A RESOLUTION BY THE CITY COUNCIL DECLARING ITS INTENTION
TO VACATE AND ABANDON A PORTION OF RAILROAD AVENUE
ADJACENT TO AND BETWEEN THE PROPERTY ADDRESSED AS 1807
OREGON STREET (ASSESSOR'S PARCEL NUMBER 101-120-008) AND
THE UNION PACIFIC RAILROAD RIGHT-OF-WAY AND BOUNDED ON
THE NORTH BY SACRAMENTO STREET AND ON THE SOUTH BY
SOUTH STREET (ABANDONMENT APPLICATION A-2018-00522)
WHEREAS:
A. Building Adventures Inc., has requested the City of Redding close and permanently
abandon the public street right-of-way interest to the area of Railroad Avenue adjacent to
and between property addressed as 1807 Oregon Street (Assessor's Parcel Number 101-
120-008) and the Union Pacific Railroad right-of-way, bounded on the north by
Sacramento Street and on the south by South Street, more particularly described in
Exhibit A and shown crosshatched on Exhibit B attached and made a part hereof,
hereafter called "Area of Abandonment."
B. The Director of Public Works has investigated the proposed vacation, and has advised the
City Council that subject to the conditions hereinafter set forth, the Area of Abandonment
will no longer be required for public street right-of-way and the underlying fee title
belongs to Building Adventures Inc.
C. At its meeting of August 28, 2018, the Planning Commission of the City of Redding
declared that the closure and vacation of the Area of Abandonment is consistent with the
City of Redding General Plan.
NOW, THEREFORE, THE CITY COUNCIL FINDS, DECLARES AND RESOLVES AS
FOLLOWS:
1. The forgoing recitals are true and correct. CC
2. City Council elects to proceed in this matter under the provisions of the Public Streets,
Highways and Services Easements Vacation Law, as set forth in Section 8300 et seq., of
the Street and Highways Code of California, with the provision that this resolution shall
be deemed a Resolution of Intention.
3. The proposed vacation is consistent with the General Plan. Vacating and abandoning this
section of street would not compromise the street-circulation system or the General Plan
Transportation Element Goal to maintain a safe and efficient local street system.
Maintaining easements through the property for utility and pedestrian use is consistent
with General Plan Goals to provide safe and efficient routes for walking and bicycling
and supporting development in an efficient and orderly manner.
4. The proposed Area of Vacation is unnecessary for present or prospective public use as a
street because it is not essential to local or citywide circulation and does not serve a
critical public-street or traffic-circulation purpose. Therefore, the City Council intends to
and hereby declares its intention to vacate that section of Railroad Avenue located
adjacent to and between the property addressed as 1807 Oregon Street and the Union
Pacific Railroad right-of-way bounded on the north by Sacramento Street and on the
south by South Street, more particularly described in Exhibit "A" and shown hatched on
Exhibit "B" attached hereto, PROVIDED THAT this vacation shall not become effective
until the following conditions have been satisfied:
a. Dedication of a five-foot-wide easement along the east property line of 1807 Oregon
Street for existing Redding Electrical Utility facilities.
b. Dedication of a 10-foot-wide easement for AT&T underground facilities adjacent to
the Union Pacific Railroad right-of-way.
c. Dedication of a 12-foot-wide easement for pedestrian and bicycle access adjacent to
the Union Pacific Railroad right-of-way.
d. Construction of curb, gutter, sidewalk and any necessary tie-in paving along the South
Street and Sacramento Street frontages of the property.
5. All persons interested in or objecting to the proposed vacation will be heard on Tuesday,
November 6, 2018, at the hour of 6 p.m. or as soon thereafter as the matter may be heard,
in the City Council Chambers located at 777 Cypress Avenue.
6. The Public Works Director is hereby instructed to post or cause to be conspicuously
posted notices of vacation along the line of the proposed area of vacation as set forth in
Section 8323 of the Streets and Highways Code. The notices shall set forth adoption of
this Resolution of Intention and the date, hour, and place of the hearing as set forth
above. At least three such notices shall be posted at least two weeks prior to the date of
hearing.
7. The City Clerk shall certify to the passage and adoption of this resolution of intention,
and cause the same to be published in a newspaper of general circulation in the City of
Redding for two consecutive weeks before the public hearing of this proposed vacation.
I HEREBY CERTIFY that the foregoing resolution was introduced and adopted at a special
meeting of the City Council of the City of Redding on the 3`d day of October, 2018, and was
adopted at said meeting by the following vote:

Exhibit"A"
A parcel of land situate in the southwest one-quarter of Section 10 of the P.B. Reading Grant,
City of Redding, California, more particularly described as follows:
A portion of Railroad Avenue right-of-way as shown on that certain map of The Town of
Redding,recorded in the Book of Town Plats,at Page 11, Shasta County Records,beginning at
the northeast corner of Block 45 of said Town Plats Map; thence along the projection of the
southerly right-of-way line of Sacramento Street,N72°20'00"E 82.64 feet more or less to the
west line of the S.P.R.R. property;thence along said west line, S07°09'47"E 142.39 feet more or
less to the northerly right-of-way line of South Street; thence along said northerly line,
S72°20'00"W 56.68 feet more or less to the southeast corner of said Block 45,thence along the
easterly line of said Block 45,N17°40'00"W 140.00 feet more or less to the point of beginning.
Containing 9,752 SQ. FT.
Reserving an easement for pedestrian access 12.00 feet wide as measured at right angles
described as follows:
A strip of land 12.00 feet wide adjacent to and lying westerly of the west line of said S.P.R.R.
property. The sidelines shall be lengthened or shortened to terminate on the northerly line of
South Street and the southerly line of Sacramento Street.
Also reserving an easement for public service easement 5.00 wide as measured at right angles,
adjacent to and lying easterly of the east line of said Block 45.
Also reserving there from a strip of land for public service easement purposes 10.00 feet wide,
lying 5.00 feet on each side of the following described centerline:
Commencing at the northeast corner of said Block 45; thence along the projection of Sacramento
Street,N72°20'00"E 72.49 feet; thence S06°51'17"E 142.53 feet to a point on the projection of
South Street, and the point of termination, which point bears N72°20'00"E 45.76 feet from the
southeast corner of said Block 45.
PUBLIC SERVICE EASEMENT NOTE:
