HomeMy WebLinkAboutMinutes - City Council - 2019-03-05 24 Redding City Council, Regular Meeting Civic Center Council Chambers 777 Cypress Avenue Redding, CA 96001 March 5, 2019, 6:00 PM The meeting was called to order by Mayor Julie Winter with the following Council Members present: Michael Dacquisto, Adam McElvain, Erin Resner, and Kristen Schreder. Also present were: City Manager Barry Tippin, City Attorney Barry E. DeWalt,Assistant City Manager Sheri DeMaagd, Development Services Director Larry Vaupel, Community Services Director Kim Niemer, City Clerk Pamela Mize, and Executive Assistant Anette Cates. The City Manager introduced Department Directors that were in attendance: Public Works Director Chuck Aukland,Fire Chief Cullen Kreider,Police Chief Roger Moore,Electric Utility Director Dan Beans, Information Technology Director Tony Van Boekel, and Finance Director/City Treasurer Allyn Feci Van Hooser. The Pledge of Allegiance to the Flag was led by Riley and Ally Lit-Tao. The Invocation was provided by Carol Hoffmeier, Redding Police and Fire Departments' Chaplain. PRESENTATIONS 2A. PowerPoint presentation, incorporated herein by reference, by Travis Menne and Nathan Knedsen regarding the City of Redding Mayor's Mountain Bike Challenge 2019, to be held April 1, 2019, through May 31, 2019. The City Council took no action on this informational item. 2B. PowerPoint presentation, incorporated herein by reference,by Peter Bonkrude,District Manager, regarding the Shasta Mosquito & Vector Control District's 2018 Annual Report. The City Council took no action on this informational item. 2C. PowerPoint presentation, incorporated herein by reference, by Peter Griggs representing the Long Term Recovery Team for the Can and Delta fires, known collectively as the NorCal Community Recovery Team, regarding its activities to date and plans for the future. The City Council took no action on this informational item. PUBLIC COMMENT Danielle Cagan with AAA/CSAA Insurance offered an update regarding the support AAA/CSAA Insurance Group has provided to individuals impacted by the Carr Fire. Alex Bielecki opined that companies that want to open a business in Redding are short of money and need help to get started. Rob McDonald suggested the City use water filled tanks for energy storage or provide as a fire depression systems. Betsy Erickson expressed disappointment in the recent Code Enforcement actions regarding signs at businesses in the City of Redding. 3/5/2019 25 CONSENT CALENDAR The following matters were considered inclusively under the Consent Calendar and each Report to the City Council (staff report) is incorporated herein by reference: 4.(a). Approve Minutes — Special Meeting of November 6, 2018; and Regular Meeting of November 6, 2018. [A-050-060] 4.(c). Accept the Treasurer's Report for the month of January 2019. [A-050-100-600] 4(d). Accept the Proof of Cash Reconciliation and ACR133 Report for the month of January 2019. [F-205-095-650] 4.1(a). Accept report regarding the Carr Fire and make a determination by a four-fifths vote that conditions of local emergency continue to exist within the City of Redding. [P-150-050-100/P-150-050-200/W-030-125] 4.4(a). Adopt Resolution No. 2019-012, a resolution of the City Council of the City of Redding, declaring April as Fair Housing Month in the City of Redding. [A-050-060-600/G-100-030-125] The Mayor commended the Housing Division staff for recently being awarded certificates of recognition from the Federal Department of Housing and Urban Development. 4.11(a).Accept $511,710 in Bridge Preventative Maintenance Program (BPMP) funds and adopt Resolution No. 2019-013,a resolution of the City Council of the City of Redding, approving and adopting the 66th Amendment to City Budget Resolution No. 2017-57 appropriating$511,710 in BPMP funds for the design and construction of maintenance projects at various bridges throughout the City of Redding in Fiscal Year 2018-19. [B-130-070/S-070-050] 4.11(b).Authorize the Mayor to execute a Subdivision Agreement with Star Estates, LLC; approve the Final Map for Riverway Villas Subdivision, (S-2016-00364/PD-2016- 00369); and direct the City Clerk to file the map with the Shasta County Recorder. [S-101-151] A MOTION WAS MADE by Council Member Dacquisto, seconded by Council Member Resner, that the forgoing items on the Consent Calendar be accepted, acknowledged, adopted, approved, and/or authorized as recommended. PUBLIC HEARINGS 6.1. Public Hearing - Ordinance Amending Redding Municipal Code Title 16 (Buildings and Construction); and Resolution- Regarding Parks and Recreation Facility Impact Fees [F-205-600] Community Services Director Niemer summarized the Report to the City Council(staff report),and provided a PowerPoint presentation,both incorporated herein by reference. The hour of 6:00 p.m. having arrived, Mayor Winter opened the Public Hearing to consider the Resolution and Ordinance regarding Parks and Recreation Facility Impact Fees. The Affidavit of Publication—Notice of Public Hearing is on file in the Office of the City Clerk. 3/5/2019 26 A letter was presented by McNeil Law Offices (incorporated herein by reference) in opposition to the proposed Ordinance and Resolution. The following spoke in favor: Allie Figura, Amy Smallwood, Brian Harris, Denise Jorgensen,Linda Masterson,Judy Salter,Tony Lewis,John Deaton,Ann Thomas,John Livingston, David Ledger, and JD Hudson. The following spoke in opposition: Bruce Middleton, Mary Machado, Einhard Diaz, Jake Mangas, and Rob Middleton. Mayor Winter determined that no one else present wished to speak and closed the Public Hearing. A discussion amongst the Council ensued. A MOTION WAS MADE by Council Member Winter,seconded by Council Member Schreder, to approve the following actions relative to City of Redding Development Impact Fees and the Park In-Lieu Fee: (1) offer Ordinance No. 2600, an ordinance of the City Council of the City of Redding amending Redding Municipal Code (RMC) Title 16 (Buildings and Construction), Chapter 16.20 (Development Impact Fees), by amending Section 16.20.210(Park and Recreational Facilities Impact Fees),relating to the impact fees of development of park and recreation facilities; and RMC Title 17 (Subdivisions), Chapter 17.54 (Park and Recreational Land Dedications and In-Lieu Fees) by amending Sections 17.54.040 (Amount of Parkland to be Dedicated), and 17.54.070 (Formula for Fees In-Lieu of Land Dedication) and repealing RMC Section 17.54.080 (Credits), all relating to the Parkland Dedication and In-Lieu Fee Program for first reading by title only, waive the full reading, and authorize the City Attorney to prepare and the City Clerk to publish a summary ordinance; and (2) approve the recommendations of the Community Services Advisory Commission and the Park Fee Consulting Group to adopt Resolution No. 2019-014, a resolution of the City Council of the City of Redding, authorizing an update of the Park and Recreation Facility Impact Fees including non-residential fees. The Vote: AYES: Council Members - Resner, Schreder, and Winter NOES: Council Members - McElvain and Dacquisto ABSTAIN: Council Members -None ABSENT: Council Members -None City Attorney DeWalt read the title of Ordinance No. 2600. Ordinance No. 2600 and Resolution No. 2019-014 are on file in the Office of the City Clerk. 9.6(a). Establish Funding Source for the Soccer Park Turf Replacement Project Moved Item forward on the Calendar at Mayor Winter's Request. [P050-690] Community Services Director Niemer provided an overview of the Report to City Council (staff report), and provided a PowerPoint presentation, both incorporated herein by reference. The following spoke in favor: Bryan Erickson, Briana Jeter, Dr. Duane Bland, Maddie Hofferber;Nicko and Ella Wallis; Brian Salado; Dr. Don Chin; Kendal Nadin; Michaela Earrera-Bietz, Daniel Bietz, Lily Toy, Rich Pinnell, and Mark Guido. Vice Mayor McElvain stated he cannot support the proposal because the cost for the soccer park project is in direct competition with funding for public safety. Council Members Resner and Dacquisto stated interest in the possibility of selling City- owned surplus property and utilizing the funds to reduce any loan amount incurred in funding the Soccer Park Turf Replacement Project. A discussion amongst the Council ensued. 3/5/2019 27 A MOTION WAS MADE by Council Member Resner, seconded by Council Member Schreder, to; (1) approve Funding Source Option 1, as presented in the Staff Report, for the Soccer Park Turf Replacement Project; (Option 1 is a loan from Redding Electric Utility (REU) with payments made as the General Fund can afford, which would mean a lengthy an undetermined period at this time, similar to loans to the Redding Civic Auditorium and Redding Airport funds. The suggested funds would come largely from a recent settlement to litigation that REU was engaged in. These funds were not anticipated nor programmed into the fiscal management plan.); and (2) direct staff to return to the City Council with authorizing documentation including a modification of the agreement with the Shasta Regional Soccer Association(C-4663), and selling City-Owned properties for the purpose of funding future maintenance of the Soccer Park. The Vote: AYES: Council Members—Dacquisto, Resner, Schreder, and Winter NOES: Council Members—McElvain ABSTAIN: Council Members—None ABSENT: Council Members—None 6.2 Public Hearing - Rezoning Application (RZ-2019-00220), Initiated by the City; and Ordinance to Amend Redding Municipal Code Regarding Short-Term Rentals [L-010-230/C-110-100] Development Services Director Vaupel highlighted the Report to the City Council (staff report), and provided a PowerPoint presentation, both incorporated herein by reference. The hour of 6:00 p.m. having arrived, Mayor Winter opened the Public Hearing to consider Ordinance amending Redding Municipal Code Title 18, Zoning. The Affidavit of Publication—Notice of Public Hearing is on file in the Office of the City Clerk. • Mayor Winter determined that no one present wished to speak to this item and closed the Public Hearing. A MOTION WAS MADE by Council Member Schreder, seconded by Council Member McElvain, to offer Ordinance No. 2601, an ordinance of the City Council of the City of Redding amending Redding Municipal Code (RMC) Title 18, (Zoning), Chapter 18.43, (Standards for Specific Land Uses) by amending Section 18.43.180 (Short-Term Rentals), for first reading by title only, waive the first reading, and direct the City Attorney to prepare and the City Clerk to publish a summary ordinance. The Vote: AYES: Council Members - Dacquisto, Resner, Schreder, and Winter NOES: Council Members - McElvain ABSTAIN: Council Members -None ABSENT: Council Members -None City Attorney DeWalt read the title of Ordinance No. 2601. 6.3 Public Hearing—Ordinance to Amend Current Cannabis Ordinance [C-110-100/M-020] City Attorney DeWalt summarized the Report to City Council (staff report), incorporated herein by reference. Mr. DeWalt noted that a minor correction was made to the Ordinance due to a clerical error. The hour of 6:00 p.m. having arrived, Mayor Winter opened the public hearing to consider amending the Cannabis Ordinance. A MOTION WAS MADE by Council Member Dacquisto, seconded by Council Member McElvain, to offer Ordinance No. 2602, an ordinance of the City Council of the City of Redding amending Redding Municipal Code (RMC) Title 6 (Business Taxes, Licenses and Regulations), Chapter 6.12 (Cannabis) by amending Sections 6.12.010 (Definitions), 6.12.020 (Outdoor Cannabis Cultivation Prohibited), 6.12.030 (Indoor Cannabis Cultivation Regulations — Private Residence), 6.12.080 (Cannabis Business License Application Requirements), 6.12.130 (Premises), 6.12.140 (Co- Location of Cannabis Businesses), 6.12.400 (Award of Cannabis Retailer License), 6.12.560 (Microbusinesses Prohibited), 6.12.580 (Manufacture of Cannabis Products), and 6.12.610 (Suspending, Modifying, or Revoking Licenses) and amending RMC Title 18 (Zoning), Chapter 18.33 (Commercial Districts) by amending Schedule 18.33.020-A (Use Regulations — Commercial Districts) in order to permit Microbusinesses, streamline and clarifying Cannabis Business Application Processes, permit cannabis businesses to locate on property zoned as heavy commercial with approval of a Site Development Permit and make other non-substantive clarifications for first reading by title only, waive the first reading, and direct the City Attorney to prepare and the City Clerk to publish a summary ordinance. The Vote: AYES: Council Members - Dacquisto, McElvain, Resner, Schreder& Winter NOES: Council Members-None ABSTAIN: Council Members -None ABSENT: Council Members -None City Attorney DeWalt read the title of Ordinance No. 2602. REGULAR CALENDAR: REPORTS & COMMUNICATIONS OF DEPARTMENTS, BOARDS, COMMISSIONS AND COMMITTEES 9.6(a). Establish Funding Source for the Soccer Park Turf Replacement Project. Moved Item to follow Item 6.1 at Mayor Winter's Request. [P-050-690] POTENTIAL TOPICS FOR FUTURE CITY COUNCIL MEETINGS [A-050-060] At Council Member Dacquisto's suggestions, the City Council directed the following be brought back to the Council at a future meeting: (1)the City Manager to prepare a list and map of all City-Owned properties available for sale for Council discussion; and (2) the Development Services Director to provide an overview of Code Enforcement processes. CLOSED SESSION At the hour of 9:59 p.m., Mayor Winter announced that the Council would adjourn to Closed Session. At the hour of 10:31 p.m., Mayor Winter reconvened to Open Session and reported that in reference to: 13A.
