HomeMy WebLinkAboutReso 2018-108 - Schedule of Fees RESOLUTION NO. 2018-108 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING AMENDING ITS SCHEDULE OF FEES AND SERVICE CHARGES WHEREAS: A. On October 4, 1988, by Resolution 88-364, the City Council adopted a Schedule of Fees and Service Charges (Schedule), which has been subsequently amended from time-to- time; B. Pursuant to said resolution, the City Manager is authorized and directed to revise, supplement, and maintain the Schedule so that it will be, to the greatest extent possible, a comprehensive list of fees and City permits and services; and that a fee that is not on the Schedule will not be invalid but should be made a part thereof at the earliest possible time; C. It is the desire of the City Council that all City services be self-supporting and not subsidized as to their operational costs by revenues raised through the imposition of ad valorem taxes or other sources of revenue; D. On July 26, 2018, the City Manager, in his capacity as Director of Emergency Services, proclaimed the existence of local emergency in the City of Redding; E. On July 26, 2018, the Governor of the State of California proclaimed a State of Emergency for Shasta and other counties; F. On July 31, 2018, the City Council adopted Resolution No. 2018-083 ratifying the City Manager's proclamation of the existence of a local emergency; G. On August 4, 2018, President Donald J. Trump declared the existence of a major disaster in the State of California and ordered Federal aid to supplement State and local recovery efforts in the areas affected by wildfires, beginning on July 23, 2018; H. The Council recognizes the urgent need to rebuild and repopulate those areas affected by the Carr Fire and has identified several measures by which the process could be expedited and facilitated; I. The Carr Fire Natural Disaster destroyed over 250 residential structures in the City; J. This Resolution exercises the land use powers of the City to protect the health, safety, and welfare of the public which would be put at risk if fire-damaged neighborhoods were not quickly repaired and repopulated; �) K. Adoption of this amendment is exempt from the provisions of the California C Environmental Quality Act (CEQA) pursuant to Public Resources Code Section CC 21080(b)(3) regarding repairs and replacement work after a state-declared disaster and Section 21080(b)(4) regarding actions to mitigate or prevent an emergency, and CEQA .- Guidelines Section 15269(a) regarding maintaining, repairing, restoring, demolishing, or Q replacing property or facilities damaged or destroyed as a result of a disaster in a disaster (C stricken area in which a state of emergency has been proclaimed by the Governor pursuant to the California Emergency Services Act, commencing with Section 8550 of the Government Code, and Section 15269(c) regarding specific actions necessary to prevent or mitigate an emergency; L. The City Council has been provided with information upon which the findings and actions set forth in this Resolution are based; M. For the reasons set forth above, this Resolution is declared by the City Council to be necessary for preserving the public peace, welfare, health, or safety and to avoid a current, immediate, and direct threat to the peace, health, safety, or welfare of the community and the recitals above taken together constitute the City Council' s statement of the reasons for adopting this Resolution; and N. A public hearing on the proposed increases and changes was held on this date, prior to the adoption of this Resolution. NOW, THEREFORE, the City Council of the City of Redding FINDS, DETERMINES, and RESOLVES as follows: 1. With respect to the proposed changes in fees and charges, the City Council finds and determines that: a. The fees and charges previously established by resolution continue to be reasonably related to the cost of providing the specific services for which the fees are charged, except as modified herein, and as based on the most recent fee study of July 1, 2017. The modifications reflect the decreases in the costs of providing the specific services related to the charges occasioned by the retention of retired annuitants to assist in processing building permit applications requested by those impacted by the Carr Fire. b. The new fees are reasonably related to or are less than the cost of providing the specific service for which the fee is to be charged, and is necessary to cover, but does not exceed the City's costs of providing the service. c. The provisions of the California Environmental Quality Act do not apply to the new or increased fees, which are for the purpose of meeting operating expenses of a portion thereof. d. The proposed new fees will not exceed the governmental costs in providing said services in Fiscal Year 2018-19. 2. The fees and charges be amended to cover, but not exceed, the City's costs of providing the services. 3. The reduction of fees shall apply to Carr Fire building permits applied for prior to December 31, 2021.
