At its meeting of August 28, 2018, the Planning Commission of the City of Redding declared that the closure and vacation of the portion of Railroad Avenue adjacent to property addressed as 1807 Oregon Street is consistent with the City of Redding General Plan. B. On October 3, 2018, by Resolution 2018-102, the City Council found that the permanent closure of a portion of Railroad Avenue and vacating the public street right-of-way easement across the property is consistent with the General Plan pursuant to Government Code Section 65402, would not compromise the street-circulation system or the General Plan Transportation Element Goal to maintain a safe and efficient local street system, that the property is unnecessary for present or prospective use as a street and, therefore, it is not in the interest of the City to continue the establishment and maintenance of this portion of street. C. Proceedings have been duly conducted and held in accordance with the provisions of the Public Streets, Highways, and Service Easements Vacation Law as set forth in Sections 8300 et seq., of the Streets and Highways Code of the State of California, including a public hearing held on November 6, 2018. �� D. The Area of Abandonment falls within the criteria of CEQA Section 15332 and is � (`, categorically exempt. _ f� NOW, THEREFORE, THE CITY COUNCIL FINDS, DECLARES AND RESOLVES AS � FOLLOWS: J� 1. The City Council elects to proceed in this matter under the provisions of California Streets and Highways Code Sections 8300 et seg. 2. Pursuant to Streets and Highways Code §8324, the Council finds that the street segment is unnecessary for present or prospective public street use. 3. The City Council approves the vacation and abandonment of that section of Railroad Avenue located adjacent to and between the property addressed as 1807 Oregon Street and the Union Pacific Railroad right-of-way bounded on the north by Sacramento Street and on the south by South Street, more particularly described in Exhibit "A" and as shown hatched on Exhibit "B" attached hereto. 4. The Area of Abandonment is hereby vacated, PROVIDED THAT this vacation shall not become effective until the following conditions have been satisfied: a. Dedication of a five-foot-wide public service easement along the east property line of 1807 Oregon Street. b. Dedication of a ten-foot-wide public service easement adjacent to the Union Pacific Railroad right-of-way. c. Dedication of a twelve-foot-wide public easement for pedestrian and bicycle access adjacent to the Union Pacific Railroad right-of-way. d. Construction of curb, gutter, sidewalk and any necessary tie-in paving along the South Street and Sacramento Street frontages of the property. 5. When the Director of Development Services advised the City Clerk that the above conditions have been met, pursuant to Streets and Highways Code §8325, the City Clerk is directed to record a certified copy of this resolution, attested by the Clerk under seal, in the office of the Shasta County Assessor/Recorder. The abandonment and vacation of the area described in Exhibit A shall be valid and effective as of the date of recordation of the certified copy of this resolution.
