Code §6103 APN 116-030-011 RESOLUTION NO. 2018-035 A RESOLUTION OF APPLICATION BY THE CITY COUNCIL ORDERING THE VACATION AND ABANDONMENT OF ALLEY AND PUBLIC SERVICE EASEMENT FOR THE SHASTA COUNTY COURTHOUSE PROJECT (ABANDONMENT APPLICATION A-2018-00278) WHEREAS A. On June 20, 2011, by Resolution 2011-66, the City Council adopted a resolution approving a memorandum of understanding with the Judicial Council of California, Administrative Office of the Courts to vacate and abandon the hereinafter-described area of abandonment. The conditions set forth in the resolution were satisfied in 2018 upon relocation of utilities within the alleyway. B. Proceedings have been duly conducted and held in accordance with the provisions of the Public Streets, Highways, and Service Easements Vacation Law as set forth in Sections 8300 et seq., of the Streets and Highways Code of the State of California, including a public hearing held on April 17, 2018. C. The area of abandonment falls within the criteria of CEQA Section 15305 and is categorically exempt. C' CC NOW, THEREFORE, THE CITY COUNCIL FINDS, DECLARES AND RESOLVES AS FOLLOWS: C) A 1. The City Council elects to proceed in this matter under the provisions of California Streets and Highways Code Sections 8300 et seq. 2. The City Council approves the vacation and abandonment of the 20-foot wide alleyway and 10-foot wide public service easement within the block bounded by Oregon, Butte, Court, and Yuba Streets, described in Exhibit "A"and shown on Exhibit "B." 3. Pursuant to Streets and Highways Code §8324, the Council finds that the street segment is unnecessary for present or prospective public use. 4. Pursuant to Streets and Highways Code §8325, the City Clerk is directed to record a certified copy of this resolution, attested by the Clerk under seal, in the office of the Shasta County Assessor/Recorder. Reading Grant in the City of Redding, County of Shasta, State of California,being more particularly described as follows: All that certain strip of land 20 feet in width, being an alley,lying between lots 1 through 12 and lots 13 through 18 of Block 32 of the Original Town of Redding as per map thereof filed for record in Book of Town Plats at page 11, Shasta County Records. Together with that entire portion of a 10 foot wide strip of land for Public Service Easement purposes as described in that Easement Deed to the City of Redding,recorded on January 9, 2008 in Instrument Number 2008-0000662, Official Records of Shasta County.
