Also present were City Manager Starman, Assistant City Manager Tippin, City Attorney Duvernay, and Personnel Director Johnson. I At the hour of 6: 15 p.m., Mayor Bosetti announced that the City Council would adjourn to closed session to discuss the following: Closed session pursuant to California Government Code Section 54957.6: CONFERENCE WITH LABOR NEGOTIATOR Designated Agency Representative: Personnel Director Johnson Employee Organization: Local Union 1245 of International Brotherhood of Electrical Workers AFL-CIO - Maintenance Employees (P-I00-050-070) . Closed session pursuant to California Government Code Section 54957.6: CONFERENCE WITH LABOR NEGOTIATOR Designated Agency Representative: Personnel Director Johnson Employee Organization: Local Union 1245 of International Brotherhood of Electrical Workers AFL-CIO - Electric Employees (P-I00-050-070) I Closed session pursuant to California Government Code Section 54957.6: CONFERENCE WITH LABOR NEGOTIATOR Designated Agency Representatives: Kurt Starman & Linda Johnson Employee Organization: All Represented and Non-represented Employees [P-I00-050] Closed session pursuant to California Government Code Section 549576.9(b)(3)(C): CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION Significant exposure to litigation Claim No. 09-027-861 by C&H Investments (re 18-inch water main break) occurred at 2701 Old Eureka Way One (1) case (L-IOO) At the hour of 6:59 p.m., Mayor Bosetti reconvened the Special Meeting to open session and reported that with regard to the anticipated litigation issue, the City Council, by unanimous vote, authorized the City Manager to accept a settlement agreement regarding a claim filed by Mike and Jody Cushman for property damage in the amount of$167,000 that occurred at 2701 Old Eureka Way due to the rupture of a City-owned water main. With regard to the remaining items, he advised that there was no reportable action taken. There being no further business, at the hour of7 :00 p.m., Mayor Bosetti declared the meeting adjourned.
