HomeMy WebLinkAboutOrdinance - 2595 - Renewable Energy Projects ORDINANCE NO. 2595 AN ORDINANCE OF THE CITY OF REDDING AMENDING REDDING MUNICIPAL CODE TITLE 4 (REVENUE AND FINANCE), CHAPTER 4.22 (PUBLIC PROJECTS) BY ADDING SECTION 4.22.130 (DESIGN BUILD AND RENEWABLE ENERGY PROJECTS),AUTHORIZING THE CITY TO ENTER INTO DESIGN BUILD AND RENEWABLE ENERGY PROJECTS WHEREAS, pursuant to Chapter 4.22 of the Redding Municipal Code, the City Council of the City of Redding may establish procedures to assist in the implementation of the awarding and acceptance of public projects; and WHEREAS, the City of Redding desires to utilize design-build for some public projects, excluding projects on the state highway system, pursuant to California Public Contract Code Section 22160 et seq., as the City believes utilization of that procurement method would result in lower project costs, higher accountability, and higher quality construction work for the eligible projects; and WHEREAS, the City of Redding also desires to utilize renewable energy efficiency contracting procedures for many of the aforementioned reasons and pursuant to California Government Code Section 4217; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF REDDING AS FOLLOWS: Section 1. Title 4 (Revenue and Finance), Chapter 4.22 (Public Projects), Section 4.22.130 (Design-Build Projects) is hereby amended to read as follows: 4.22.130—Design-Build and Renewable Energy Projects A. Notwithstanding anything to the contrary in this Chapter and pursuant to California Public Contract Code Section 22160 et seq., the City is authorized to use design-build �\ contracts for public works projects, as defined in Public Contract Code Section 22161(g)(1), over one million dollars with an award of contract either to the low bid or the bid representing the best value, as defined by statute or in any other situations that may be authorized by state law. B. As required by Public Contract Code Section 22162, a design professional or other consultant who, under contract with the City, provides assistance related to the design- build procurement, including, but not limited to, preparing the documents for the request for qualifications or request for proposals documents envisioned in Public Contract Code Section 22164 shall be prohibited from participating with the design-build entity. C. The City is further authorized to enter into renewable energy and energy efficiency projects, pursuant to California Government Code Section 4217 et seq., or California Public Utilities Code Section 388, et seq. Section 2. Severability. If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held by a court of competent jurisdiction to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of the ordinance. The City Council of the City of Redding hereby declares that it would have passed this ordinance and each section, subsection, sentence, clause and phrase thereof irrespective of the fact that one or more sections, subsections, sentences, clauses or phrases may be held invalid or unconstitutional. Section 3. The passage of this ordinance is not a "project" according to the definition in the California Environmental Quality Act, and therefore is not subject to the provisions requiring environmental review. Section 4. This ordinance shall take effect thirty (30) days after the date of its adoption, and the City Clerk shall certify to the adoption thereof and cause publication according to law.
