HomeMy WebLinkAboutMinutes - City Council - 2011-12-20 177 City Council, Regular Meeting Civic Center Council Chambers 777 Cypress Avenue Redding, California December 20, 2011 6:00 p.m. I The meeting was called to order by Mayor Dick Dickerson with the following Council Members present: Rick Bosetti, Patrick Jones, Missy McArthur and Francie Sullivan. Also present were City Manager Kurt Starman, City Attorney Rick Duvernay, Assistant City Manager/Interim Electric Utility Director Barry Tippin, Interim Development Services Director Bill Nagel, City Clerk Pamela Mize, and Executive Assistant Sharlene Tipton. The City Manager introduced Department Directors that were in attendance: Interim Personnel Director Sheri DeMaagd, Interim Support Services Director Rod Dinger, Fire Chief Kevin Kreitman, Community Services Director Kimberly Niemer, Police Chief Robert Paoletti, and Finance Director Steve Strong. The Pledge of Allegiance to the Flag was led by Council Member McArthur. Invocation was provided by Lynn Fritz. PUBLIC COMMENT [A-050-060] Rob McDonald spoke relative to the recall petitions he presented to Council Members Bosetti, Jones, and Sullivan. I CONSENT CALENDAR The following matters were considered inclusively under the Consent Calendar and each report to City Council (staff report) is incorporated herein by.reference: 4.(a). Approval of Minutes - Regular Meeting of December 6,2011 4.(b). Approval of Payroll and Accounts Payable Registers [A-050-100-500] It is the recommendation of the Finance Director that the City Council approve Accounts Payable Register No. 11, for the period of December 1, 2011, through December 15, 2011, for a total of $14,368,825.02, for check numbers 898376 through 898915, inclusive, ACH Transfer numbers 8420 through 8461, inclusive, and Wire Transfer numbers 3715 through 3735, inclusive; Payroll Register No. 11, for the period November 13, 2011, through November 26, 2011, in the amount of $2,714,881.26, for electronic deposit transaction numbers 314439 through 315206, inclusive, and check numbers 550354 through 550405, inclusive; and Payroll Register No. 12, for the period November 27,2011, through December 10,2011, in the amount of $3,014,705.57, for electron'ic deposit transaction numbers 315256 through 316024, inclusive, and check numbers 550422 through 550577, inclusive. SUMMARY TOTAL: $20,098,411.85 I 4.2(a). 2010-11 Comprehensive Annual Financial Report and Required Annual Reports- Redding Redevelopment Agency [R-030-075] It is the recommendation of the Assistant City Manager that the City Council accept the Redding Redevelopment Agency's 2010-11 Comprehensive Annual Financial Report and the required annual reports to the State Controller as presented. 4.3(a). Space-lease with Shasta County for Hill 900 Medical Communication Base Unit [C-070-100] It is the recommendation of the Interim Support Services Director that the City Council approve a retroactive no-cost lease with Shasta County to provide space for the County-owned emergency medical communications radio base unit in the City- owned communication shelter located on Hill 900 for the period July 1, 2010, through June 30, 2030. 12/20/2011 178 4.3(b). Consent to Assignment of Lease - Hangar (C-2216) and Permit for Commercial Activities: and Consent to Assignment of Lease - Fixed Based Operator (C-2643); and Permit for Commercial Activities (C-2644) - Benton Airpark [C-070-1 001 A-090-020] It is the recommendation of the Interim Support Services Director that the Council approve the Consent to Assignment of Lease - Hangar (C-2216) and Permit for Commercial Activities; Consent to Assignment of Lease - Fixed Based Operator (C- 2643); and Permit for Commercial Activities (C-2644), assigning said leases from Hillside Aviation Inc., to Benton Field Aviation Services, Inc. at Benton Airpark. I 4.5(a). Award of Bid - Bid Schedule No. 4439, Primary Splice Boxes [B-050-100] It is the recommendation of the Interim Electric Utility Director that the City Council award Bid Schedule No.4439, for furnishing primary splice boxes at the bid unit prices during the period of January 1, 2012, to December 31, 2012, to Cook Concrete Products, Inc.; and authorize the Purchasing Officer to extend the bid award for one year at the same prices, terms, and conditions, if deemed prudent and mutually agreeable to Cook Concrete Products, Inc. 4.5(b). Electric Utility's Monthly Financial Report - October 2011 [B-130-070] It is the recommendation of the Interim Electric Utility Director that the City Council accept Redding Electric Utility's (REU) Monthly Financial Report for October 2011. Billed retail revenue through October was $1,399,176 (3.4%) below projections for the four-month period and total wholesale sales were $6,166,142 (54.4%) above projections. Overall, operating revenue through October came in $4,809,425 (9.0%) above plan. The combined costs for generation, purchase,S from the Western Area Power Administration, contracts, and the spot market were $2,803,591(8.5%) above budget projections through October 2011. Total operating expenses through October were $1,653,998 (16.9%) below budget. REU's net operating results for the first four months of the fiscal year are positive and are $3,659,831 better than budget projections. Debt service payments to-date total $4,618,053. Capital expenditures through October were $725,328 forrevenue-funded projects and $895,224 for bond-funded projects. REU's unrestricted cash balance at the end of October was $33.8 million. I 4.5(c). Award of Bid - Bid Schedule No. 4449 (Job No. 4012-20), Redding Electric Utility Moore Road Substation [B-050-020/E-090-140-475] It was the recommendation of the Interim Electric Utility Director that the City Council authorize the City Manager to award Bid Schedule No. 4449 (Job No. 4012- 20), to the responsible bidder submitting the lowest responsive bid to construct site improvements for the Redding Electric Utility Moore Road Substation; and authorize the City Manager, or his designee, to approve project construction change orders in an amount not-to-exceed 10 percent of the bid amount. 4.10(a).General Fund Financial Report - October 2011 [B-130-070] It is the recommendation of the Finance Director that the City Council accept the monthly General Fund Financial Report for October 2011. Total revenue to-date is $13.7 million or $382,531 (2.9 %) above staffs cash flow projection. Expenditures at month-end, excluding encumbrances, total $21,134,481, or $1,875,508 (8.2%) under staff s projection. Encumbrances total $1,522,303. I 4.11(a).Award of Bid - Bid Schedule No. 4442, Rock and Mineral Products [B-050-100] It is the recommendation of the Public Works Director that the City Council award Bid Schedule No. 4442, Rock and Mineral Products to several companies listed in the Report the City Council (staff report), incorporated herein by reference, dated December 12, 2011, that have submitted the lowest competitive bids for rock, asphalt, and mineral aggregates. 12/20/2011 179 I 4.11(b).PropertyLineAdiustment(PLA-12-11) - Merging a Vacated Portion of Park Marina Drive with the Adjacent Property Located at 3000 Park Marina Drive [L-010-150-750/^C-070-200] It is the recommendation of the Public Works Director that the City Council approve the Property Line Adjustment (PLA-12-11) and authorize the Mayor to sign the Property Line Adjustment Grant Deed merging a vacated portion of Park Marina Drive with the adjacent property owned by the Gerard 1994 Revocable Living Trust located at 3000 Park Marina Drive. 4.11(c).Notice of Completion - Bid Schedule No. 4391 (Job No. 2379), Lassen View Safe Routes to School Project [B-050-020] It is the recommendation of the Public Works Director that the City Council accept the subject construction contract for the Lassen View Safe Routes to School Project, Bid Schedule No. 4391 (Job No. 2379), performed by Sunrise Excavating as satisfactorily complete and authorize the City Clerk to file a Notice of Completion with the Shasta County Recorder. Final cost was $212,264.04. 4.12(a). City Boards. Commissions and Committees - 2012 Term Expirations and Vacancies - California Government Code Section 54972 (Maddy Act) [B-080] It is the recommendation of the City Clerk that the City Council accept Exhibits A and B as outlined in the Report to City Council (staff report) dated December 12, 2011, incorporated herein by reference, relative to the 2012 term expirations and vacancies for City Boards, Commissions and Committees as fulfilling the requirements of California Government Code Section 54972 (Maddy Act). I A MOTION WAS MADE by Council Member Jones, seconded by Council Member Bosetti, that the foregoing items on the Consent Calendar be approved and adopted as recommended. The Vote: Unanimous Ayes PUBLIC HEARINGS. PETITIONS. AND PROTESTS 6.1 PUBLIC HEARING - Re: Resolution to Adopt California Renewable Portfolio Standard (RPS); and RESOLUTION - Revising the RPS and Adopting a Policy for Enforcement of the New RPS Requirements [L-040-300/E-120] Interim Electric Utility Director Tippin summarized the Report to City Council (staff report) dated December 7,2011, incorporated herein by reference, and recommended that the City Council hold a Public Hearing and adopt a resolution revising Redding's RPS and adopting a policy for enforcement of the new RPS requirements, pursuant to the recent passage of Senate Bill 2 in the First Extraordinary Session (SBXl 2). I Vice Mayor Bosetti noted that under SBX 1 2, not allowing hydroelectric generation greater than 30 megawatts as a qualified renewable resource is political rather than environmental. He stated that because the larger power utilities in southern California do not have access to the same hydroelectric resources as the larger northern California utility companies, the southern California utilities perceive an advantage to the northern California utilities. He opined that legislation backed by representatives of southern California will be harmful to Redding and other cities that have access.to large hydroelectric resources. In response to Council Member Jones, Mr. Tippin noted that Shasta Dam provides an average of 110 megawatts and without including it, Redding's RPS is at approximately 25 to 27 percent for 2012-13. Mr. Tippin stated that SBXl 2 regulations apply to the capacity output of the dam and not the amount that is received by the City of Redding. I A MOTION WAS MADE by Council Member McArthur, seconded by Council Member Sullivan, to adopt Resolution No. 2011-197, a resolution ofthe City Council of the City of Redding to revise the Renewable Portfolio Standard for the City of Redding's Electric System. APPOINTMENTS 7.1 Re-Appointment - Shasta County Commission on Aging [B-080-470] Ci ty Manager Starman highlighted the Report to City Council ( staff report) dated December 12, 2011, incorporated herein by reference, and relayed Mayor Dickerson's recommendation that the City Council re-appoint Murray H. Blake to the Shasta County Commission on Aging to serve a two-year term ending January 6,2014. A MOTION WAS MADE by Council Member Bosetti, seconded by Council Member McArthur, to re-appoint Murray H. Blake to the Shasta County Commission on Aging to serve a two-year term ending January 6,2014. The Vote: Unanimous Ayes I REGULAR CALENDAR - REPORTS & COMMUNICATIONS OF DEPARTMENTS, BOARDS, COMMISSIONS, AND COMMITTEES 9.1(a). Ordinance -Amending Redding Municipal Code Title 7 (Animals) and Chapter 7.12 (Dogs) [C-110-100/A-130-150] Assistant to the City Manager Clark summarized the Report to City Council (staff report) dated December 8,2011, incorporated herein by reference, and recommended that the City Council introduce an ordinance by title only, amending Redding Municipal Code Title 7 (Animals) Chapter 7.12 (Dogs) by amending Section 7.120.030 and repealing Section 7.12.070 which includes revisions to language relating to dog license terms. A MOTION WAS MADE by Council Member McArthur, seconded by Council Member Bosetti, to introduce Ordinance No. 2482 by title only, an ordinance of the City Council ofthe City of Redding amending Title 7 (Animals) Chapter 7. 12 (Dogs) by amending Section 7.12.030 and repealing Section 7.12.070 of the Redding Municipal Code relating to licensing of dogs.
