Code §6103 APN's 112-140-003, 112-150-032, 4NrL5 112-150-033 and 112-160-028 RESOLUTION NO. 2019-007 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING SUMMARILY VACATING A PUBLIC UTILITY EASEMENT RESERVED BY THE CITY OF REDDING AS ORDERED BY THE CITY COUNCIL OF THE CITY OF REDDING ON OCTOBER 7, 1957, RECORDED OCTOBER 9, 1957 IN BOOK 546, PAGE 210 OF OFFICIAL RECORDS OF SHASTA COUNTY WHEREAS: A. This Public Utility Easement was reserved by order of the City Council of the City of Redding on October 7, 1957 and recorded October 9, 1957 in Book 546, Page 210 Official Records of Shasta County; and rIJ B. This public utility easement has been determined to be superseded by relocation and is not required for public use. Therefore, it is appropriate to vacate this Public Utility Easement, B described in Exhibit "A" and shown hatched on Exhibit "B" attached and made a part ! hereof by reference; and C. The summary vacation falls within the criteria of CEQA Section 15305 and is categorically exempt; NOW,THEREFORE,THE CITY COUNCIL DETERMINES,RESOLVES AND ORDERS AS FOLLOWS: 1. The City Council elects to proceed in this matter under the provisions of the California Streets and Highways Code, Section 8333. 2. The City Council approves the request to summarily vacate the Public Utility Easement as reserved by order of the City Council of the City of Redding on October 7, 1957 and recorded October 9, 1957 in Book 546, Page 210 Official Records of Shasta County. 3. The easement being vacated is superseded in location; Therefore, from and after the date this resolution is recorded, the Public Utility Easement, described in Exhibit A and shown on Exhibit B,shall be vacated in its entirety and no longer constitute an easement for public service purposes. 4. This proposed vacation would not result in any significant environmental impacts and falls within the criteria of a CEQA Section 15305 and is categorically exempt. 5. The City Clerk is directed to cause a certified copy of this resolution of vacation, attested by the Clerk under seal, to be recorded in the office of the Shasta County Assessor/Recorder.
