive, and Wire Transfer numbers 8291 through 8309, inclusive; and (2) Payroll Register No. 20 for the period of March 24, 2019, through April 6, 2019, in the amount of $3,229,935.00, for electronic deposit transaction numbers 483632 through 484505, inclusive, and check numbers 605098 through 605118, inclusive; SUMMARY TOTAL: $9,418,081.97. 4(c). Accept the Treasurer's Report for the month of March 2019. 4(d). Accept the Proof of Cash reconciliation and ACR133 Report for the month of March 2019. 4.5(a). Adopt Resolution No. 2019-029, a resolution of the City Council of the City of Redding, approving and adopting the 75th Amendment to City Budget Resolution No. 2017-057 appropriating funds in the amount of$2,920,000,relative to expenditures for the 2019 snow storm for Fiscal Year 2018-19. 4.5(b). Accept Bid Schedule No. 4853 for On-Call Erosion Control Services at various locations in the City of Redding awarded to McEntire Landscaping, Inc., as satisfactorily complete, with a final cost of$5,100. 4.6(a). Approve the Restated and Amended License Agreement (C-3826) with the Shasta Growers Association to reflect: (1)the updated site map; (2)adjustments to use permit; and (3) to authorize the City Manager, or designee, to execute this agreement and any future amendments. 4.6(c). Approve the Funding(C-2561)and Lease (C-2072)Agreements for the Shasta County Arts Council for the period July 1, 2019, through June 30, 2023; and authorize the Mayor to execute both Agreements. 4.7(a). Approve extension of the banking services contract with U.S. Bank (C-4622), and secured transportation services contracts with Garda Logistics (C-6176) for one year; and authorize the City Manager, or designee, to approve the remaining two one-year extensions if deemed appropriate. 4.10(a).Adopt Resolution No. 2019-030, a resolution of the City Council of the City of Redding, amending the Employment and Benefit Policies for Unrepresented Employees to adopt the Federal Government Services Administration travel reimbursement rates effective July 1, 2019. 4.11(a).Authorize the following actions relative to Bid Schedule No. 5024 (Job No. 2626) Churn Creek Road I-5 North Bound Ramp Project: (1) award to Steve Manning Construction, in the amount of $3,156,540; (2) approve $315,000 to provide construction contingency funding;(3)approve$42,000 for staff contract administration services; and (4) adopt Resolution No. 2019-031, a resolution of the City Council of the City of Redding, approving and adopting the 74th Amendment to City Budget Resolution No. 2017-057 appropriating $882,110 for the Churn Creek Road I-5 North Bound Ramp Project for Fiscal Year 2018-19. 5/7/2019 50 4.11(b).Authorize the following actions relative to Bid Schedule No. 5040 (Job No. 2499) Arroyo Manor Sewer Project: (1) award to Site Work Solutions in the amount of $264,645.64; (2) approve an additional $45,000 to cover the cost of administration and inspection fees; and $105,000 for project development costs; (3) approve $28,000 to provide construction contingency funding; and (4) authorize the City Manager to approve additional increases in either the construction management or construction contingency amounts up to a total of$15,000. 4.11(c).Approve sole source acquisition of all City of Redding water system meters to Badger Meter and Itron Encoder Receiver Transmitters. 4.11(d).Authorize the following actions related to the Eastside Road Bridge Replacement Project: (1) approve the Contract of Acquisition acquiring a 1,611-square-foot slope easement for $3,100 located at 6045 Eastside Road (Assessor's Parcel Number 050- 270-001); and (2) authorize the Mayor to execute all legal documents necessary to complete the proposed easement acquisition. 4.11(e).Adopt Resolution No. 2019-032, a resolution of the City Council of the City of Redding, summarily vacating a portion of Waverly Avenue, East Waverly Avenue and a drainage canal easement and reserving a five-foot-wide Public Service Easement. 4.11(f).Approve the Fifth Amendment to Aircraft Storage Hangar Agreement (C-2216) and Sixth Amendment to Fixed Base Operation Hangar and Aircraft Parking Apron Agreement (C-2643) with Benton Air Center at Benton Airpark; and authorize the Mayor to execute the agreements. 4.15(c).Adopt Resolution No. 2019-033, a resolution of the City Council of the City of Redding, approving a meal and lodging stipend for the classification of Police Recruit Officer in the amount of$1,800 per month be provided while attending a Peace Officers Standards and Training Police Academy. A MOTION WAS MADE by Council Member McElvain, seconded by Council Member Schreder, that the forgoing items on the Consent Calendar be accepted, acknowledged, adopted, approved, and/or authorized as recommended. PUBLIC HEARINGS 6.1. Public Hearing—Resolution and Ordinance related to the project to construct a 9,249- square-foot Les Schwab Tire Store on property located at 4601 Churn Creek Road and to subdivide the property into two lots. Planning/Community Development Manager Lily Toy highlighted the Report to the City Council (staff report), and provided a PowerPoint presentation, both incorporated herein by reference. The hour of 6:00 p.m. having arrived, Mayor Winter opened the Public Hearing to consider the Les Schwab Tire Store Project. The following spoke in support: J.C. Brennan & Associates Project Representatives Scot Patterson, Terra Mortensen, and Jim Brennan. David Ledger, President of Shasta Environmental Alliance, submitted an email dated May 7,2019, incorporated herein by reference. He stated that the Shasta Environmental Alliance opposes the change of zoning because of biological reasons and for the aesthetics of the entrance to Redding. 5/7/2019 51 The Affidavit of Publication—Notice of Public Hearing is on file in the Office of the City Clerk. Mayor Winter determined that no one else present wished to speak and closed the Public Hearing. A discussion amongst the Council ensued. A MOTION WAS MADE by Council Member McElvain, seconded by Council ' Member Dacquisto, to: (1) adopt the Mitigated Declaration for the project; approve General Plan Amendment Application GPA-2019-00024; and adopt Resolution No. 2019-034, a resolution of the City Council of the City of Redding, amending the General Plan designation from "Limited Office" to "Shopping Center"; (2) approve Rezoning Application RZ-2019-00026; and offer Ordinance No. 2603,an ordinance of the City Council of the City of Redding,amending the Zoning Map from"LO"Limited Office District to"SC"Shopping Center District and amending Title 18 of the Redding Municipal Code (Zoning Map of the City of Redding) for first reading by title only, waive the full reading, and authorize the City Attorney to prepare and the City Clerk to publish the Ordinance in summary; and (3) approve Site Development Permit Application SDP-2019-00027 and Parcel Map Application PM-2019-00025 to construct a 9,249-square-foot Les Schwab Tire Store on property located at 4601 Churn Creek Road and to subdivide the property into two lots. Ordinance No. 2603 and Resolution No. 2019-034 are on file in the Office of the City Clerk. 6.2. A Public Hearing Notice was published regarding General Plan Amendment Application GPA-2019-00360 and Rezoning Application RZ-2019-00361, initiated by the City of Redding, to execute the General Plan Annual Cleanup, including properties located at 1042, 1050, 1066, 1078, and 1094 West Street and 4710, 4900 and 4950 Shasta View Drive. At the request of the Development Services Department, this item was withdrawn from the agenda. If the referenced applications are considered in the future, a new Public Hearing Notice will be published and the item will be placed on an agenda at that time. 6.3. A Public Hearing Notice was published regarding General Plan Amendment Application GPA-2019-00495 and Zoning Application RZ-2019-00496, initiated by the City of Redding, requesting a General Plan Amendment and Rezoning for properties addressed as 950 Lake Boulevard and 971 and 991 North Market Street. At the request of the Development Services Department, this item was withdrawn from the agenda. If the referenced applications are considered in the future, a new Public Hearing Notice will be published and the item will be placed on an agenda at that time. 5/7/2019 52 REGULAR CALENDAR: REPORTS & COMMUNICATIONS OF DEPARTMENTS, BOARDS, COMMISSIONS, AND COMMITTEES 9.1(a). Report Regarding Surplus Properties Management Assistant to the City Manager Janelle Galbraith highlighted the Report to the City Council (staff report), and provided a PowerPoint presentation, both incorporated herein by reference. A discussion amongst the Council ensued. A MOTION WAS MADE by Council Member Dacquisto, and seconded by Council Member Resner to accept the report regarding surplus properties. The Vote: Unanimous Ayes. 9.1(b). Lowden Lane Senior Apartments Impact Fee Deferral City Manager Tippin provided an overview to the Report to the City Council (staff report), incorporated herein by reference. The following spoke in support: Laurie Doyle, Vice President of Central California Housing Corporation, Mary Machado, Executive Director of Shasta Voices, and Markus Partin. A discussion amongst the Council ensued. A MOTION WAS MADE by Council Member McElvain, seconded by Council Member Dacquisto, to approve the following actions: (1) approve the Letter of Conditional Commitment (Letter) to the Central California Housing Corporation (CCHC) to assist with the development of the Lowden Lane Senior Apartment complex. The Letter will set forth the terms and conditions to allow for a Development Impact Fee Deferral for the project in an amount not-to-exceed $300,000; (2)authorize staff to draft an agreement between the City of Redding's Housing Division with CCHC for a residual receipts loan and affordability covenants in exchange for the Housing Division assuming the fee deferral on behalf of CCHC; and (3) authorize the City Manager, or designee, to execute all documents necessary to complete the Commitment. The Vote: Unanimous Ayes. 9.5(c). Wildfire Prevention and Improved Response Program. Redding Electric Utility Director Beans summarized the Report to the City Council (staff report), and provided a PowerPoint presentation, both incorporated herein by reference. A discussion amongst the Council ensued. A MOTION WAS MADE by Council Member Schreder, seconded by Council Member McElvain, to approve the Wildfire Prevention and Improved Response Services Program as part of the upcoming Redding Electric Utility Wildfire Mitigation Plan being developed in response to Senate Bill 901; and authorized the City Manager to execute a Memorandum of Understanding between participating departments to memorialize the details. The Vote: Unanimous Ayes. 5/7/2019 53 9.15(a).Resolution of Intention; and Introduction of Uncodified Ordinance - amending the City of Redding (City) Contract with the California Public Employees' Retirement System (Ca1PERS). Assistant City Manager DeMaagd provided an overview of the Report to the City Council (staff report), incorporated herein by reference. A MOTION WAS MADE by Council Member McElvain, seconded by Council Member Schreder, to adopt Resolution No. 2019-035, a resolution of the City Council of the City of Redding, to offer Ordinance No. 2604, an uncodified ordinance of the City Council of the City of Redding, for first reading by title only and waive the full reading, giving notice of the City's intent to amend the contract between the City and CaIPERS as allowed in Section 20516 of the Public Employees' Retirement Law (Employees Sharing Additional Cost) to allow the Redding Independent Employees' Organization—Clerical, Technical and Professional Unit and Supervisory/Confidential Unit and the Redding Peace Officers' Association - Miscellaneous to share additional cost of the retirement benefit. The Vote: AYES: Council Members - Dacquisto, Resner, McElvain, Schreder, and Winter NOES: Council Members -None ABSTAIN: Council Members -None ABSENT: Council Members -None City Attorney DeWalt read the Title of Ordinance No. 2604. Ordinance No. 2604 and Resolution No. 2019-035 are on file in the Office of the City Clerk. 9.15(b).Resolution- Regarding the City Attorney's Salary Increase Assistant City Manager DeMaagd highlighted the Report to the City Council, incorporated herein by reference. Linda Johnson and Bob Reitenbach spoke in opposition to increasing the City Attorney's salary. A discussion amongst the Council ensued. A MOTION WAS MADE by Council Member Schreder, seconded by Council Member Resner, to adopt Resolution No. 2019-036, a resolution of the City Council of the City of Redding, adjusting the annual salary of the City Attorney by two and one- half percent based on the result of a performance review. The proposed change will be effective May 5, 2019. The Vote: AYES: Council Members - Resner, McElvain, Schreder, and Winter NOES: Council Members - Dacquisto ABSTAIN: Council Members -None ABSENT: Council Members -None Resolution No. 2019-036 is on file in the Office of the City Clerk. COUNCIL TRAVEL REPORT(S) Council Member Schreder attended the Northern California Power Agency/Northwest Public Power Agency Federal Policy Conference held in Washington, D.C. from April 28, 2019, through May 2, 2019. POTENTIAL TOPICS FOR FUTURE CITY COUNCIL MEETINGS At Council Member Dacquisto's suggestion, a consensus of the Council directed the City Manager to invite Anderson Police Chief Michael Johnson, Shasta County Sheriff Tom Bosenko, and Shasta County District Attorney Stephanie Bridgett to give a presentation regarding the Life Center at a future Council meeting. 5/7/2019 54 CLOSED SESSION At the hour of 8:49 p.m., Mayor Winter announced that the Council would adjourn to Closed Session. At the hour of 9:13 p.m., Mayor Winter reconvened to Open Session and reported that in reference to: 13A.
