The meeting was called to order by Mayor Dickerson with the following Council Members
present: Bosetti, Jones, Murray, and Stegall.
Also present were City Manager Starman, City Attorney Duvernay, and Personnel Director
Johnson.

At the hour of 5:45 p.m., Mayor Dickerson announced that the City Council would adjourn to
closed session to discuss the following:

Threatened litigation:
The City Council will discuss with its attorney a threat oflitigation presented by Natural
Resources Defense Council v. Dirk Kempthorne, Case No. 05-CV-01207 OWW GSA in
the United States District Court for the Eastern District of California. The pleading in the
case giving rise to the exposure to litigation is available for public inspection in the
Office of the City Clerk pursuant to Section 54957.5

At the hour of7:00 p.m., Mayor Dickerson reconvened the Special Meeting to open session
and reported that with regard to the Anticipated Litigation with Natural Resources Defense
Council v. Dirk Kempthorne, the matter is continued. With regard to the real property
negotiations on Item No.4, the Mayor is authorized to execute a contract of acquisition and

a certificate of acceptance for a public service easement on each of the following properties
for electric transmission lines for the Stillwater Business Park Transmission Line Project: 1)
APN 109-040-012 owned by Everett, Clara, Benny, and Carolyn Brown, details will be
disclosed upon receipt of executed documents, 2) APN 054-220-004 owned by David and
Cindee Denton for a price of$13, 700 plus a conveyance of approximately 15,580 square feet
of adjacent property owned by the City to the Dentons, 3) APN 054-020-017 owned by
Bradford and Jacqueline Evans for a price of$ 1 6,000, 4) APN 10-040-014 owned by James
and Deborah Huber for a price of$19,000, 5) APN 154-220-005 owned by Joe L. Sanders
for a price of $17,000, APN 054-210-017 owned by Joe L. Sanders for a price of $7,500,
APN 110-160-002 owned by Irvin and Carol Scarbrough, Trustees fo the Irvin C. Scarbrough
and Carol Scarbrough 1995 Revocable Living Trust for a price of$12,000, and APNs 110-
160-010 and 110-160-011 owned by Colburn R. Thomason and Valdene Thomason, details
will be disclosed upon receipt of executed documents. A copy of each contract of acquisition
and certificate of acceptance will be on file with the City Clerk after execution by the Mayor.
Mayor Dickerson stated there was no other reportable action taken.
There being no further business, at the hour of 7:03 p.m., Mayor Dickerson declared the
meeting adjourned.
