Also present were: City Manager Barry Tippin, City Attorney Barry E. DeWalt,Assistant City Manager Sheri DeMaagd, City Clerk Pamela Mize, and Assistant City Clerk Sharlene Tipton. The City Manager introduced Department Directors that were in attendance: Public Works Director Chuck Aukland, Redding Electric Utility Director Dan Beans, Interim Fire Chief Cullen Kreider, Police Chief Roger Moore, Community Services Director Kimberly Niemer, and Information Technology Director Tony Van Boekel. The Pledge of Allegiance to the Flag was led by Mayor Schreder. The Invocation was provided by Ken Ficklin, Associate Spiritual Leader, Unity Church in Redding. PRESENTATIONS 2A. Mayor's Proclamation presented to Christine Hixenbaugh, One SAFE Place, and the One SAFE Place Campus Kids declaring October 2018 as Domestic Violence Awareness Month in the City of Redding. [A-050-060-600] The City Council took no action on this informational item. 2B. Mayor's Certificates of Recognition presented to the following women in honor of National Women's Small Business Month in the City of Redding: Jenna Zint(Turbans for Tots), Anne Ballard (The Crowning Jewels), and Christine Sullivan (Twin Sparrow). [A-050-060-600] The City Council took no action on this informational item. 2C. Mayor's Proclamation presented to Kathy Hammond declaring October 2018,as Breast Cancer Awareness Month and October 18, 2018, as Think Pink Day in the City of Redding. Presentation of City of Redding Employee Service Recognition Awards to City Clerk Pamela Mize for achieving 20 years and Interim Fire Chief Cullen Kreider for achieving 25 years of public service to the City of Redding. [P-100] PUBLIC COMMENT [A-050-060] Alex Bielecki opined that law enforcement can assist the community by being respectful of citizens' civil rights. [C-110-100-400] Margie Baugh opined that she is frustrated with numerous ongoing code violations with a neighboring property on Verda Street and the lack of assistance by the City's code enforcement division. [P-150-050-200] Murray Blake inquired about the monies raised for Carr Fire victims, and questioned how it can be accessed by those affected. 10/16/2018 451 [S-060] Nick Gardner opined that he continues to have issues regarding a storm drain on his property and requested that the City of Redding match the County of Shasta's payment of$3,000 to keep his property from flooding. [L-010-005] Ashley Mangrum stated that she lives in Downtown Redding and is wheelchair bound due to having Multiple Sclerosis. She requested that there be more affordable housing for people with disabilities. [L-010-500] I Jeff Morrow provided a PowerPoint presentation,incorporated herein by reference,and opined that the City of Redding should address regulation of Accessory Dwelling Units by adopting state law regulations. CONSENT CALENDAR The following matters were considered inclusively under the Consent Calendar and each Report to the City Council (staff report) is incorporated herein by reference: 4(a). Approve Minutes— Special Meeting of September 5, 2018. [A-050-060] 4(b). Approve Payroll and Accounts Payable Register. [A-050-100-500] (1) Accounts Payable Register No. 7 for the period of September 29, 2018, through October 12, 2018, for a total of $5,334,796.70 for check numbers 139081 through 139557, inclusive, ACH Transfer numbers 14679 through 14719, inclusive, and Wire Transfer numbers 8003 through 8028, inclusive; and (2) Payroll Register No. 7 for the period of September 23, 2018, through October 6, 2018, in the amount of $2,892,741.09, for electronic deposit transaction numbers 472261 through 473146, inclusive, and check numbers 604533 through 604553, inclusive; SUMMARY TOTAL: $8,227,537.79. 4.1(a). Accept report regarding the Carr Fire and make a determination by a four-fifths vote that conditions of local emergency continue to exist within the City of Redding. [P-150-050-100/P-150-050-200/A-050-080] 4.1(d). Affirm submission of an application to the Community Planning Assistance for Wildfire Program administered by Wildfire Planning International; and authorize the City Manager, or designee, to execute all subsequent documentation necessary to obtain the grant for consulting services. Approve Post-Disaster Mutual Aid Agreement with Haven Humane Society authorizing the City of Redding to submit eligible emergency expenses on behalf of Haven Humane Society as part of the public assistance grant application; and authorize the City Manager, or designee, to sign this and all other amendments to the agreement. [P-150-050-200/A-130-170] 4.4(a). Approve Funding Agreement (C-1336) with the Superior California Economic Development District (SCEDD) for Fiscal Year 2018-19 for economic development planning and business development services, and authorize payment to SCEDD in the amount of$14,036 for Fiscal Year 2018-19 activities. [A-050-020] Bob Nash, Chief Executive Officer for SCEDD, thanked the Council for their support. 4.5(b). Award Bid Schedule No. 4996, Electric Line Clearance Services for Area 1 to the sole bidder, Utility Tree Service, in the amount of$309,300.27 for the period beginning the date the City of Redding issues the purchase order and ending on September 30, 2019. [B-050-100/E-090-160] 10/16/2018 452 4.5(c). Award Bid Schedule No. 4998 for Treated Wood Poles to McFarland Cascade Holdings, Inc., in the amount of $431,883; and authorize the Purchasing Officer to extend the bid award annually through September 30,2022,if mutually agreeable,with all prices, terms and conditions remaining the same to McFarland Cascade Holdings, Inc. [B-050-100] 4.11(a).Accept Bid Schedule No. 4956 (Job No. 2610), CAPE Seal Project 2018, awarded to VSS International, Inc., as satisfactorily complete, with a final project cost of $1,169,186.50. [B-050-020/S-070-100] 4.11(b).Accept Bid Schedule No. 4827 (Job No. 9941), Redding Municipal Airport West Apron and T-Hangar Taxilane Reconstruction Project, awarded to Tullis Inc., as satisfactorily complete, with a final project cost of$3,279,750.62. [B-050-020/B-130-070/A-090-100] 4.11(c).Accept Bid Schedule No. 4886 (Job No. 9941), Redding Municipal Airport T-Hangar Taxilane Pavement Reconstruction Project, awarded to Tullis, Inc., as satisfactorily complete, with a final project cost of$4,599,039.63. [B-050-020/A-090-100] 4.11(d).Accept Bid Schedule No.4957(Job No.5867),Corporation Yard and Transfer Station Administration Building Public Address System Project, awarded to Gaynor Telesystems, Inc., as satisfactorily complete, with a final project cost of$170,574.42. [B-050-020/C-050-100-040] 4.11(e).Authorize the following action relative to Bid Schedule No. 4999 (Job No. 2990), Buckeye Water Treatment Plant Filter No. 2 and No. 3 Repair Project: (1) award to ERS Industrial, in the amount of$288,650.14 to replace the filter media, underdrains, and air scour system for gravity filters No. 2 and No. 3; (2) approve $65,000 to cover the cost of contract administration and inspection fees; (3) approve $30,000 to provide construction contingency funding;(4)authorize the City Manager to approve additional increases, in either the construction management or construction contingency amounts, up to a total of$5,000; and (5)adopt Resolution No. 2018-107, a resolution of the City Council of the City of Redding approving and adopting the 54th Amendment to City Budget Resolution No. 2017-057 appropriating $388,540 in Water Utility Funds for Fiscal Year 2018-19. [B-050-020/B-130-170/W-030-600] 4.11(f).Authorize the First Amendment to the Enterprise Rent-A-Car of Sacramento Agreement (C-3874); and authorize the City Manager, or designee, to execute this and all future amendments to the Agreement. [A-090-100/C-070-100] 4.11(h).Authorize staff to negotiate an extension of the Lease Agreement (C-5689)with Dave and Liz Ault for grazing activities at the Stillwater Business Park, for three months, to accommodate the Request for Proposals process; authorize the City Manager to execute an Amendment to the lease; and authorize the City Manager to execute an additional term extension, if needed, should the initial three months not be sufficient. [C-070-010/E-050-500] 4.11(i).Affirm submission of grant applications for the following federal Hazard Mitigation Grant Program projects; and further authorize the City Manager, or designee, to sign related application documents: (1) River Trail Erosion Control Project; (2) Carr Fire Redding Reforestation Project; (3) Foothill Water Treatment Plant Backup Generator and Switchgear Project; (4) Pump House No. 1 Backup Generator Project; (5) Cypress Booster Pump Station Project;(6)Centerville Water District Backup Generator Project; (7) Anderson Cottonwood Irrigation District (ACID) Flood Inundation Mapping and Emergency Action Plan Project; and (8) Buckeye Water Treatment Plant Solids Handling Project. [P-150-050-200/G-100-070/P-150-050-500] 10/16/2018 453 4.15(b).Accept the quotation from Liberty and StarrTech for a 50/50 quota-share one-year contract to provide property and boiler-machinery insurance coverage for the Redding Power Plant with a$253,675 premium for policy year 2018-2019. PUBLIC HEARINGS, PETITIONS,AND PROTESTS 6.1. Public Hearing - Appeal of Use Permit Application (UP-2018-00696), by Jeremy Aleck, Requesting Approval of a Use Permit For a Commercial Cannabis Cultivation Facility. [L-010-390/L-010-410/L-010-150-050/M-020] Interim Planning Manager Lily Toy provided an overview of the Report to the City Council (staff report), and a PowerPoint presentation, both incorporated herein by reference. The hour of 6:00 p.m. having arrived, Mayor Schreder opened the public hearing to consider the appeal of Use Permit Application (UP-2018-00696), by Jeremy Aleck, requesting approval of a Use Permit for a commercial cannabis cultivation facility on property located at 3048 South Market Street. The Affidavit of Publication—Notice of Public Hearing is on file in the Office of the City Clerk. The following spoke in favor: Laura McHaney, Jim Baker read a letter on behalf of his brother Chris Baker, Doug McHaney, Garrett Ball, Joe Baker, Jacob Ewald, Ken Miller, and Dr. Bob Hansen. The following spoke in opposition: Linda Cadd, Robert Cronic, Larry Schaller, Victor Hernandez,Bradley Reynolds,Jonathan Anderson(Executive Director,Good News Rescue Mission), Raymond Holden, Adam Schwartz, Cathy Grindstaff, Stewart Munsee, Brenda Woods, Gary Cadd, and Honey Storlie. Mayor Schreder determined that no one else present wished to speak and closed the public hearing. A discussion amongst the Council ensued. A MOTION WAS MADE by Council Member Weaver, seconded by Council Member McElvain, to: (1) approve the Appeal of Use Permit Application (UP-2018- 00696) by Jeremy Aleck for a commercial cannabis cultivation operation located at 3048 South Market Street and allow a cannabis cultivation facility at this location; and (2) adopt the appropriate findings of fact. The Vote: AYES: Council Members - McElvain, Sullivan, and Weaver. NOES: Council Members - Winter and Schreder ABSTAIN: Council Members - None ABSENT: Council Members - None 10/16/2018 454 6.2. Public Hearing — Regarding Adoption of a Twenty Percent Reduction in Building Permit Fees Relating to Carr Fire Permits. [P-150-050-200/B-130-070/F-205-600] City Manager Tippin summarized the Report to the City Council (staff report), incorporated herein by reference. Mr. Tippin noted that all impact fees are already waived, the Council voted on this previously to put in place for those properties destroyed by the Carr Fire. The hour of 6:00 p.m. having arrived, Mayor Schreder opened the public hearing to consider the adoption of a twenty percent reduction in Building Permit Fees relating to Carr Fire Permits. A MOTION WAS MADE by Council Member Winter,seconded by Council Member Sullivan,to adopt Resolution No. 2018-108,a resolution of the City Council of the City of Redding amending the City of Redding Schedule of Fees and Service Charges to provide for a twenty percent reduction in building permit fees for the rebuilding of structures damaged or destroyed by the Carr Fire disaster. The hour of 6:00 p.m. having arrived, Mayor Schreder opened the public hearing to consider the annexation of the Terrace Subdivision into Landscape Maintenance District S. The Affidavit of Publication — Notice of Public Hearing is on file in the Office of the City Clerk. Mayor Schreder determined that no one present wished to speak and closed the public hearing. A MOTION WAS MADE by Council Member Sullivan, seconded by Council Member Weaver, to adopt Resolution No. 2018-109, a resolution of the City Council of the City of Redding: (1) ordering the annexation of the Terrace Subdivision into Landscape Maintenance District S (LMD S) with a supplemental assessment pursuant to the Improvement Act of 1911, Chapter 26, Maintenance Districts, Streets and Highways Code Section 5820, et seq; (2) approving the Engineer's Report, and confirming the map of the assessment district located therein, for LMD S Annexation of Terrace Subdivision; and(3)approving the annual assessments for Fiscal Year 2018- 19 pursuant to the Landscaping and Lighting Act of 1972 commencing with Section 22500 of the Streets and Highways Code. Development of an Engineers Report for a City-Wide Fire Fuels Management District; and Resolution -55th Amendment to City Budget Resolution No. 2017-057. Jack Baker spoke in support with the right parameters in place. A MOTION WAS MADE by Council Member Winter,seconded by Council Member McElvain, to authorize development of Engineer's Report for a City-Wide Fire Fuels Management District; and adopt Resolution No. 2018-110, a resolution of the City Council of the City of Redding approving and adopting the 55th Amendment to City Budget Resolution No. 2017-057 appropriating$75,000 for Fiscal Year 2018-19. Oral Presentation regarding Community Services Department Update [A-050-110/R-006-250] Community Services Director Niemer provided an overview of the Report to the City Council (staff report), and provided a PowerPoint presentation, both incorporated herein by reference. Ms. Niemer highlighted recent successful events such as: 2018 Community Creek Clean Up at the Henderson Open Space; Martin Luther King Jr. Center 50th Anniversary Celebration; Grasshopper 20th Birthday; Post-Carr Fire River Trail Restoration; Re-Oak Redding; and the 2019 Art in the City. The City Council took no action on this informational item. 9.11(g).Final Map and Execute Subdivision Agreement for The Terrace Subdivision, (S-2016-00603). [S-101-151] Public Works Director Aukland summarized the Report to the City Council (staff • report), incorporated herein by reference. A MOTION WAS MADE by Council Member McElvain, seconded by Council Member Winter, to: (1) authorize the Mayor to execute a subdivision agreement with Shasta View Lake, Inc.; (2) approve the final map for The Terrace Subdivision, (S- 2016-00603); and (3) instruct the City Clerk to file the map with the Shasta County Recorder. The Vote: Unanimous Ayes. I 10/16/2018 456 9.15(a).Resolution — Regarding Exception to the California Public Employee's Retirement System (Ca1PERS) 180-Day Wait Period with Regard to the Re-Hiring of Retired Information Technology Supervisor Don Roberts. A MOTION WAS MADE by Council Member Sullivan, seconded by Council Member McElvain, to adopt Resolution No. 2018-111,a resolution of the City Council of the City of Redding approving an exception to the 180-day wait period for public agencies set by Ca1PERS as required by the California Public Employees' Pension Reform Act of 2013 and granting the City Manager authority to execute the necessary hiring documentation, to allow the retired Information Technology Supervisor to be rehired as an annuitant to assist in training Building Maintenance Division staff in the systems and processes pertaining to alarm systems and fire suppression systems City- wide, effective October 17, 2018. POTENTIAL TOPICS FOR FUTURE CITY COUNCIL MEETINGS [L-010-230/C-110-100] At Council member Weaver's suggestion, the City Council directed the City Manager to present a staff report,after the first of the year,to determine the Council's interest in discussing revisions to the ordinance pertaining to mobile medical units within downtown Redding. CLOSED SESSION At the hour of 9:00 p.m.,Mayor Schreder announced that the Council would adjourn to Closed Session. At the hour of 9:34 p.m., Mayor Schreder reconvened the Closed Session to Open Session and reported that in reference to: 13A. City of Redding, et al.; Shasta County Superior Court Case No. 190834 [L-100] The City Council took no reportable action on this item pursuant to Government Code Section 54957.1(a). 13B. Closed Session pursuant to California Government Code Section 54956.9(d)(1): CONFERENCE WITH LEGAL COUNSEL- EXISTING LITIGATION Northern California Power Agency (NCPA), City of Redding, City of Roseville, and City of Santa Clara v. United States Bureau of Reclamation and Department of Interior U.S. Court of Federal Claims Case No. 14-817C [L-100] Pursuant to Government Code Section 54957.1(a)(2), the City Council authorized the City Attorney to appeal the decision of the Trial court in Northern California Power Agency, City of Redding et al v United States Bureau of Reclamation. The substance of the litigation is that plaintiffs allege that defendant has misinterpreted the Central Valley Project Improvement Act and, as a consequence, overcharged plaintiffs and their customers for their fair share of environmental restoration and mitigation charges due as a result of taking power from the Central Valley Project. 10/16/2018 457 13C.
