The meeting was called to order by Mayor Mathena with the following Council Members
present: Dickerson, Murray, Pohlmeyer, and Stegall.
Also present were City Attorney Warren, Assistant City Manager Perry, Assistant City
Manager Starman, and City Attorney Duvernay.
At the hour of 6:00 p.m., Mayor Mathena announced that the City Council would adjourn to
closed session to discuss the following:

1. Closed session pursuant to California Goverrnrient Code Section 54956.9(b)(2) to
seek advice of legal counsel and determine if, based on certain facts and
circumstances not yet known to a potential plaintiff, there is a significant exposure
to litigation against the City.

At the hour of 6:55 p.m., Mayor Mathena reconvened the Special Meeting to open session
and advised that with respect to Item No.1, the City Council determined upon advice oflegal
counsel that certain facts and circumstances constitute a significant exposure to litigation
against the City. As a result of this determination and with regard to Item No.2, Mayor
Mathena related that the City Council directed the City Manager to prepare an amendment
to the Biennial 2005-07 City Budget relating to interdepartmental charges and fees in
compliance with the new law established in the case of HJTA v. City of Fresno and return
the report to the City Council for consideration in open session.
Mayor Mathena reported that relative to Item No.3, the City Council authorized settlement
of a claim with the Hartford Accident & Indemnity Company acting as surety to Kenko, Inc.,
a public works construction contractor, who defaulted on the Phase I Parallel Westside
Interceptor Project (Bid Schedule No. 3414). The details ofthe written settlement allowing
the City to recover approximately $70,000 in penalties and damages in excess of project costs
will be made available for public inspection in the office of the City Clerk upon finalization.
There being no further business, at the hour of 6:57 p.m., Mayor Mathena declared the
meeting adjourned.
