HomeMy WebLinkAboutReso 1990-339 - Certifying the completion of a final environmental impact reportI RESOLUTION NO. 9O -3,317 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING CERTIFYING THE COMPLETION OF A FINAL ENVIRONMENTAL IMPACT REPORT FOR THE AMENDED REDEVELOPMENT PLAN FOR THE MARKET STREET REDEVELOPMENT PROJECT. WHEREAS, the Redding Redevelopment Agency (the "Agency") has prepared and submitted to the City Council a proposed Amended Redevelopment Plan (the "Amended Plan") to the Market Street Redevelopment Project which would add area to the Project (the "Added Area"), increase certain limits in, add certain public improvements to and change the name of the Redevelopment Plan and make other technical and textual changes to the Redevelopment Plan; and WHEREAS, an environmental impact report (the "EIR") on the Amended Plan was prepared by the Agency pursuant to the California Environmental Quality Act (Public Resources Code Section 21000 et seg.); the Guidelines for Implementation of the California Environmental Quality Act (14 C.C.R. Section 15000 et. seq., hereinafter the "State CEQA Guidelines"); and local procedures adopted by the Agency pursuant thereto; and WHEREAS, a Notice of Completion of the Draft EIR was filed with the Office of Planning and Research on January 23, 1990, and a public notice of the availability of the Draft EIR was published in the Redding Record Searchlight, on January 25, 1990; and WHEREAS, copies of the Draft EIR were distributed to the State Clearing- house and to those public agencies which have jurisdiction by law with respect to the Project, as proposed to be amended, and to other interested persons and agencies, and the comments of such persons and agencies were sought; and WHEREAS, the Draft EIR was thereafter revised and supplemented to adopt changes suggested, to incorporate comments received and the Agency's response to said comments, and as so revised and supplemented, a Final EIR was prepared 1 and submitted to the City Council; and p WHEREAS, a joint public hearing was held by the Agency and the City Council on June 19, 1990, on the Amended Plan and the Final EIR relating thereto, following notice duly and regularly given as required by law, and all interested persons expressing a desire to comment thereon or object thereto having been heard, and said Final EIR and all comments and responses thereto having been considered; and WHEREAS, the Final EIR consists of the Draft EIR, as revised and supple- mented, made a part of the Agency's Report on the Amended Plan incorporating all comments received and the response of the Agency and the Council thereto as of the date hereof; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDDING DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The City Council has considered the Final EIR for the Amended Plan as prepared by the Agency and has evaluated all comments, written and oral, received from persons who have reviewed the Draft EIR. Section 2. The City Council hereby makes the written findings set forth in Exhibit A, attached hereto and incorporated by reference herein, for each of the significant effects set forth in said Exhibit A, and further approves the statements of facts set forth in said Exhibit A. Based on such findings and statements of facts, the City Council hereby finds that significant environmental effects have been reduced to an acceptable level in that all significant environmental effects have been eliminated or substantially lessened, except for the potential elimination of significant vegetation between Parkview Avenue and the Sacramento River along the south bank of Calaboose Creek. Based on the foregoing, the City Council finds and deter- mines that the Amended Plan to the Market Street Redevelopment Project will have a significant effect upon the environment. - 2 - Section 3. In the event it is determined that significant environmental effects are not mitigated or substantially lessened, the City Council finds that the benefits of the Amended Plan outweigh such effects and hereby adopts the following statement of overriding considerations. The City Council hereby finds that, based on the findings and statements of facts set forth in Exhibit A, and based on the Final EIR and/or other information contained in the record, its action to approve and carry out the Amended Plan is supported for the reasons that the Amended Plan will encourage and assist in effectuating the objectives of the Redevelopment Plan, as proposed to be amended by the Amended Plan, to: eliminate blighting influences and correct environmental deficiencies in the Added Area, including, among others, small and irregular lots, obsolete and aged building types and inadequate or deteriorated public improvements; permit the assembly of land into parcels suitable for modern, integrated development with improved pedestrian and vehicular circulation in the Added Area; replan, redesign and develop undeveloped areas which are stagnant or improperly utilized; strengthen retail and other commercial functions in the Added Area; provide opportunities for participation by owners and tenants in the revitalization of their properties; expand employment opportunities; establish and implement performance criteria to assure high site design standards and environmental quality and other design elements which provide unity and integrity to the Added Area and the existing Project Area; and expand and improve the supply of housing for low- and moderate - income persons. Section 4. Description of significant effect: LAND USE: Potential for displacement of some businesses and a few residents as a result of Agency acquisition of property for redevelopment projects. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The facts supporting such finding are as follows: a. Redevelopment projects shall be designed and located in a manner which will minimize the need for acquisition of private property. b. Any acquisition of property or relocation of businesses and residents shall be done in conformance with state law. C. New development will be subject to City General Plan policies and development regulations. This finding is supported by substantial evidence in the record of the proceedings before the Council. 2. Description of significant effect: LAND USE: Potential for temporary violation of zoning provisions and allowable land uses and adverse effects on residents, businesses and other persons in project area due to construction activities, such as excavation, dredging, noise, and equipment parking. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. RDD/EIRExhACC/CDC 1 6/28/90 The facts supporting such finding are as follows: a. Use permits will be required for exceptional activities. b. Redevelopment projects will be phased to minimize impacts on residents and to reduce excessive noise levels. C. Construction sites shall be watered as necessary to control dust and shall be revegetated as soon as possible. d. The mitigation measures for geology in paragraph 36, noise in paragraph 17, traffic in paragraphs 4 and 9 and visual in paragraphs 23 and 25 will minimize the construction impacts. This finding is supported by substantial evidence in the record of the proceedings before the Council. 3. Description of significant effect: LAND USE: Increase in parking needs, pedestrian traffic, and noise levels due to construction of public recreational facilities and potential effects on property values of properties in vicinity of new public recreational facilities. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The fact supporting such finding is as follows: The design of public recreational facilities shall take into consideration their effects on immediate and nearby neighborhoods. This finding is supported by substantial evidence in the record of the proceedings before the Council. 4. Description of significant effect: TRAFFIC AND CIRCULATION: Possible increase in trip generation due to new dwelling units. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which RDD/EIRExhACC/CDC 2 6/28/90 avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The fact supporting such finding is as follows: Prior to construction of new housing projects, initial studies shall be required to determine whether significant traffic impacts would be created, and environmental assessments, traffic studies and/or additional environmental impact reports shall be required if the initial studies determine significant traffic impacts would occur. This finding is supported by substantial evidence in the record of the proceedings before the Council. 5. Description of significant effect: TRAFFIC AND CIRCULATION: Potential for temporary disruptions in traffic flow and increase in localized congestion due to construction of new roadway improvements. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The facts supporting such finding are as follows: a. Construction plans within street rights-of-way shall be coordinated with the Police and Fire Departments to ensure that adequate detour routes are established if through -traffic is temporarily suspended. b. Construction in travel lanes shall be required to be done during off- peak hours. C. Complete trenching across streets shall be done in segments and decking shall be required where necessary to ensure that at least one travel lane will remain open at all times. In addition, during construction of major streets, at least one lane in each direction shall remain open. d. Adequate signing and placement of barricades with flashing lights shall be required as part of an overall traffic control plan. e. Flagmen will be required wherever opposing traffic flows are required to use the same travel lane. RDD/EIRExhACC/CDC 3 6/28/90 f. Plans to implement control of pedestrian movement across construction right-of-way at regular intervals shall be implemented. g. Adequate truck routes shall be provided and maintained. This finding is supported by substantial evidence in the record of the proceedings before the Council. 6. Description of significant effect: TRAFFIC AND CIRCULATION: Potential for minor increase in traffic congestion and delays due to placement of new bus shelters. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The facts supporting such finding are as follows: a. All shelters shall be placed in a manner which will not interfere with intersection traffic at peak traffic hours. b. On heavily traveled roadways, bus turnouts shall be installed. This finding is supported by substantial evidence in the record of the proceedings before the Council. 7. Description of significant effect: TRAFFIC AND CIRCULATION: Potential for difficult and unsafe pedestrian flow near intersections of Court Street/Butte Street and Court Street/Yuba Street due to increased traffic. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The fact supporting such finding is as follows: A pedestrian walkway/traffic signal combination shall be placed in the vicinity of the intersection of Butte Street and Court Street when traffic warrants the signal. Description of significant effect: TRAFFIC AND CIRCULATION: Potential for automobile/bicycle traffic conflicts on new roadways. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The fact supporting such finding is as follows: All new street extensions and new bridges shall include bicycle lanes or sidewalks of sufficient design to accommodate bicycles, whenever possible. This finding is supported by substantial evidence in the record of the proceedings before the Council. 9. Description of significant effect: TRAFFIC AND CIRCULATION: Potential for local traffic congestion due to construction and placement of new public structures. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The facts supporting such finding are as follows: a. New public structures shall be designed and located in a manner that will minimize the traffic impacts. b. When more detail is available on the location and design of the public structures, new traffic studies will be required to determine whether additional environmental review is needed. This finding is supported by substantial evidence in the record of the proceedings before the Council. RDD/EIRExhACC/CDC 5 6/28/90 10. Description of significant effect: PUBLIC SERVICES AND FISCAL CONDITIONS: Potential for decrease in road safety and emergency access due to construction of roadway improvements. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The fact supporting such finding is as follows: Prior to construction of each roadway improvement project, a traffic flow plan approved by the City Traffic Engineer shall be required, and the Police Department shall monitor the effectiveness of the traffic flow plan during the construction phases of each roadway improvement project. This finding is supported by substantial evidence in the record of the proceedings before the Council. 11. Description of significant effect: PUBLIC SERVICES AND FISCAL CONDITIONS: Potential for inadequate emergency access for fire trucks due to resubdivision of the Fern Subdivision. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The fact supporting such finding is as follows: Subdivision plans for the Fern Subdivision shall be required to be reviewed by the Fire Department prior to subdivision approval in order to ensure that roads would be accessible to fire trucks. This finding is supported by substantial evidence in the record of the proceedings before the Council. RDD/EIRExhACC/CDC 6 6/28/90 12. Description of significant effect: PUBLIC SERVICES AND FISCAL CONDITIONS: Potential for fire hazards due to residential development from the resubdivision of the Fern Subdivision. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The facts supporting such finding are as follows: a. Residential development in the Fern Subdivision shall be required to use fire resistant roofing material. b. The Fire Department shall review the tentative map of the resubdivision of Fern Subdivision to ensure that sufficient emergency access is available. This finding is supported by substantial evidence in the record of the proceedings before the Council. 13. Description of significant effect: PUBLIC SERVICES AND FISCAL CONDITIONS: Potential for incurring significant costs due to relocation and undergrounds of electrical facilities. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The fact supporting such finding is as follows: The Agency and Electric Department shall work together to develop cost estimates and the costs shall be included in the budget for individual projects. This finding is supported by substantial evidence in the record of the proceedings before the Council. RDD/EIRExhACC/CDC 7 6/28/90 14. Description of significant effect: PUBLIC SERVICES AND FISCAL CONDITIONS: Potential increase in number of students due to residential development facilitated by redevelopment projects. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The facts supporting such finding are as follows: a. New commercial and residential development will be required to pay the maximum school impact fees allowable under State law. b. The redevelopment project will be assisting in the development of school facilities. C. The redevelopment process includes provisions for meeting with school districts through the fiscal review process to determine if the redevelopment project will cause a significant financial burden or detriment, and if significant financial burden or detriment is proven, the Agency shall take appropriate action to alleviate the significant financial burden or detriment. This finding is supported by substantial evidence in the record of the proceedings before the Council. 15. Description of significant effect: PUBLIC SERVICES AND FISCAL CONDITIONS: Potential for adverse financial impacts to the City and other affected taxing entities due to tax increment financing. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The fact supporting such finding is as follows: The redevelopment process provides for meeting with affected taxing entities to determine whether the redevelopment project will cause a significant financial burden or detriment to the taxing entity, and if RDD/EIRExhACC/CDC 8 6/28/90 significant financial burden or detriment is proven, the Agency shall take appropriate action to alleviate the significant financial burden or detriment. This finding is supported by substantial evidence in the record of the proceedings before the Council. 16. Description of significant effect: PUBLIC SERVICES AND FISCAL CONDITIONS: Potential for increase in water needs beyond water system capacity by the year 2015. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The facts supporting such finding are as follows: a. By 2010, the City shall develop a program to supply additional water service to accommodate planned growth to 2030. b. By 2015, if it is deemed warranted at that time, the water supply project shall be constructed at once or in phases. C. New development pays for water system improvements. This finding is supported by substantial evidence in the record of the proceedings before the Council. 17. Description of significant effect: NOISE: Potential for temporary increase in noise levels due to construction of redevelopment projects. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The facts supporting such finding are as follows: a. All construction vehicles and equipment shall be required to be properly muffled and shall meet the California State noise standards for delivery motor vehicles. RDD/EIRExhACC/CDC 9 6/28/90 b. In residential areas, construction operations and related travel in the vicinity of the project site to and from the cosntruction area shall be limited to between the hours of 7:30 a.m. and 6:00 p.m., Monday through Saturday. C. The Agency shall endeavor to inform the public of proposed construction timelines to minimize potential annoyance related to construction noise. This finding is supported by substantial evidence in the record of the proceedings before the Council. 18. Description of significant effect: NOISE: Potential for increase in secondary traffic noise to existing sensitive land uses. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The facts supporting such finding are as follows: a. Development shall be designed and located in a manner that will minimize the secondary traffic noise impacts. b. In existing noise sensitive areas, noise reduction measures such as retrofitting existing structures and neighborhoods with noise dampening equipment and construction of soundwalls, where feasible, shall be implemented. C. The Agency shall endeavor to provide acoustical reduction information, such as ceiling/roof and/or wall modifications to homeowners and commercial business owners who are considering reconstruction or remodeling to improve the dampening cpabilities of their structures. This finding is supported by substantial evidence in the record of the proceedings before the Council. RDD/EIRExhACC/CDC 10 6/28/90 19. Description of significant effect: NOISE: Potential for increase in secondary traffic noise impacts due to future sensitive land uses. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The facts supporting such finding are as follows: a. Structures in impacted locations shall be evaluated for their conformance to City noise standards. b. Acoustical analyses shall be conducted as part of subsequent environmental review for proposed projects which will generate a substantial number of motor vehicle trips in the area. C. Soundwalls and noise insulation strategies designed by an acoustical engineer shall be considered and installed where appropriate, and new buildings which face busy roadways shall be required to consider double paned windows, weather seals and other insulation measures. This finding is supported by substantial evidence in the record of the proceedings before the Council. 20. Description of significant effect: AIR QUALITY: Potential for temporary increase in airborne concentrations or dust or particulate matter due to construction The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The facts supporting such finding are as follows: a. Areas of soil redistribution shall be required to be watered down twice daily or as necessary to trap fugitive dust and particulates during construction and until plantings or grass growth or building coverage reduces the need or, if water is limited, soil binders such as soil cement shall be spread in conjunction with watering, or sheet coverings such as burlap shall be used on small areas. RDD/EIRExhACC/CDC 11 6/28/90 b. Construction shall be temporarily suspended during periods of excessive wind speeds. C. Disturbed areas shall be revegetated or paved as soon as possible to reduce dust during construction activities. This finding is supported by substantial evidence in the record of the proceedings before the Council. 21. Description of significant effect: AIR QUALITY: Potential for extension of the date of attainment of the ambient air quality standard for ozone due to vehicular emissions from future development that may be facilitated by redevelopment. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The fact supporting such finding is as follows: Due to lack of specificity on potential future development that may occur due directly or indirectly by redevelopment activities, specific projects will be reviewed on a project -by -project basis to determine their consistency with the Air Quality Act and mitigation measures shall be developed that will reduce vehicle miles traveled, such as reducing private automobile travel and increasing the use of mass transit and bicycle transportation. This finding is supported by substantial evidence in the record of the proceedings before the Council. 22. Description of significant effect: AIR QUALITY: Potential decrease in regional vehicular air quality due to development of FHK Commercial Complex and Wixon Ranch Subdivision. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. RDD/EIREAACC/CDC 12 6/28/90 The facts supporting such finding are as follows: a. Approval of the FHK Commercial Complex and Wixon Ranch Subdivision shall be subject to their agreement to implement specific transportation control measures to reduce daily VMT, such as routine bus access, bicycle lockers, preferential parking for carpools, vanpools and park-and-ride vehicles. b. The applicants of both FHK Commercial Complex and Wixon Ranch Subdivision shall be required to provide emission offsets approvable to the Shasta County Air Quality Management District of all induced emissions of non -methane hydrocarbons and oxides of nitrogen. This finding is supported by substantial evidence in the record of the proceedings before the Council. 23. Description of significant effect: VISUAL QUALITY: Potential for temporary unsightly views and obstructed views during construction. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The fact supporting such finding is as follows: Visual buffers such as temporary fences shall be installed during construction phases, wherever possible. This finding is supported by substantial evidence in the record of the proceedings before the Council. 24. Description of significant effect: VISUAL QUALITY: Potential for obstruction of views due to new development. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. RDD/EIREAACC/CDC 13 6/28/90 The facts supporting such finding are as follows: a. Projects facilitated by redevelopment shall be required to submit design plans which shall be reviewed by the City of Redding Planning Department for compliance with the Redding General Plan guidelines. b. Topographic conditions, grading operations, proposed landscaping, open space buffer zones, exterior building materials, and roof mounted equipment, if any, shall all be included within the City Planning Department's review of the proposed project. This finding is supported by substantial evidence in the record of the proceedings before the Council. 25. Description of significant effect: VISUAL QUALITY: Potential for interruption of existing view opportunities of the Sacramento River and removal of visually valuable riparian forest trees due to construction of proposed bridges. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The facts supporting such finding are as follows: a. The proposed bridges shall be designed with aesthetics as an important feature. b. The proposed bridges shall be designed in a manner that will preserve as many existing native oak, pine and riparian trees as feasible. This finding is supported by substantial evidence in the record of the proceedings before the Council. 26. Description of significant effect: VISUAL QUALITY: Potential for improper development of the Fern Subdivision which could result in removal of prominent hillsides which would be contrary to the Redding General Plan objectives. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which RDD/EIRExhACC/CDC 14 6/28/90 avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The facts supporting such finding are as follows: a. Development shall be designed to blend into the natural landscape and not obscure, detract from, or negatively affect the scenic quality of hillside areas. b. Dwellings and other structures shall be concentrated into neighborhood units in order to preserve large areas of open space and significant natural features. This finding is supported by substantial evidence in the record of the proceedings before the Council. 27. Description of significant effect: VISUAL QUALITY: Potential for reduction in open space lands in the southwest portion of the City of Redding due to the proposed project and subsequent projects facilitated by redevelopment. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The facts supporting such finding are as follows: a. Development shall be clustered in order to preserve more open space lands. b. Proposed projects shall be required to incorporate into their landscaping plans a program for vegetating recontoured slopes and lands with native vegetation where possible. This finding is supported by substantial evidence in the record of the proceedings before the Council. 28. Description of significant effect: VISUAL QUALITY: Potential for decrease in quality of night views due to street lighting of the Fern Subdivision site and the FHK commercial development. The fact supporting such finding is as follows: Lighting at the proposed Fern Subdivision and FHK Shopping Center shall be required to be of the type that will minimize glare and intrusion onto adjacent properties and views from the important view corridors, such as the use of lighting fixtures to focus light downward onto the site, the reduction of on-site lighting levels after 10:00 p.m. to the minimum required for safety and security, and the use of earth tone colors of lights. This finding is supported by substantial evidence in the record of the proceedings before the Council. 29. Description of significant effect: VISUAL QUALITY: Potential for interference of view opportunities and removal of trees to local residents due to proposed elevated grade separation at the intersection of South Market Street and South Bonnyview Road. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The facts supporting such finding are as follows: a. The City shall preserve existing native valley oaks wherever feasible. b. The proposed project shall be designed to avoid removal of valuable valley oak trees in order to minimize interference with viewsheds of local structures. This finding is supported by substantial evidence in the record of the proceedings before the Council. RDD/EIRExhACC/CDC 16 6/28/90 30. Description of significant effect: HYDROLOGY: Potential for increase in impervious surfaces and in the volume and velocity of storm water runoff due to secondary growth facilitated by redevelopment. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The fact supporting such finding is as follows: Drainage basin plans, consistent with areawide storm drain plans, shall be required to be prepared prior to any specific project approval. Description of significant effect: HYDROLOGY: Potential for flooding of new Westside Road Extension to Clear Creek Road and of potential development in the Olney Creek area. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The facts supporting such finding are as follows: a. The proposed Westside Road Extension shall be designed so that it is elevated above the flood levels. b. A storm drainage study shall be prepared prior to any development approved along Olney Creek in order to determine the feasibility of development near this creek. Description of significant effect: HYDROLOGY: Potential for increase in the quantity of street contaminants entering streams and rivers due to secondary growth facilitated by redevelopment. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof aE identified in the Final EIR. The facts supporting such finding are as follows: a. Parking areas for new public/ community buildings shall be required to include grease traps in order to reduce impacts on water quality. b. The City of Redding shall require future developments to mitigate increases in street contaminants such as oils and grease that enter surface waters in the project area, through adoption of an ordinance or other regulations or development approval requirements. This finding is supported by substantial evidence in the record of the proceedings before the Council. 33. Description of significant effect: HYDROLOGY: Potential for loss of groundwater recharge areas due to secondary growth facilitated by redevelopment. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The facts supporting such finding are as follows: The City of Redding shall consider the preparation of a study of recharge areas in the planning area and adopt ordinances that would protect groundwater recharge areas. Description of significant effect: HYDROLOGY: Potential for temporary increase in siltation due to in - stream construction. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The facts supporting such finding are as follows: a. Construction activities will be timed for seasons when decreased water quality will have the least impact. b. Proper in -stream construction techniques shall be required. This finding is supported by substantial evidence in the record of the proceedings before the Council. 35. Description of significant effect: GEOLOGY: Potential for excessive grading and alteration of the natural slope due to new residential development in the Fern Subdivision. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The fact supporting such finding as follows: Streets and residential lots in the Fern Subdivision shall be designed in a manner that will follow the natural slope of the hillside and reduce excessive cut and fill slopes. This finding is supported by substantial evidence in the record of the proceedings before the Council. 36. Description of significant effect: GEOLOGY: Potential for accelerated soil erosion during construction of proposed redevelopment projects. RDD/EIRExhACC/CDC 19 6/28/90 The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The facts supporting such finding are as follows: a. All new development shall be subject to the requirements in the City of Redding Grading Ordinance, including revegetation of cut and fill slopes and the use of energy dissipater devices in areas of concentrated storm flow. b. Excavation and grading of land shall be required to be done during a single dry construction season from May to October, wherever possible. C. Natural vegetation shall remain undisturbed where possible. d. Catch basins shall be used to retain sediment on-site. This finding is supported by substantial evidence in the record of the proceedings before the Council. 37. Description of significant effect: GEOLOGY: Potential for increase in slope instability due to shrink -swell action of expansive soils, corrosivity of soils and construction and development on slopes and river bluffs. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The fact supporting such finding is as follows: All projects where extensive earthwork will be required will have to submit a site specific geotechnical report prior to project approval which shall include recommended engineering and construction techniques to mitigate slope instability. Description of significant effect: GEOLOGY: Potential for structural damage to project structures due to severe groundshaking. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The fact supporting such finding is as follows: All project structures shall be designed in accordance with the seismic design requirements of the Uniform Building Code. This finding is supported by substantial evidence in the record of the proceedings before the Council. 39. Description of significant effect: ECOLOGY/ BIOLOGY: Loss in vegetation due to construction of redevelopment projects. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The facts supporting such finding are as follows: a. Vegetation removed as a result of redevelopment activities or secondary development shall be required to be replaced with native species which are of value to local wildlife. b. Native vegetation shall be retained wherever possible. This finding is supported by substantial evidence in the record of the proceedings before the Council. 40. Description of significant effect: ECOLOGY/ BIOLOGY: Potential for damage to vegetation being preserved due to its proximity to construction activities. RDD/EIRExhACC/CDC 21 6/28/90 The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The fact supporting such finding is as follows: The location of machinery, earthen or stockpiled materials produced or used during construction of redevelopment projects shall be kept away from the drip lines of trees, vegetated areas and drainage areas. This finding is supported by substantial evidence in the record of the proceedings before the Council. 41. Description of significant effect: ECOLOGY/ BIOLOGY: Potential for contamination of local streams due to possible use of pesticides and fertilizers on landscaping vegetation proposed in the downtown beautification project. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The fact supporting such finding is as follows: Landscaping of redevelopment projects for beautification shall be required to consist of native species wherever possible, as they require less irrigation, fertilizers and pesticides. This finding is supported by substantial evidence in the record of the proceedings before the Council. 42. Description of significant effect: ECOLOGY/ BIOLOGY: Potential for reduction in native habitat for birds due to removal of shrubs and small trees from the vacant parcel between Ellis Street and Favretto Street for the Eastside Road extension project. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. RDD/EIRExhACC/CDC 22 6/28/90 The fact supporting such finding is as follows: Areas of the vacant lot not used for the street extension shall remain in an open space use and shall be revegetated. This finding is supported by substantial evidence in the record of the proceedings before the Council. 43. Description of significant effect: ECOLOGY/ BIOLOGY: Potential for removal of valley oak and digger pine trees due to South Bonnyview Road widening, construction of the interchange and grade separation. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The facts supporting such finding are as follows: a. All roadway, bridge, or building construction and landscaping sites and pathways shall be designed in a manner that will avoid removal of mature native trees and other native vegetation wherever possible. b. Native trees, particularly oaks, shall have high priority for preservation. C. If oaks need to be removed, three oaks shall be planted for every one removed. d. Saplings shall be required to be surrounded by temporary mesh fences to prevent damage from grazing. e. Replacement trees shall be planted in designated open space areas or in reparian setback areas wherever possible. f. Prior to construction of the South Bonnyview Road interchange, the City shall consider alternative routes that would minimize the removal of trees. This finding is supported by substantial evidence in the record of the proceedings before the Council. RDD/EIRExhACC/CDC 23 6/28/90 44. Description of significant effect: ECOLOGY/ BIOLOGY: Potential for loss of vegetation and habitat due to Fern Subdivision reversion to acreage. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The facts supporting such finding are as follows: a. Construction activities shall be as limited in areal extent as is feasible to minimize wildlife habitat disturbance. b. Temporary fences shall be erected between construction sites and important wildlife habitat areas to protect the vegetation from being trampled by pedestrian and equipment access and storage. C. Preservation of native vegetation shall be required wherever possible. This finding is supported by substantial evidence in the record of the proceedings before the Council. 45. Description of significant effect: ECOLOGY/ BIOLOGY: Potential for removal of some streamside vegetation and loss of spawning habitat along Calaboose Creek due to storm drainage improvements. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The facts supporting such finding are as follows: a. A streambank revegetation program shall be required prior to commencement of the storm drainage improvements. b. The project shall incorporate gravel recruitment catchments into the channel for spawning habitat at regular intervals. This finding is supported by substantial evidence in the record of the proceedings before the Council. RDD/EIRExhACC/CDC 24 6/28/90 { 46. Description of significant effect: ECOLOGY/ BIOLOGY: Potential for disturbance of the sensitive riparian ecology of the tributaries in project area due to redevelopment construction activities, including loss of vegetation, greater topsoil erosion rates, increase in turbidity and loss of spawning habitat. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The facts supporting such finding are as follows: a. Grease traps and sediment catchment basins shall be installed in appropriate locations to capture runoff from impervious areas. b. The City shall initiate a natural streambed cleanup and maintenance program. C. A 1603 permit from the California Department of Fish and Game shall be required for any projects that would alter any natural watercourse in the Project Area. This finding is supported by substantial evidence in the record of the proceedings before the Council. 47. Description of significant effect: ECOLOGY/ BIOLOGY: Potential for decrease in natural gravel recruitment rates in project area streams due to project implementation. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The fact supporting such finding is as follows: The City of Redding shall monitor Calaboose Creek, Canyon Hollow, Oregon Gulch, Olney Creek and the Sacramento River to determine when additional gravels are necessary, and when decreases occur additional gravels from existing natural drainages that do not contain critical habitat shall be introduced. Description of significant effect: ECOLOGY/ BIOLOGY: Potential for destruction of spawning habitat due to siltation. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The fact supporting such finding is as follows: No development shall be allowed that will penetrate riparian buffer areas along streams as delineated by the 100 year floodplain boundary prepared by the Federal Emergency Management Agency. This finding is supported by substantial evidence in the record of the proceedings before the Council. 49. Description of significant effect: ECOLOGY/ BIOLOGY: Potential for removal of riparian forest vegetation on both banks of the river due to construction of bridges. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The facts supporting such finding are as follows: a. The proposed bridges shall be designed in a manner that will avoid removal of mature native trees and other native vegetation considered valuable to wildlife whenever possible. b. The machinery, earthen, or stockpiled materials produced or used during construction of the bridges shall be kept away from the drip lines of trees, vegetated areas, and drainage areas. This finding is supported by substantial evidence in the record of the proceedings before the Council. RDD/EIRExhACC/CDC 26 6/28/90 k 50. Description of significant effect: ECOLOGY/ BIOLOGY: Potential for elimination of significant vegetation between Parkview Avenue and the Sacramento River along the south bank of Calaboose Creek due to construction of Parkview Bridge as designed under Alternative A. The Council finds that as to such significant effect identified above, specific economic, social or other considerations make infeasible the project alteratives identified in the Final EIR. The facts supporting such finding are as follows: a. The no project alternative would not eliminate the traffic congestion. b. Alternative B would result in other significant affects that also could not be mitigated. C. Alternative A is the most direct route for the Parkview Bridge and the most cost-effective alternative for providing the needed bridge. This finding is supported by substantial evidence in the record of the proceedings before the Council. 51. Description of significant effect: CULTURAL RESOURCES: Potential for damage to known or unknown archaeological resources due to subsurface construction activities. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The facts supporting such finding are as follows: a. An archaeological study by a qualified professional archaeologist shall be required prior to construction of redevelopment projects in areas that have not been previously disturbed or in areas known to have archaeological resources, which study shall include recommendations to mitigate the potential damage. b. If archaeological resources are observed during construction activities, all land alteration work shall be halted immediately and a qualified RDD/EIRExhACC/CDC 27 6/28/90 t archaeologist shall be notified for the purposes of evaluating the finds and recommending acceptable courses of action. This finding is supported by substantial evidence in the record of the proceedings before the Council. 52. Description of significant effect: CULTURAL RESOURCES: Potential for disturbance of Indian burial sites during construction activities. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The fact supporting such finding is as follows: Upon discovery of any human remains during construction, all excavation or disturbance of the site shall be halted until a County Coroner has been informed, and if the human remains are of Native American origin, the Agency shall notify the Native American Heritage Commission within 24 hours. In addition, local Native American Associations and descendants of the deceased shall be informed and shall be requested to make recommendations for means of treating or disposing human remains and any associated grave goods as provided In Public Resources Code Section 5097.89. This finding is supported by substantial evidence in the record of the proceedings before the Council. 53. Description of significant effect: CULTURAL RESOURCES: Potential for removal of the historic field stone building located at Parkview and Freebridge due to construction of the Parkview Bridge. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. RDD/EIRExhACC/CDC 28 6/28/90 6 The fact supporting such finding is as follows: The City shall make every effort to preserve the field stone electric building and its historic integrity, through consultation with local historians, the Shasta Historical Society and the Office of Historic Preservation. Description of significant effect: CULTURAL RESOURCES: Potential for damage to Old Southern Pacific Station due to Yuba Street beautification projects. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The facts supporting such finding are as follows: a. Prior to construction of the Yuba Street beautification projects the City shall have the Old Southern Pacific Station inspected as to its stability, and if it is unstable, the City shall take measures to strenthen it to prevent damage during construction of the beautification projects. b. The City or Agency shall review and consider the possibility of improvements to enhance the structure and its immediate surroundings to ensure enjoyment of this historic structure by residents and visitors. This finding is supported by substantial evidence in the record of the proceedings before the Council. 55. Description of significant effect: CULTURAL RESOURCES: Potential loss of the Lodging House, a possible historic structure, due to Butte Street realignment to Placer Street. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. RDD/EIRExhACC/CDC 29 6/28/90 The fact supporting such finding is as follows: In the early planning stages of the Butte Street realignment, an architectural historian shall be retained to evaluate the historic significance of this structure, and, if determined to be significant, recommend measures to mitigate any potential removal. Description of significant effect: CULTURAL RESOURCES: Potential for loss of presently unknown historic resources due to redevelopment activities or activities due to secondary growth caused by redevelopment activities. The Council finds that as to such significant effect identified above, changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects thereof as identified in the Final EIR. The facts supporting such finding are as follows: a. Prior to construction of redevelopment projects which could result in damage or destruction to structures in the project area that are 45 years of age or older, an architecture historian shall examine the structures to determine if it is historically significant, and if it is historically significant, it shall be recorded on forms available from the Office of Historic Preservation. b. Projects resulting from growth induced by redevelopment shall be evaluated on a project -by -project basis as to its potential for removal or damage to historic resources.
