HomeMy WebLinkAboutMinutes - City Council - 2009-10-19 - Special Meeting (2) 246 City Council, Special Meeting Council Chambers 777 Cypress Avenue Redding, California October 19,20095:15 p.m. The meeting was called to order by Vice Mayor Jones with the following Council Members present: Dickerson, McArthur, and Stegall. Mayor Bosetti was absent. Also present were City Manager Starman, City Attorney Duvernay, Assistant City Manager Tippin, Community Services Director Niemer, Deputy City Clerk Mize, and Executive I Assistant Stockwell. At the hour of 5:54 p.m., Vice Mayor Jones convened the Special Meeting ofthe Redding City Council for a joint meeting with the Redding Municipal Library Board. PROPOSED NEW CODE OF CONDUCT POLICY FOR THE SHASTA PUBLIC LIBRARIES [L-050-500/L-050-010] Community Services Director Niemer presented a Code of Conduct policy (Code) to formally establish parameters for Shasta Public Libraries (SPL) customers and afford SPL staff wri tten guidelines for consistent1 y and faid y monitoring, advising, and educating library customers, including provisions for suspension or revocation of library privileges and an appeals process. Ms. Niemer stated that Shasta Public Libraries are committed to providing information services to the citizens of Shasta County, who are expected to behave responsibly and respectfully. She stressed that, on average, the conduct ofSPL customers is unremarkable, but the new Code would allow SPL staff sufficient authority to mete out appropriate consequences for conduct infractions when necessary. Ms. Niemer added that SPL staff, Shasta Public Library Citizens Advisory Committee (SPLCAC) and Library Systems & Services, Inc., would annually review any offenses and effectiveness of the Code. Ms. Niemer, with the endorsement of the SPLCAC, recommended that the Redding Municipal Library Board adopt the Shasta Public Libraries Code of Conduct policy as prepared. I In response to Council Member/Board Member Dickerson, City Attorney Duvernay advised that prior to petition for review of a decision issued by the SPLCAC being filed with the Shasta County Superior Court, all administrative remedies would be exhausted, including review of all evidence and objections of the offender by the City Attorney's office to assure consistency in enforcement of the Code. At the request of Council Member/Board Member Stegall, Mr. Duvernay opined that since the SPLCAC has intimate knowledge of SPL operations and policies, they would be the appropriate body to hear and issue rulings on any SPL appeals. MOTION: Made by Council Member/Board Member Dickerson, seconded by Council Member/Board Member McArthur adopting the proposed Shasta Public Libraries Code of Conduct policy. The Vote: Unanimous Ayes ORDINANCE - Amending Redding Municipal Code Section 2.42.120 - Library Regulations I re suspended library customers (L-050/L-050-500) Community Services Director Niemer pointed out that while the SPL Code of Conduct policy ( Code) will provide SPL staff with the proper authority to address any SPL customer misconduct, the ordinance modifying the Library Regulations would provide the legal means for law enforcement personnel to remove or arrest a suspended customer should he/she reappear at the SPL during the suspension period. Ms. Niemer, with the endorsement of the SPLCAC, recommended that the City Council approve the amendment(s) to Redding Municipal Code Section 2.42.120 (Library Regulations), by adding Subsection 2.42.120.All related to prohibited activity on the 10/19/2009 247 grounds of the Redding Municipal Library; offer an ordinance for first reading; and waive the full reading. I MOTION: Made by Council Member Stegall, seconded by Council Member Dickerson approving the amendment( s) to Redding Municipal Code Section Title 2 (Administration and Personnel), Chapter 2.42 (Redding Municipal Library), Section 2.42.120 (Library Regulations), by adding Subsection 2.42.120.All relating to prohibited activity on the grounds of the Redding Municipal Library; and offering Ordinance No. 2441 for first reading and waiving the full reading.
