City Council, Special Meeting

July 9,2001 7:00 a.m.
The meeting was called to order by Mayor McGeorge with the following Council Members
present: Kight, Pohlmeyer and Stegall. Council Member Cibula was absent.
Also present were City Manager Warren, Assistant City Manager Perry, Deputy City
Manager Starman, and City Attorney Wingate.

At the hour of7:00 a.m., Mayor McGeorge announced that the City Council would adjourn
to closed session to discuss the following:

Mayor McGeorge reconvened the meeting to open session at the hour of7:35 a.m. Mayor
McGeorge reported that after deliberation, the City Council determined it is in the best
interests of all parties, including the citizens of Redding, to authorize the City Attorney to
file an Action for Declaratory Relief, naming the Local Union 1934 of the International
Association of Firefighters as defendant.
The purpose of the action is to seek a determination from the Superior Court as to the
constitutionality of Senate Bill 402 (SB 402), a State law which became effective on January
1, 2001. SB 402 established the right of firefighters and law enforcement officers to force
the City into binding arbitration over economic issues, including salaries and benefits. The
City Council believes that the new law is unconstitutional because it delegates to a private
person the power to perform municipal economic functions in violation of Article XI,
Section ll(a) of the State Constitution.

There being no further business, at the hour of 7:35 a.m., Mayor McGeorge declared the
meeting adjourned.
