HomeMy WebLinkAboutReso 2019-014 - Parks and Rec Impact Fees RESOLUTION NO.2019-014 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING AUTHORIZING AND ESTABLISHING THE PARKS AND RECREATION FACILITY IMPACT FEES WHEREAS, City staff, as directed by the City Council, is undertaking an update of the Park and Recreation Facility Impact Fees; and WHEREAS, the update was heard by the City Council on March 5, 2019, and the Council approved the first reading of an ordinance amending Redding Municipal Code Title 16 (Buildings and Construction), Chapter 16.20.210 (Park and Recreation Facility Impact Fees), authorizing establishment of these impact fees by Resolution of the City Council; and WHEREAS, the City Council desires to establish a schedule of facility impact fees sufficient to adequately finance public facilities needed to mitigate the impacts caused by future development in the City and to ensure that new development pays its fair share, and only its fair share, of the costs associated with mitigating those impacts; and WHEREAS, the Parks and Recreation Facilities Development Impact Mitigation Fee Nexus Study, dated March 5, 2019, provides the information necessary to adopt required findings in compliance with the State of California's Mitigation Fee Act (Government Code 66000 et seq.) to update the impact fee programs under consideration; and WHEREAS, the City Council has considered the information in the Parks and Recreation Facilities Development Impact Mitigation Fee Nexus Study dated March 5, 2019, the information, documents, and data upon which the Development Impact Fee Nexus Study dated March 5, 2019, was based, and the information provided in the staff report and staff presentation and by those testifying at the public hearing on this matter; and WHEREAS, Redding Municipal Code Section 16.20.050 allows for an automatic inflationary adjustment on July 1 of each year unless specifically modified by resolution of the City Council; NOW THEREFORE, BE IT RESOLVED THAT 1. The City Council of the City of Redding finds that the recitals set forth above are true and correct, and are adopted herein. 2. The Parks and Recreation Facilities Development Impact Mitigation Fee Nexus Study, dated March 5, 2019, is hereby adopted and incorporated by reference into this Resolution. All findings of fact set forth therein are adopted herein. 3. The public interest is best met by establishing the following fee schedule based on the findings and determination of the Park and Recreation Facilities Development Impact Mitigation Fee Nexus Study dated March 5, 2019: a. Park and Recreation Facility Impact Fee shall be set forth as follows: i. Single Family: Fee is per dwelling unit: $5,200 ii. Multiple Family (2 to 4 units)—Fee is per dwelling unit: $3,935 iii. Multiple Family (5 units and above)—Fee is per dwelling unit: $3,935 iv. Commercial - Fee is per one thousand square feet: $494 v. Office—Fee is per one thousand square feet: $731 vi. Industrial—Fee is per one thousand square feet: $395 4. Based on consideration of all the information contained in the Park and Recreation Facilities Development Impact Mitigation Fee Nexus Study dated March 5, 2019, the information contained in the City staff report associated with introduction of this Resolution, and all information presented and received at the public hearing associated with introduction of this Resolution, the Redding City Council makes the following findings: a. The purpose of the fees has been described and identified. b. The use of fee revenues has been described and identified. c. There is a reasonable relationship between the fee's use and the type of development paying the fee. d. There is a reasonable relationship between the need for the fee and type of development paying the fees. e. There is a reasonable relationship between the amount of the fee and cost of the facility attributable to development paying the fee. 5. The impact fees established with this Resolution shall be adjusted for inflation annually in accordance with Section 16.20.050 of the Redding Municipal Code.
