HomeMy WebLinkAboutMinutes - City Council - 2002-05-07 - Special Meeting 84 City Council, Special Meeting Council Chambers 777 Cypress Avenue Redding, California May 7, 2002 6:30 p.m. The meeting was called to order by Mayor Kight with the following Council Members present: Cibula, McGeorge, Pohlmeyer, and Stegall. Also present were City Manager Warren, Assistant City Manager Perry, Deputy City Manager Starman, City Attorney Wingate, and Administrative Services Director Bachman. I At the hour of 6:30 p.m., Mayor Kight announced that the City Council would adjourn to closed session to discuss the items listed below. At the hour of 6:58 p.m., Mayor Kight reconvened the meeting to open session. Closed session pursuant to California Government Code Section 54957.6: CONFERENCE WITH LABOR NEGOTIATOR Designated Agency Representative: Randy Bachman Employee Organization: Peace Officers Association of Redding (P-IOO-050-120) Mayor Kight reported that the City Council approved the proposed amendments to the Redding Peace Officers Association (RPOA) Memorandum of Understanding (MOU) to provide an economic benefits package totaling 25% over a 4~ year term (or 5.6% per year) which includes a 3% at age 50 retirement option. He explained that this increase is consistent with the City's General Fund 10-year Financial Plan. In light of a recent newspaper article challenging the City's refusal to make the proposed RPOA labor contract public prior to City Council deliberation on the matter, Mayor Kight requested that City Attorney Wingate explain the legal parameters which govern labor negotiations and other issues of a sensitive nature. I City Attorney Wingate summarized the Ralph M. Brown Act which requires that local agencies conduct deliberations openly and in public to assure communities that all information is provided to the public. However, the Brown Act also provides that items of a sensitive nature such as personnel issues, labor negotiations, litigation and the sale or purchase of real property may be considered in closed session without public input. He pointed out that labor negotiations with the RPOA have been ongoing for some time and, prior to the Closed Session meeting, the City Council had not had the opportunity to review the contract or receive new information and recommendations regarding the issue. Mr. Wingate stated that the proceedings were held in strict adherence to the Brown Act and that the public's right to information had not been breached. MOTION: Made by Council Member Pohlmeyer, seconded by Council Member Stegall, adopting Resolution No. 2002-75, a resolution of the City Council of the City of Redding approving the provisions ofthe Memorandum of Understanding (MOU) entered into between the City of Redding and the Peace Officers Association of Redding-Sworn Employees, effective from April 14, 2002, through March 19, 2006.The Vote: AYES: NOES: ABSTAIN: ABSENT: Council Members - Cibula, McGeorge, Pohlmeyer, Stegall, and Kight Council Members - None Council Members - None Council Members - None I Resolution No. 2002-75 is on file in the Office of the City Clerk.
