HomeMy WebLinkAboutReso 2018-070 - Randhawa Property RESOLUTION NO. 2018-070 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING ADOPTING THE MITIGATED NEGATIVE DECLARATION AND APPROVING AN AMENDMENT TO THE GENERAL PLAN DIAGRAM OF THE CITY OF REDDING RELATING TO THE LAND USE CLASSIFICATION OF THE RANDHAWA PROPERTY (APN 109-080- 007) CONSISTING OF APPROXIMATELY 1.2 ACRES LOCATED AT 2450 GOODWATER AVENUE IN THE CITY OF REDDING (GPA-2017- 00955) WHEREAS, the City Council adopted the General Plan on October 3, 2000; and WHEREAS, the amendment to the General Plan Diagram is desired to allow for the development of a 3,180-square-foot convenience gas mart and carwash as identified in Site Development Permit Application SDP-2017-01262; and WHEREAS, the Planning Commission held a duly noticed public hearing pertaining to said amendment on March 27, 2018, April 24, 2018, and May 8, 2018, for General Plan Amendment Application GPA-2017-00955 as described on the attached amendment to the General Plan Diagram and failed to make a recommendation to the City Council regarding said amendment because Government Code Section 65354 requires that a recommendation on a general plan amendment be supported by a "majority of the total membership" of the Planning Commission, and three votes were cast in favor of the motion to recommend approval of said amendment where a minimum of four votes was required; and WHEREAS, the Planning Commission has reviewed pertinent documents prepared in C accordance with the requirements of the California Environmental Quality Act and recommended that the Mitigated Negative Declaration be adopted for GPA-2016-00804 after consideration of all testimonial and written evidence submitted prior to and during the aforementioned public hearing; and C WHEREAS, the City Council held a duly noticed public hearing on GPA-2017-00955 on June 19, 2018; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Redding as follows: 1. The above recitations are true and correct. 2. The City Council has reviewed the proposed Mitigated Negative Declaration, all reports submitted by staff, and all testamentary and documentary evidence presented at the public hearing, and has determined that the actions contemplated will not have an adverse impact on the environment. 3. The City Council hereby adopts the Mitigated Negative Declaration for GPA-2017-00955 as referred to the City Council by the Planning Commission. 4.
