RESOLUTION - Approving the Memorandum of Understanding between the City of Reqding al).d Local Union 1934 of International Association of Fire Fighters - AFL-CIO (P-I00-050.,050) .. Administrative Services Director Bachman provided an overview of the Report to City Council datl;:d June 20, 2002, recalling that the existing Memorandum of Understanding (MOU) between the City of Redding and Local Union 1934 ofInternational Association of Fire Fighters - AFL-CIO (IAFF) expIred Decen).ber.31, 2000. He stated that the proposed MOUwol!ld be effective January 1,2001, through June 30, 2006, with a total economic cost of ~6.5% (or an average annual increase of 6.6%, alld retroactivity to July 1, 2001. Mr. . ' ' ~ ' Bachman related that additional modifications to the MOU are technical in natur~ such as . health insurance changes to provide consistency with other un,ions within the City. Mr. Bachm~ explained that the process of negotiation inCluded a request by the IAFF for binding arbitration pursuant to provisions of Senate Bill 402, which became effective January 1, 2001, and established the right of firefighters and law enforcement officers to force cities. and counties into binding arbitration over economic issues, including salaries and benefits. Th~ City belJeves that the new law is unconstitutional because it delegates to a private person the power to perform municipal economic functions in violation of Article XI, Section 11 (a) oftpe Sltate ~on~ti.tution. Therefore, the City filed an action with the Superior Court in June , ' '{ ., 20Q 1 to, seek declaratory relief from the binding interest law. He said the case is currently in the State Court of Appeals, and it is unknown when it will be heard. I Mr. Bachman recommended adoption ofthe resolution approving the provisions of the MOU between the City of Redding and IAFF. . . IAFF President Rich Bates related that the negotiation process for the proposed MOU was long and difficult. He pointed out that membership ratification of the MOU was not unanimous and maintained his beliefthat members are justified in their requests. Mr. Bates then announced his retirement, effective July 1,2002, as President of the IAFF citing family commitments. He acknowledged the assistanpe of Fire Chief Gunsauls, Administrative Services Director Bachman, and Personnel Manager Johnson through the difficult process. Mayor Kight stated tqat n~gotiations have been a long, arduous process and IAFF President Bates will be sorely missed. He applauded Mr. Bates' honor and integrity as a negotiator. Council Member Cibula echoed Mayor Kight's comments.
